I was closing out WP0201800027, and wanted to ensure recorded copy of SUB202000089 (SWM + public drainage easement
plat /deeds for )VP0201800027) was in CV. It is, but may take a few minutes to be visible (public drainage deed /plat at bk.-
pg. 5372-700 (8/21/20); SWM facility deed /plat at bk.-pg. 5368-620 (8/14/20)). No loose ends!

Hi John,
I don't think so, I am still waiting for the County Exec to sign the deed for SUB202000089 but that should happen in the
next day or two. Once that is done, the applicant just needs to get the other plats recorded and then we can do the site
plan approval.

We are a little confused about comment #3.
[14-302 (A)(11)] Please be aware that two other plats for these parcels is currently under review:
SLJB202000089 and SUB202000115. Please revise instrument numbers in the parcel labels accordingly
to state the correct instrument numbers for TMPs 78-20M5 and 78-20M6. Rev. 1: Comment stands,
please update parcel labels once SUB202000089 and SUB202000115 are recorded.
Not sure what you mean by update parcel labels? The only thing we can figure is that you would like us
to add the recently recorded easement plats with plats already listed under *TMP 78-20M6* label as well
as TMP 78-20M5 label. We are listing them under "see plats recorded at for additional
easements already.
We can do this if you want, and it does not hurt anything, but typically in this area of a plat we only
identify deeds/plats if they were part of an ownership transfer or changed the overall boundary of the
parcel.
If I am off base and you are actually asking for something else, please give me a call. 540-294-2961

Good news —this plat is ready for approval once SUB202000089 and SUB202000115 are recorded and
the easement and parcel labels are updated so that the correct instrument numbers are referenced. As
a reminder, SUB202000115 was approved earlier today and is ready for pick-up and
recordation. SUB202000089 was approved back on August 13th, and I believe you have had it
recorded. I still mentioned SUB202000089 in the comment letter simply because I don't know the
recorded instrument number.
One last thing, the County Attorney's office had some minor revisions to the draft declaration, and I've
attached his edited version with track changes turned on. Once this plat is ready to be submitted for
County signatures, please be sure that the declaration you submit is the version that incorporates the
attorney edits.
You can just email a revised copy of the plat once the other two applications have been recorded and
this one is updated. I'll look at it immediately and confirm that you can submit hard copies for approval.

and bicycle access over a travelway and sidewalk within an apartment complex. The easement will allow pedestrians
and bicyclists to use the travel way/sidewalk and access a County -owned parcel that is adjacent to the development.

easement so that it describes the easement's purpose, and maintenance responsibilities.

Yes, Engineering has said they have no objection. I transmitted the sidewalk declaration to the County Attorney for
review. If he has changes, I'll email those to your team. I will look over the revised plat today, but I believe the only
thing will be to update recorded instrument numbers for all of the easement plats/boundary line adjustments that are in
process of being approved/recorded.

We are almost certainly going to record the plat he mentions before this one. If we are to show all of the
easements per this plat it is going to create a really cluttered up/difficult to read plat. We show these
easements on the other related plats, do we really need to show these on this plat again? I'm asking you as
he is calling it a recommendation and defers to planning. I agree with John that typically it is helpful to show
all relevant easements on a property, but in this case I think it will make a more confusing product for
everyone in the end if we do this. We deal with projects all the time in which we have to look at multiple
plats to get all of the pieces, its kind of the name of the game for us and should not be a problem for any
surveyor in the future. Let me know your thoughts, we are trying to get this plat back to you guys ASAP.

Good evening everyone,
Attached you will find the first review comments for this plat.
As has previously been discussed with Alan & Scott Collins (CC'd), the final site plan for Presidia
Apartments needs a new access easement over one of the travel ways and sidewalks within the
development to allow for pedestrian and bicyclist public access down to the Rivanna River greenway
system. This easement needs to be recorded prior to final site plan approval. In the interest of time,
staff suggests adding this new easement as part of this plat instead of submitting a separate plat
application for the access easement.
Scott is showing the new access easement on the most recent version of the site plan that has been
submitted to the County, so please coordinate with him to verify the accurate location within TMP 78-
20M6. You will see that my comments identify the necessary changes which need to be made to the
plat in order to address this matter.
The easement will also require a declaration and maintenance agreement, and I've attached an example
of a similar easement done for another project. The highlighted yellow text are the sections of the
declaration that definitely need to be updated. If you believe any other sections need to be revised to
accurately describe this project, easement, etc. please make those edits as well. When you submit a
revised plat to me, please include a draft of the declaration. I will forward this to the County Attorney
for review.

