THIS DEED, made and entered into this 8th day
of June, 1978, by and between MICHAEL PETER MURRAY and ROSANNE
DUCEY MURRAY, husband and wife, parties of the first part;
ARTHUR PAUL PETTY, JR. and SIMA BETH GOODHARTZ, husband and wife,
THE RECTOR A14D VISITORS OF THE
parties of the second part; UNIVERSITY OF VIRGINIA, Bondholder,
party of the third part; RALPH E. MAIN, JR. and GARY C. McGEE,
Trustees, parties of the fourth part; UNITED VIRGINIA BANK,
Bondholder, party of the fifth part; RALPH E. MAIN, JR. and
DENNIS MILLER, Trustees, parties of the sixth part; and BISCUIT
RUN, INC., a Virginia corporation, party of the seventh part,
W I T N E S S E T H:
That for and in consideration of the sum of
TEN DOLLARS ($10.00) cash in hand paid and other good and valuable
consideration, the receipt of which is hereby acknowledged, the
parties of the first part do hereby GRANT, BARGAIN, SELL and
CONVEY with GENERAL WARRANTY and ENGLISH COVENANTS OF TITLE unto
the parties of the second part as tenants by the entirety with
full rights of survivorship as at common law and not as tenants
in common the following described property, to -wit: All that
certain tract or parcel of land with the improvements thereon and

northern side of State Route 631, containing 2.0 acres, more or
less, and designated as Parcel A-2 on a plat of B. Aubrey Huffman
and Associates, Ltd., dated May 13, 1978, which said plat is
hereto attached and made a part of this deed and to which
reference is made for a more particular description of the
property hereby conveyed. This is a portion of the property which
was conveyed unto the parties of the first part by.deed of George

L. Bailey et ux dated July 24, 1975 and recorded in the Clerk's
Office of the Circuit Court of Albemarle County, Virginia in
Deed Book 578 at Page 73.

The parties of the first part do further (:RANT
and CONVEY unto the parties of the second part as an appurtenance
the use of the *,Yell
to the property hereby conveyed the right to
and the water therefrom located on Parcel A-1 as shown and depicted
on the plat hereto attached. Right to the use of said well and
the water therefrom shall be subject to the following terms and
conditions:
1. The owner or owners of Parcel A-2 sh-ill
have a 15' wide easement across Parcel A-1 for the location of
water service lines.
2. All present and future owners of Parcel
A-2 shall install and maintain a separate waterline runnincr
directly from said well to Parcel A-2. No present or futu::e
owners of Parcel A-1 shall be responsible for the installa:ion,
maintenance or any cost associated with such separate water line.
3. All present and future owners of Parcels
A-1 and A-2 will share equally the full expense of maintaining
the well in proper running condition. The cost of electricity
for operating the pump on said well shall also be equally divided
among the owners of the two parcels.
4. The present and future owners of Parcel
A-2 shall not use the water from said well to supply water to
other than a single family residence located on said Parcel A-2.
5. In the event that the owner or owi,ers of
Parcel A-1 or Parcel A-2 cease to provide or contribute •:o the
maintenance of said well, such maintenance to include th> provision
of electricity to operate the pump, then the owner or owners of
either parcel shall have the right to continue the operation and
maintenance of said well at their own expense.

As evidenced by their acceptance and
recordation of this deed, the parties of the second part, for
themselves, their heirs, assigns and successors in interest
accept and agree to be bound by the foregoing terms and conditions
respecting use of the well.

The property hereby conveyed is made subject
to the conditions, easements and restrictions affecting same.
By a deed of trust dated July 29, 1975 and

recorded in the aforesaid Clerk's Office in Deed Book 578 at
Page 76, the parties of the first part conveyed certain property,
including said Parcel A-2, to the parties of the fourth part,

Trustees, to secure payment of a certain indebtedness therein
more particularly described payable to The Rector and Visitors of

For and in consideration of the sum of FIVE DOLLARS ($5.00) cash
in hand paid and other good and valuable consideration, the
receipt of which is hereby acknowledged, the party of the third
part, as evidenced by its joining in this deed, agrees to release
the said Parcel A-2 and the well use right appurtenance from the
lien of said deed of trust, and directs the parties of the fourth
part to effect said release. Accordingly, the parties of the fourth
part, Trustees, do hereby GRANT, RELEASE, QUITCLAIM and CONVEY unto
the parties of the second part free and clear from the lien of
said deed of trust recorded in Deed Book 578 at Page 76 said
Parcel A-2 and the well use right appurtenance, but in all other
respects said deed of trust shall remain in full force and effect.

By a deed of trust dated June 30, 1977 and
recorded in the aforesaid Clerk's Office in Deed Book 624 at
Page 198, the parties of the first part conveyed certain property,
including said Parcel A-2, to the parties of the sixth part,

of the sum of FIVE DOLLARS ($5.00) cash in hand paid and other
good and valuable consideration, the receipt of which is hereby
acknowledged, the party of the fifth part, as evidenced by :.ts
joining in this deed, agrees to release the said Parcel A-2
and the well use right appurtenance from the lien of said d-:ed
of trust, and directs the parties of the sixth part to effect
said release. Accordingly, the parties of the sixth part,
Trustees, do hereby GRANT, RELEASE, QUITCLAIM and CONVEY unto
the parties of the second part free and clear from the lien of
said deed of trust recorded in Deed Book 624 at Page 198 said
Parcel A-2 and the well use right appurtenance, but in all other
respects said deed of trust shall remain in full force and effect.
The party of the seventh part, for and :.n
consideration of the sum of ONE DOLLAR ($1.00) cash in hangl paid
and other good and valuable consideration and as evidenced by
its joining in this deed, releases any and all claims of aay
nature whatsoever it may have in and to the above-describel
property by virtue of an unrecorded sales contract between it and
the parties of the first part dated May 11, 1978.
