All comments contained in the attached comment letter must be addressed prior to final site plan approval. This approval shall be valid for a period of five (5) years from the date of this letter, provided that the developer submits a final site plan for all or a portion of the site within one (1) year after the date of this letter as provided in section 32.4.3.1 of Chapter 18 of the Code of the County of Albemarle, and thereafter diligently pursues approval of the final site plan. In accordance with Chapter 18 Section 32.4.2.8 Early or Mass Grading may be permitted after the following approvals are received: 1. Engineering approval of a VSMP plan meeting the requirements of Chapter 17 of the Code of the County of Albemarle. 2. Approval of all easements for facilities for stormwater management and drainage control. The final site plan will not be considered to have been officially submitted until the following items are received: 1. A final site plan that satisfies all of the requirements of section 32.6 of Chapter 18 of the Code. 2. Applicable fee. Please submit 11 copies of the final plans to the Community Development Department. The assigned Lead Reviewer will then distribute the plans to all reviewing agencies (for ACSA, please submit 3 copies of construction plans directly to them, as stated in their comments). Once you receive the first set of comments on the final site plan, please work with each reviewer individually to satisfy their requirements. Total fees for this project are $5,501.15. The County has received payment of $5,293.80. The remaining balance of $207.35 must be paid by Friday April 22, 2022 in order for the initial site plan to be approved. Comment addressed. Fee submitted and received on April 14, 2022. Comments to be addressed prior to final site plan approval: 2. [Parking reduction] A parking reduction request was received with the initial site plan submittal. Based on comments #18-19 below, the amount of parking provided will likely need to be adjusted in order to account for other Zoning Ordinance requirements for parking areas. The reduction request will need to be re -submitted with the final site plan once a more finalized parking count has been determined by the applicant. 3. [Advisory Comment] The Total Project Area note on Sheet 1 states that the area of Blocks 2 and 3 are being increased and decreased, respectively. The acreage reductions are within the 15% area adjustment allowed by the Code of Development (COD). Blocks 2 and 3 are required to have a minimum of 37 and 34 total dwelling units, respectively. Staff asks the applicant to keep this in mind as the acreages/layouts of Blocks 1-3 are designed further so that adequate area is available for building streets and residential units/lots in Blocks 2 and 3. 4. [General comment] Please be sure that the table on Sheet 3 is updated with accurate figures prior to final site plan approval of Block 1D. There are many site plans and plats under review within Brookhill, and some of those may be approved prior to the Block 1D final site plan. a. The map on Sheet 3 does not show the proposed phase lines of Block 1D. Please be sure that Block 1D is shown, and the Block limits of Blocks 2, 3, and 5 are accurately depicted. 5. [ZMA201500007] Per the maps within the COD and the Application Plan, Blocks 2, 3, and 5 are located to the east of Block 1D. The layout of streets and parking areas shown on the Block 1D site plan do not depict how Blocks 2, 3, and 5 will be accessed. Please provide information on how the developer intends to access those blocks for future development. 6. [ZMA201500007] The site plan for Block 113 identifies 2,650 sq. ft. of non-residential square footage being provided in the building at the intersection of Stella Lane/Archer Avenue. The combined non-residential square footage of Block 1C and 1D is 130,000 sq. ft. which is the maximum that can be developed in the entirety of Brookhill. On the final site plans for each sub -block of Block 1, the square footages of non-residential uses will need to be adjusted so that they do not exceed 130,000 total sq. ft. total in Block 1. As proposed, the non- residential sq.ft. that counts against the maximum is 132,650 sq. ft. 7. [General Comment] The open space note on Sheet 1 states that the greenway area has already been dedicated to the County. However, the greenway has only been subdivided and has not yet been dedicated. The instrument number referenced in the note will need to be revised if the greenway is dedicated to the County prior to final site plan approval. 8. [32.5.2 (a) and ZMA201500007] Please clarify the total project area note on Sheet 1 for Block 1D. The Acreage Per Phases of the Village Center note says that Block 1D will measure 17.49 acres, but the Total Proposed Acreage note states that all of Block 1 will only measure 13.49 acres. Please verify the accurate area of Block 1. a. Per footnote #2 under Table 2, block areas listed in the table are exclusive of greenway areas. Please verify what the actual proposed acreage of Block 1 and Block 1D are and update any acreage figures as necessary. [32.5.2 (a) and ZMA201500007] The proposed hotel is 4 stories, and the block regulations for Block 1 (page 16 of the COD) state that buildings greater than 3 stories must step back a minimum of 15' after the third story or provide a minimum 15' front or side setback adjacent to a street. Please either provide notes and labels identifying how the building will meet the minimum 15' step back requirement or demonstrate how the building meets the minimum 15' setback. 