The permitted uses of the Property are provided in Section 25 of Chapter 18 of the Albemarle County Code ("Zoning Ordinance"). The Property is subject to the Entrance Corridor Overlay District described in Section 30 of the Zoning Ordinance. • There is no pending zoning map amendment, special use permit, conditional use, special exception, or variance request on the Property. • The Property was developed a site development plan, SDP1984-00010 Burger King Final Site Plan. All ingress and egress to the Property to/from Riverbend Drive and Richmond Road (US Route 250) was approved with this plan and to the best of my knowledge remains in effect. • There are no additional conditions, variances, or special use permits associated with the Property. • To the best of my knowledge, the Property is currently in compliance with all applicable requirements of the Zoning Ordinance. A review of our files found (i) no violations or alleged violations or regulations applicable to the Property, whether pending, contemplated, or having already occurred and (ii) no fees due or pending with respect to any matter before the County Zoning Office; and (iii) no pending application for rezoning or for a special or conditional use permit or variance of the Property. Further, no proceeding to challenge the zoning or other governmental approval or use of the Property is pending or overtly threatened to the best of our knowledge. • In the event of a casualty, in whole or in part, the structure located on the Property may be built in its current form subject to the approval of a building permit and applicable site plans and building code. • Copies of any relevant records may be obtained via the noted links or the Community Development Department Records Public Access link below. If unable to find the records, a request may be made through the department's Records Manager, Paul Bjornsen, at pbiornsen(a)albemarle.oro.
