To Whom It May Concern:
In response to your request for a Letter of Zoning Compliance for the above -referenced
Property, please be advised of the following:
The Property is zoned PUD, Planned Unit Development, per ZMA1985-00029, approved
May 7, 1986, with proffers, and ZMA1996-00021, approved February 12, 1997, with
proffers. The permitted uses of the Property are provided in Section 20 of Chapter 18 of
the Albemarle County Code ("Zoning Ordinance") but are limited by the proffers per the
noted ZMAs. The Property is subject to the Airport Impact Area and Steep Slopes
Overlay Districts described in Section 30 of the Zoning Ordinance.
• The use of the Property for Ting Fiber is permitted as
Storage/Warehousing/Distribution/Transportation and Industrial offices.
• The Property is subject to site plan SDP2004-21 Service Master Final, and SDP2005-115
Service Master Minor the most recently approved site plans associated with the Property.
It appears the Property has been developed in accord with this approved plan.
• No application for rezoning of the Property, or for a special or conditional use permit or
variance in connection with the Property, is now pending.
• To the best of my knowledge, the Property is currently in compliance with all applicable
requirements of the Zoning Ordinance. A review of our files found (i) no violations or
alleged violations or regulations applicable to the Property, whether pending,
contemplated, or having already occurred and (ii) no fees due or pending with respect to
any matter before the County Zoning Office; and (iii) no pending application for rezoning
of the Property. Further, no proceeding to challenge the zoning or other governmental
approval or use of the Property is pending or overtly threatened to the best of our
knowledge.
• In the event of a casualty, in whole or in part, the structure located on the Property may
be built in its current form subject to the approval of a building permit and applicable site
plans and building code.
• Copies of any relevant records may be obtained via the noted links or the Community
Development Department Records Public Access link below. If unable to find the
records, a request may be made through the department's Records Manager, Paul
Bjornsen, at pbiornsen(a)albemarle.oro. If the request is not based in Virginia, it will take
longer to fulfill.