10. [32.5.2 (a)] Please revise the required open space note on Sheet 1 so that it identifies the required open space for Block 1 alone. Currently, it states Blocks 1-3. 11. [32.5.2 (a)] Please label all setback lines on the final site plan. 12. [32.5.2 (b)] Per page 9 of the COD, 1 bicycle rack is required for every 5,000 sq. ft. of retail space. On the final site plan, lease provide a calculation stating the amount of bicycle racks required within Block 1D, and show their location on the plans. 13. [32.5.2 (d)] Please see Engineering comment #7 and provide an exhibit for the proposed change of Preserved Slopes to Managed Slopes based on field run topography. 14. [32.5.2 0)] Please show all existing water, sewer and drainage facilities and easements within the property. Label easements by type, state dimensions, and state the recorded instrument number that created the easement. 15. [32.5.2 (k)] Please show all proposed water, sewer, drainage, and stormwater easements on the final site plan and state the easement type and width. 16. [ZMA201500007] Per Section 2.2.1(page 9) of the COD, primary entrances for buildings in Block 1 must be located on the front or side of the buildings. Please address the following: a. Label primary entrances on all buildings. b. Add sidewalks connecting the primary entrances to existing and/or proposed sidewalks along Stella Lane as necessary. 17. [32.5.2 (n)] Per Section 3.3. of the COD (page 33), the streetscape for the main street must feature furniture, such as benches and trash receptacles. Currently, none are shown. Benches and trash receptacles should be provided along the Stella Lane adjacent to the sidewalk on the final site plan. 18. [32.5.2 (n)] The commercial retail/restaurant parking calculations on Sheet 1 do not reflect the calculation for either use as stated in Section 18-4.12 of the Zoning Ordinance. The amount of parking required may need to be adjusted pending applicant response to this comment. a. Restaurant parking requirements: 13 spaces per 1,000 square feet of gross floor area including areas for accessory dancing b. Retail use not otherwise identified: one space per each 100 square feet of retail sales area for the first 5,000 square feet and one space per each 200 square feet of retail sales area above 5,000 square feet. For purposes of this paragraph, "retail sales area" shall be deemed to be: (1) 80 percent of the gross floor area; or (2) at the request of the applicant, the actual retail sales floor area as shown on floor plans submitted by the applicant delineating the actual retail sales area, which plans shall be binding as to the maximum retail sales area used. 19. [32.5.2 (n)] Per Section 18-4.12.13 (c), loading space requirements are as follows: (1) one space for the first 8,000 square feet of retail gross leasable area, plus one space for each additional 20,000 square feet of retail gross leasable area; (2) one space for the first 8,000 square feet of office space plus one space for each additional 20,000 square feet of office space. Three loading spaces are required to serve the 50,000 sq.ft. of commercial retail/restaurant space shown in Block 1D. c. Please revise the loading space calculation on Sheet 1 so that it states how many loading spaces are required in Block 1D. d. Provide the amount of required loading spaces within Block 1D. Currently, there are only three loading spaces proposed. e. [4.12.13 (a)] Loading spaces shall be provided on the same lot with the use to which it is appurtenant and shall be adjacent to the structure it serves. The final site plan will need to depict loading spaces adjacent to the office and retail/restaurant buildings, not at the end of Stella Lane as currently shown. 20. [32.5.2 (n)] Please see attached comments from Inspections Division. ADA accessible access aisles and access routes must be provided within the site. 21. [32.5.2 (n)] Please provide sidewalks around all sides of the proposed hotel. 22. [32.5.2 (n)] There is only one dumpster pad area shown within the limits of Block 1D. Although this appears to meet the minimum Ordinance requirements, staff asks the applicant to consider providing more dumpsters/dumpster pads since there are potentially several restaurants that could occupy the buildings in Block 1D. a. Be sure to provide plan and profile view construction detail of the dumpster pad enclosure(s) in order to meet the screening requirements specified by Section 18-4.12.19 (c). If landscaping will be used to screen the dumpster pad, landscaping must meet screening requirements specified by Section 18-32.7.9.7. 