Subject: SUB2020-00201 Old Trail Block 32 Lots 64-70 — BLA; Resubmittal

The County of Albemarle Planning Division will grant or recommend approval of the plat referenced
above once the following comments have been addressed: [Each comment is preceded by the applicable
reference, which is to the Subdivision/Zoning Ordinances unless otherwise specified.]
1. [14-302(A)3; 14-303(E)] Revise the label of Bishopgate Place on sheet V3 to state that it is
a "V/W Private Street," instead of using the term "right-of-way."
2. [14-302(B)1] Provide the date of the last revision of the plat on future submittals of this
plat.
3. [14-302(B)5] The Zoning District note on the cover sheet needs to be revised with the
following information:
a. The only overlay district that applies to these parcels is the Entrance Corridor. The other
ones that are listed need to be removed.
b. It doesn't appear that any part of the subject lots is a part of the RA zoning district. It
appears that all of these parcels are zoned NMD. Remove the RA zoning designation
from the note.
c. There is a typo in the setback note misspelling "rear."
d. Add an additional note under the zoning section that states these lots are subject to
SE202100005, which was approved on March 23, 2021. Include the conditions of
approval as well — for the private street, the sidewalk modification, and the planting
strip modification.
4. [14-302(B)9] Revise the Flood Hazard Overlay District note on the cover sheet, as it does
not appear that any of these lots lie within the flood hazard overlay.
5. [14-302(B)10] Include the following three conditions under the note on the plat about the
stream buffer special exception that was approved in 2019, as these conditions are a part of
that approval:
STREAM BUFFER MITIGATION SHALL BE PROVIDED AT A 2:1 RATIO IN ACCORDANCE WITH
A BUFFER MITIGATION PLAN FOR OLD TRAIL VILLAGE ZMA2015-001, AS APPROVED BY THE
COUNTY ENGINEER.
2. DISTURBANCE TO THE BUFFER SHALL BE LIMITED TO THE AREAS DEPICTED ON PAGES 14
OF THE EXHIBIT PREPARED BY ROUDABUSH, GALE & ASSOCIATES, INC., ENTITLED "WPO
STREAM BUFFER IMPACT EXHIBIT BLOCKS 19, 24-25, 32-43" DATED JANUARY 23, 2018, WITH
A REVISION DATE OF DECEMBER 6, 2018.
3. MODIFICATION OF THE "OPEN GREEN SPACE" SHALL BE LIMITED TO THE AREAS DEPICTED
ON PAGES 14 OF THE EXHIBIT PREPARED BY ROUDABUSH, GALE & ASSOCIATES, INC.,
ENTITLED "WPO STREAM BUFFER IMPACT EXHIBIT BLOCKS 19, 24-25, 3243" DATED
JANUARY 23, 2018, WITH A REVISION DATE OF DECEMBER 6, 2018.
6. [14-303(A)] The statement of consent to division needs to include the identification of lots
64 and 66-70 in the plat title, after "... following described land... "
7. [14-303(N)] Provide the following note on the cover sheet of the plat: "The streets in this
subdivision may not meet the standards for acceptance into the secondary system of state
highways and will not be maintained by the Virginia Department of Transportation or the
County of Albemarle."
8. [14-302(A)(4) and 14-317] An instrument/maintenance agreement evidencing maintenance
of all improvements and easements that will be owned by the HOA will be needed before
approval of the final plat. The maintenance agreement will need to specifically mention who
is responsible for maintenance of improvements. The Old Trail Community Association, Inc.
(if this is the correct organization maintaining the private improvements), will need to sign
the maintenance agreement, and this will need to be reviewed and approved by the County
Attorney and recorded with the County Clerk at the same time as the final plat.
To satisfy this requirement, it appears that an amendment to the Supplemental Declaration of
Covenants and Restrictions that was approved with the Block 32 final plat (SUB2019-00137)
would suffice. This document is needed to ensure the Old Trail HOA is responsible for the
maintenance of the improvements in the private street right-of-way — the street itself and the
sidewalk and planting strip on the side where lots 64 and 65 are located.
