RE: Response Letter #3 for SUB2021-00102 HTC Area C Townhomes Block II and
SUB2021-00165 HTC Area C Townhomes Block III - Planning
Dear Andy,
Thank you for your review of the Subdivision Plats for HTC Area C Townhomes Block II and Block ID.
This letter contains responses to County comments dated January 28, 2022. Our responses are as follows:
1. For ease of review, all comments for both plats are included in this review letter. However, for
subsequent submittals, please continue to ensure that each is re -submitted separately with the
appropriate application number.
Noted, for continuation of this convenience we will keep our comment response for both
blocks in a single letter as well — these will be submitted with both plats for SUB2021-101
and SUB2021-165 (will be redundant).
Both Plats:
2. These plats do not match the final site plan that is currently under review for these same parcels
(SDP2020-00063). The final site plan and the final subdivision plat must be in conformance with
one another. Additional comments may be provided based on the subsequent layout of the site
plan, including the need for additional easements, or the re -subdivision of lots (if the plat is
recorded first). Comment still applies. The subdivision plats must match with the site plan.
VSMP and road plans must be approved prior to approval of subdivision plats.
Noted. Recent delay in resubmittal has been ensuring coordination between all submittal
plans and plats. This has now been achieved.
3. As attached single-family houses are proposed for this development, a final site plan is required.
Comment still applies. An approved final site plan is required for this development.
Final site plan SUB2020-63 which matches both plats has been resubmitted on 03-21-2022.
4. Deeds will be required for easements. Comment still applies. Deeds are required for easements
prior to approval of the subdivision plat.
Noted. We have notified the project coordinator Charlie Hurt. Deeds will be submitted by
his attorney.
5. HOA documents, such as a declaration of covenants and restrictions, are required, with
appropriate maintenance agreements, identifying the party(ies) responsible for ownership and
perpetual maintenance of private assets or facilities in common ownership, such as the access
easements. Comment still applies. These documents are required prior to approval of the
subdivision plat.
Noted. We have notified the project coordinator Charlie Hurt. HOA Docs will be submitted
by his attorney.

6. Comment addressed.
7. Ensure future submittals of the plats have dates of last revision. Comment continues to apply to
all future submittals.
This is provided.
8. Provide a written note on each plat, or show graphically, the required setbacks for the parcels in
each block. Comment partially addressed. For Block HI, the build to lines come from ZMA2001
00020. Revise the setbacks note on the Block M plat.
Noted, setbacks note revised.
Block III Plat — SUB2021-00165
9. The property in Block III is zoned Planned Development — Mixed Commercial (PDMC), pursuant
to ZMA2001-00020 (not NMD, with ZMA2017-00005). Revise note #7 on this plat. This property
is subject to ZMA2001 00020. It was not a pan of the rezoning application ZMA2017 00005. This
comment does not appear to have been addressed.
This note has been fixed.
10. Identify whether the proposed 30' access easement on the Block III plat is a private street
easement or a private alley easement. This comment has not been addressed. Clarify distinction
between new 30' access easement and new 30' private alley easement. If no distinction, they
should have an identical label.
It is an access easement, the labels now match.
Block II Plat — SLTB2021-00102
11. Comment addressed.
Noted, these are provided.
12. Private streets have not been approved for this block at this time. Requests for private streets in
the development areas must be submitted to the Community Development Department, with
justification, for staff to analyze and review. If approved, the labels will need to be changed to
"private street right-of-way." Final site plan is required for this development and must be re
submitted for review. Comment not fully addressed revise labels to private street right of way.
Comment partially addressed. Labels appear to identify "private streets," which is the correct
terminology. However, the private streets have not been approved at this time. The final site plan
is required and must be re -submitted for review.
Final site plan SUB2020-63 which matches both plats has been resubmitted on 03-21-2022.
13. Comment addressed.
