Subject: SLTB202200030 Combination Easement and Special Lot Plat — Animal Wellness Center
The County of Albemarle Planning Division will grant or recommend approval of the plat referenced above once
the following comments have been addressed: [Each comment is preceded by the applicable reference, which is
to the Subdivision/Zoning Ordinances unless otherwise specified.]
1. [14-302(6)(7)] Revise Note 6 to state that the subject parcel is within the Lickinghole Creek Water Supply
Watershed. Note 8 can be removed. Comment addressed.
2. [14-302 (B)(1)] Please add a date of last revision. Comment stands.
3. [14-302A] Include the standard note that the parcel contains a building site that complies with Section 4.2.1
of the Albemarle County Zoning Ordinance. Comment addressed.
4. [14-303(I)] See Engineering comment below. Comment addressed.
5. [14-303 (L)] New public drainage and stormwater facility easements will require a deed of dedication to be
recorded with the plat. Once all revisions to the plat have been made, staff from the Engineering Division
will draft the deeds and transmit them to the applicant. When the plat is ready to be submitted to the County
for signature/approval, signed hard copies of the deeds will also need to be submitted so that the County
Executive and County Attorney can sign them. Please contact Engineering Division staff directly if you
have further questions about the deeds. Comment stands.
6. [14-302(14)] There are two options for dedicating the land to public use.
a. The Plat can have a label/callout that identifies the acreage of the land and a note that states that this R/W
is hereby dedicated to the County for public use, or.
b. The land can be formally dedicated to the Commonwealth of Virginia (VDOT) for public use as seen in
the most recent submittal. This option requires a deed of dedication that will need to be reviewed and
approved by VDOT prior to plat approval. The County will not sign and approve the Plat until this deed
is ready for recordation along with the plat.
c. Staff recommends option a above. Please revise the note as seen in the previous submittal below.

Albemarle County Engineering Services (Engineer) —John Anderson, janderson2@albemarle.org —No
objection.
Once all plat review comments are addressed, and once SWM Facility Maintenance Agreement is recorded (not
sure if it is, or not,... will check), then Engineering can format SWM Facility /public drainage deeds, and
forward to CAO (County Attorney's Office) for review. Please let me know when all reviewers' comments
have been addressed. We will format deeds as soon as possible.
Albemarle County Service Authority (ACSA) — Richard Nelson, melson@serviceauthority.org — Requested
changes, see comments below.
We have reviewed SUB202200030 and understand that the ROW dedication will eliminate the need for the
linear easement along the frontage of the property. Please update your plat to include the second ACSA
PC
easement extending perpendicular to Crozet Avenue. You are already showing the water meter easement. The
second easement covers the fire hydrant that will be installed with the Crozet Phase 4 WMRP. I've attached the
ACSA deed and plat depicting the easement. See attached.

This Deed is exempt from recordation taxes and fees pursuant to §§58.1-811 (A) (3) and
17.1-266, respectively, of the Code of Virginia (1950) as amended and the Constitution
of Virginia, Article X, Section 6 (a) (1).
This DEED OF EASEMENT, made this day of
by and between ANNMAE HOLDINGS, LLC, a Virginia limited liability company
("Grantor"), and the ALBEMARLE COUNTY SERVICE AUTHORITY (the
"ACSA"), ("Grantee"), whose address is 168 Spotnap Road, Charlottesville, Virginia
22911.
WITNESSETH:
That for and in consideration of the sum of ONE DOLLAR ($1.00) and other good
and valuable consideration, receipt of all of which is hereby acknowledged, the Grantor
does hereby GRANT and CONVEY with GENERAL WARRANTY and ENGLISH
COVENANTS of TITLE unto the Albemarle County Service Authority a perpetual right
of way and easement to acquire, construct, install, maintain, repair, replace and extend a
water line consisting of pipes and appurtenances thereto, over, under and across the real
property of the Grantor located in Albemarle County, Virginia, the location of the
easement granted and the boundaries of the property being more particularly described on
the following plat:
A permanent water line easement, approximately 3,020 square feet, shown and described
on plat of the Albemarle County Service Authority, dated April 1, 2021 (the "Plat'), as it
crosses property of the Grantor described on the Plat as "P.I.N. 056A2-01-00-00700,
AnnMae Holdings, LLC, # 1100 Crozet Avenue" and being a portion of the property
acquired by the Grantor in Deed Book 5446, Page 549; PROVIDED HOWEVER, that it
is expressly understood and agreed that the Grantee shall not be deemed to have accepted
the conveyance set forth hereinabove until such time as the same shall have been
evidenced by the affirmative acceptance thereof in accordance with the usual and
customary practices of the Grantee.
Reference is made to the Plat, a copy of which is attached hereto to be recorded
herewith, for the exact location and dimension of the permanent easement hereby granted
and the property over which the same crosses.
As part of the easement the ACSA shall have the right to enter upon the above
described property within the easement for the purpose of acquiring, installing,
constructing, maintaining, repairing, replacing and extending a water line and
appurtenances thereto, within such easement and the right of ingress and egress thereto as
reasonably necessary to acquire, construct, install, maintain, repair, replace and extend
such water line. If the ACSA decides in its sole discretion that it is unable reasonably to
exercise the right of ingress and egress over the right-of-way, the ACSA shall have the
right of ingress and egress over the property of Grantor.
Whenever it is necessary to excavate earth within such easement, the ACSA
agrees to backfill such excavation in a proper and workmanlike manner so as to restore
surface conditions to the same condition as prior to excavation, including restoration of
such paved surfaces as may be damaged or disturbed as part of such excavation.
Grantor, their respective successors or assigns, agree that no trees, shrubs, fences,
buildings, overhangs or other improvements or obstructions shall be placed within the
easement conveyed herein.

The easement provided for herein shall include the right of the ACSA, to cut any
trees, brush and shrubbery, remove obstructions and take other similar action reasonably
necessary to provide economical and safe water line installation, operation and
maintenance. The ACSA shall have no responsibility to the Grantors, their successors or
assigns, to replace or reimburse the cost of said trees, brush, shrubbery and obstructions
that are removed or otherwise damaged.
The facilities constructed by ACSA within the permanent easement shall be the
property of the ACSA which shall have the right to inspect, rebuild, remove, repair,
improve and make such changes, alterations and connections to or extensions of its
facilities within the boundaries of the permanent easement as are consistent with the
purposes expressed herein.

The Department of Transportation, Charlottesville Residency Transportation and Land Use
Section, has reviewed the above referenced plan as submitted by Foresight Survey, P.C., dated
10 February 2022, and offer the following comments.
Land use
1. Proposed right of way labeling will need to be changed to; dedicated to the
Commonwealth of Virginia, for public use. Route 240 is a primary road, and in most
circumstances right of way dedications, are to be dedicated to the Commonwealth of
Virginia.
2. The applicant will need to provide VDOT with an environmental report, stating that
there's no hazardous material in the dedication area.
3. Attached you'll find the deed of dedication form to the Commonwealth of Va., please
have the applicant fill out and notarize. Once this has been completed, it will need to be
QC and QA by our Right of Way section manager, for accuracy, before the State Right
Way Director signs the deed. Please forward this back with your response letter.
A VDOT Land Use Permit will be required prior to any work within the right-of-way. The
owner/developer must contact the VDOT Charlottesville Residency Land Use Section at
(434) 422-9399 for information pertaining to this process.