23. [32.5.2 (n)] Please provide dimensions for all buildings, sidewalks, walkways, walls, etc. a. Be sure to dimension and label the community center and pool deck. Dimensions are currently missing for this area on Sheet 7. The outdoor deck and pool area must be a minimum of 5,000 sq.ft., per page 22 of the COD. 24. [32.5.2 (n)] On the final site plan, please depict all proposed improvements and amenities within the 42,000 sq.ft. recreational area behind the 10,000 sq.fL restaurant building. a. [ZMA201500007] The recreation note on Sheet 1 lists different sq.ft. of the recreational area from the labels on other sheets. Please be aware that the Neighborhood Amenity Center/Linear Park/Civic Space #1 required in Block 1 must measure 50,000 sq.ft. See page 22 of the COD for exact dimensions and area requirements for Civic Space #1. 25. [32.5.2 (r)] Please provide a legend on each drawing. 26. [32.5.2 (u)] Please see attached ARB comments. Prior to final site plan approval, a Certificate of Appropriateness is needed. This will require building elevations for all proposed structures. 27. [32.6] Prior to approval, the final site plan must address all applicable requirements of Section 32.6 and 32.7 of the Zoning Ordinance. 28. [32.7] Prior to final site plan approval, a road plan application must be submitted, reviewed, and approved to verify that all proposed streets and other means of vehicular access to the site comply with all County and VDOT road design requirements. 29. [32.7.4] Prior to final site plan approval, a Water Protection Ordinance Plan (WPO) must be submitted, reviewed, and approved. See Engineering comments for further information. [32.7] Prior to final site plan approval, an easement plat application must be submitted, reviewed, approved, and recorded for all proposed easements. a. [32.7.4.1] The easement plat must show all proposed stormwater and drainage easements. Prior to approval of the final site plan, all stormwater and drainage easements created by the easement plat will need to be shown, labeled, and identified as public/private, state the width/size of the easement, and state the recorded instrument number of the plat that created the easements. b. [32.7.5] The easement plat must show all proposed water and sewer easements. Prior to approval of the final site plan, all water and sewer easements created by the easement plat will need to be shown, labeled, and identified as public/private, state the width/size of the easement, and state the recorded instrument number of the plat that created the easements. 31. [32.7.9] The final site plan will need to include a landscaping plan that meets the following requirements: a. [32.7.9.5] Street trees along all streets. Sizes and spacing requirements must be met. b. [32.7.9.6] Parking lot landscaping requirements. c. [32.7.9.7] Screening for parking spaces and dumpster areas. d. [32.7.9.8] Minimum tree canopy of 10% must be provided within the site. Provide a calculation of the tree canopy area provided, and state the tree canopy area proposed. e. Provide a landscape schedule identifying the following information for proposed landscaping: state the species name, common name, quantity, size/height at time of installation, canopy area per species, and total canopy area for each species of landscaping material provided. f. All proposed landscaping must be tree and shrub species specified on the Albemarle County Recommended Plants List. g. Canopy figures for all species can be obtained from the Plant Canopy Calculations list. 32. [32.5.2 (n)] Any proposed outdoor lighting must be shown on the site plan. A photometric plan and lighting cut sheets must be provided with the final site plan. Proposed lighting must comply with requirements of Sections 32.7.8 & Section 4.17 of the Zoning Ordinance. In addition to meeting all lighting requirements a standard lighting note will be required. 33. [ZMA201500007 and ZMA2018000011] The greenway parcel (currently identified in County records as Tax Map Parcel 46-19139) created through the plat recorded in DB 5512 page 282 is owned by the Brookhill HOA. Per correspondence with the developer when that subdivision plat application (SUB202000189) was under review, the developer was going to submit an easement plat to dedicate a public easement over the greenway at a future date. Per the COD and proffers, a public greenway easement must be dedicated to Albemarle County over the greenway area sometime after the 5001' certificate of occupancy is issued within Brookhill. Please provide an update on when the developer intends to provide the easement. This requires afire hydrant within 100 feet of the fire department connections for the systems. Do not see thye locations of the FDC's indicated on the plan, so cannot evaluate if the proposed hydrants satisfy bthis requirement, please indicate the locationn of FDC's and ensure there are hydrants within 100 feet of them on the plans. 2) Fire hydrant spacing is based on the needed fire flow. It appears from the information provided on fire flow notes on the plans, the spacing required will be 500 feet with no building more thanm 250 feet from a hydrant. I have concerns about hydrant spacing as shown on the plans, though many of the buildings on the west side of the plans appear to fall within this requirement on hydrant spacing on the east side of the plans.
