THIS DEED, made this 27th day of December, 1990, by and
between PEPSI-COLA BOTTLING COMPANY OF CENTRAL VIRGINIA, a Virginia
corporation, Grantor, party of the first part, and JA-ZAN LIMITED
PARTNERSHIP, a Virginia limited partnership, Grantee, party of the
second part, whose address is: P.O. Box 9035, Charlottesville VA
22906;
W I T N E S S E T H:
That for and in consideration of the sum of TEN DOLLARS
($10.00), and other good and valuable consideration, the receipt
of which is hereby acknowledged, the said Grantor does hereby
GRANT, BARGAIN, SELL and CONVEY with GENERAL WARRANTY and ENGLISH
COVENANTS OF TITLE unto the Grantee, the following described
property lying in Albemarle County, Virginia described as:
(1) 5.566 acres with all improvements thereon and
appurtenances thereto described as Tract A on plat of Roudabush,
Greene & Gale, Inc., entitled "Subdivision Plat of Tract A & Tract
B 'Pepsi Place"' dated November 10, 1981, last revised October 11,
1983, and recorded in the Clerk's Office of the Circuit Court of
Albemarle County in Deed Book 817, Page 231. This is a portion of
the property conveyed to Grantor by deed of Hurt Investment
Company, et. al, dated November 19, 1980, and recorded in the
aforesaid Clerk's Office in Deed Book 705, Page 334.
(2) 1,77G acres with all improvements thereon and
appurtenances thereto described as Tract B-1A on attached plat of
Roudabush, Gale & Assoc., Inc., dated December 27, 1990 entitled
"Subdivision Plat of Tracts B-lA and B-1B a Division of Tract

B-1 Shown on a Plat in Deed Book 1034, page 7 Charlottesville
District, Albemarle County, Virginia". This is a portion of the
property conveyed to Grantor by deed of Hurt Investment Company at.
al dated November 19, 1980 and recorded in the aforesaid Clerk's
office in Deed Book 705, page 334.
There is conveyed to the Grantee as an appurtenance to Tract
B-1A an unexclusive easement for parking over "Area All and "Area
B" as shown on the attached plat.
The Grantor further conveys to the Grantee as an appurtenance
to Tract B-lA an unexclusive fifteen (15) foot storm sewer easement
as it crosses Tract B-1B as shown on the attached plat and an
unexclusive easement for drainage and run off of surface water
within the area designated as "Storm Detention Easement".
The two parcels are conveyed subject to the easements,
conditions, restrictions, and reservations contained in duly
recorded deeds, plats and other instruments constituting
constructive notice in the chain of title to the property hereby
conveyed, which have not expired by limitation of time contained
therein or have not otherwise become ineffective and any lien,
inchoate or otherwise for real estate taxes and assessments not yet
due and payable.