Yes, Engineering has said they have no objection. I transmitted the sidewalk declaration to the County Attorney for
review. If he has changes, I'll email those to your team. I will look over the revised plat today, but I believe the only
thing will be to update recorded instrument numbers for all of the easement plats/boundary line adjustments that are in
process of being approved/recorded.

We are almost certainly going to record the plat he mentions before this one. If we are to show all of the
easements per this plat it is going to create a really cluttered up/difficult to read plat. We show these
easements on the other related plats, do we really need to show these on this plat again? I'm asking you as
he is calling it a recommendation and defers to planning. I agree with John that typically it is helpful to show
all relevant easements on a property, but in this case I think it will make a more confusing product for
everyone in the end if we do this. We deal with projects all the time in which we have to look at multiple
plats to get all of the pieces, its kind of the name of the game for us and should not be a problem for any
surveyor in the future. Let me know your thoughts, we are trying to get this plat back to you guys ASAP.

use a travel way and sidewalk within a private development to comply with a proffer. The easement will allow
pedestrians and bicyclists to use the travel way/sidewalk and access a County -owned parcel that is adjacent to the
development. The County would not maintain any of the improvements within the easement. I've CC'd Tim Padalino
because he is working on the review of the site plan with me.
This is not a common situation encountered during plan reviews, and I have some questions:
1. 1 assume this would need to be shown on a plat as a public access easement hereby dedicated to the County. Is
"public access easement" an acceptable title for such an easement?
2. My understanding is that all "public" easements require deeds. Is that true, or could the developer just have a
note on the plat stating that the easement is established to allow public usage of the travel way and sidewalk?

Good evening,
This subdivision plat has been submitted to the County for review and approval. This plat is proposed to add acreage
from TMP 78-20M1 to TMP 78-20M5 so that a full piece of land is created to satisfy a proffer requirement. This plat is
associated with the Presidio Apartments at Martha Jefferson Hospital final site plan currently under review
(SDP202000023).

Thanks again for all your efforts to help expedite this process. We are chomping at the bit to get this additional BLA plat
submitted by COB tomorrow so that you are able to distribute and begin review on Thursday.
In order to speed the drafting process as well as simplify the finished product for everyone, we would like to show the
portion of the property being transferred, and the relevant portions of the other properties being effected (TMP 78-
20M1 (Worrell), and the new reservation parcel that is close to being finalized) versus showing both of these properties
in their entirety. This will allow for a plat with less sheets, as well as being prepared at a better scale (better end product
for everyone). Based on survey regulation requirements, this is 100% legitimate, but I want to be certain the county will
not require us to show these properties with metes and bounds in their entirety. A vicinity map showing the exterior
outlines of all the involved properties would be provided.
I tried to call both of you this morning and I know Jeff left you a voicemail and we need to know the answer to this
quickly if possible so that we can proceed.

I told Cameron yesterday, but I just wanted to share a big win with the group. I spoke with Andrew Dracopoli yesterday,
and he agreed to dedicate the required land to the County, so the trail network could be held in fee by CoA. This is great
news, so we need to capitalize on the timing before Andrew changes his mind.

The way it needs to work is:
1) The BLA plat that Mariah is reviewing needs to be approved / recorded to create the lot.
2) In parallel, we will create a BLA plat that moves the Worrell Land & Development property into the newly
created lot from 1). Hopefully these two BLA plats can be reviewed / approved at the same time so we can take
them both to record together.
3) Then, all of this land will all be dedicated to the County as one parcel. I think it would be best to wait for the
dedication until after the issuance of COs for the apartments just to make it through construction without the
need for easements and the like, but if you're ready to get going with the trail construction, we can talk about
that too. Just a thought.

Can we set up a zoom meeting this week to discuss some of the final aspects of the Presidio Apartments. Things appear
to be coming together pretty well, but I think it would be good for all of us to get on a zoom call this week to make sure
we are addressing everything. We have the HUD closing scheduled for the end of August, so we want to make sure we
have everything done and are not missing anything as we are wrapping up the site plan, the BLA, and the easement
plats.
