Design Focused Engineering March 17, 2022 Cameron Langille County of Albemarle Department of Community Development 401 McIntire Road, North Wing Charlottesville, Virginia 22902 RE: Response Letter #1 for SLTB2021-00159 Bamboo Grove Road Plan - Planning Dear Cameron, Thank you for your review of the Road plan for Bamboo Grove. This letter contains responses to County comments dated October 27, 2021. Our responses are as follows: 1. [ 14-422] Per the proffered concept plan approved with ZMA201900016, the sidewalk along the south side of the private street must extend all the way to the property line along Orchard Drive. Please add additional sidewalk alone the frontage of Lot 6 to connect to Orchard Drive. Sidewalk now extends across Lot 6 to Orchard Drive. 2. [ZMA201900016] Per proffer #3B of 7-MA201900016, the dedicated of the 0.22 acre open space area and construction of the trails within it must be dedicated to the County prior to the third certificate of occupancy for the project. The developer may dedicated the 0.22 acre area with the final plat creating the new lots. A Zoning Performance Bond will likely need to be provided as part of the road plan approval in order to ensure that the trails are constructed. Noted. I have advised the client of these requirements. It appears that a performance bond is not required, as the trail would need to be built to the satisfaction of the county before issuance of a 3' CO. In this case, the CO would be the enforcement item to ensure this trail is built, so it seems that a bond will be redundant and not necessary, as the developer will be eager to obtain CO's as soon as possible after the permitting process is complete. The open space is in the subdivision plat, and the subdivision plat must be recorded before issuance of the first CO. Thus, both proffered items will be effectively met before issuance of the 3' CO. 3. [Advisory Comment] A private street maintenance agreement will need to be reviewed, approved, and recorded with the final subdivision plat. Noted, thank you.
