I finished my review of the plat and I have no remaining revisions needed. That said, I have not heard from ACSA yet, so
they may have revisions still needed.
Nicole — in your comment response letter you mentioned that a draft of the HOA covenants was included in the last
submittal. Your email to me only included the revised plat and your comment response letter. Can you send me the
draft HOA covenants?

David, please let me know the next steps for drafting the stormwater deed of easements. I believe the County is
drafting these now? I will also follow up with an email to the County Attorney with the HOA Declaration, and to

Thanks for your patience, I've spoken with some folks about that private street easement. Since those lots touch
Belvedere Boulevard, the easement does not need to touch their frontage since they are amenity oriented lots, per
the ZMA. If this was a standard subdivision that didn't have the ZMA Application Plan, the easement would need to
touch their property lines.
So, please disregard that comment in my letter. I will mark it as "no longer applicable" when the plat is submitted
for the next review.

Also, thanks for sending over the certificate of take. David James & I had not seen the recorded instrument
before, so you are correct, our GIS has an error. I'll share that info with David so he is aware. The comment about
needing an easement through the HOA parcel is void now based on this new information.
For the private street easement inside of the development, does it pose an issue to make the easement touch lots
8-13? You are correct that those lots all touch the Belvedere Boulevard ROW which is how they will obtain
frontage. The reason it's been commented on with the site plan/plat is that the actual internal access to those
lots will be gained via the private street easement in the amenity area, and not from Belvedere Boulevard. I know
that there isn't going to actually be vehicular driveways entering onto the new private street easement, but the
subdivision ordinance requires new lots to gain access from new streets established at the time of subdivision. In
this case, that would be the new private street.

It looks like really all that is left are draft deeds, HOA documents, and maintenance agreements. The fee has been
paid and should have been submitted with the materials (I apologize if it was not, see attached).
The second paragraph of comment 5 references the GIS Belvedere HOA parcel. I've addressed this several
times. That parcel is incorrectly labeled in the GIS. It was taken by VDOT for the construction of Belvedere
Boulevard. It is part of the Belvedere right-of-way. We do not need Belvedere HOA approval or a temporary
construction easement from them. See the attached Certificate of Take.
One thing I am still confused about is the frontage for Lots 12 and 13. I've attached the draft plat. Lots 12 and 13
appear to have frontage right onto the existing Belvedere Blvd right-of-way, but let me know if I am missing
something?
