You do not need to revise the initial site plan to show the park and re -submit that for a review with us. I will work on drafting the conditional approval letter for the initial site plan, and I will have it emailed to you by the end of the day Friday (possibly sooner). The drawdown time is much quicker than a traditional pond and the vegetation species are specifically chosen because they thrive in that environment. The Building Inspections Division has not yet completed their review, but I will forward any comments or approvals to you once they are finished. As you will see on page 2 of the letter, there are four comments (comments #1- #4) that need to be addressed prior to initial site plan approval. Comment #1 is just to submit payment of the outstanding fee balance for the application. Comments #244 pose some questions from staff that we may need to discuss. Depending on your answers, actual revisions may need to be made to the initial site plan drawings prior to County taking an action on the application. To make things easier, let me elaborate on the comments a little more: If your answer to comment #2a is yes, you are planning to submit a separate site plan application for the proposed improvements within the trailhead park, then you do not need to revise and resubmit the initial site plan drawings to address the comment. If your answer to comment #3b is yes, you think the retention pond can be relocated to another spot without resulting in significant changes to the layout of building and hardscape improvements, then you do not need to revise and resubmit the initial site plan drawings to address the comment. You can just show the pond in a different location when you submit the final site plan application. Comment #4 is a little trickier. • If your answer to comment #4c is yes, you can identify some parking alternatives as specified in Section 18- 4.12.8 that are available to justify the parking reduction, then you can submit a revised request for the parking reduction at time of final site plan review, and staff will administratively review that. o Staff can only review and approve parking reduction requests administratively if an applicant identifies adequate alternatives as specified in Section 4.12.8. If none of those alternatives are possible, then parking reduction requests require approval by the Board of Supervisors (BOS), see below. • If you don't think any of the alternatives are available/possible, the BOS must approve a Special Exception application to allow the parking reduction. o This is the tricky part, because if the BOS does not approve the Special Exception, then the minimum amount of required spaces must be shown on the final site plan prior to approval. Has the feasibility of adding the missing spaces been evaluated by the design team? I know this is a bit of information but I hope that I provided clarity on your options to address the four comments. There are no longer any apartment buildings shown along the entire frontage of Rio, all the apartment buildings are internal to the site. I met with the Zoning Administrator and their staff to ask about whether the attached units are permitted. Basically, the Application Plan approved with the ZMA has a note that specifies the permitted uses. The exact wording is as follows: "The allowable uses for this development shall be in accordance with Section 18-19.3 of the Albemarle County Zoning Ordinance." Section 18-19.3 lists the permitted uses in the PRD Zoning District. If you click that link, you'll see that attached single-family (townhouses) and multifamily are both by -right uses in the PRD district. So the attached units are allowed. A couple things I want to mention just to ease any concerns — 58 1. The townhouses along Rio are still complying with the maximum building heights approved with the ZMA. The townhouses closest to Dunlora Forest (9 of them) are only going to be two -stories, not three. 2. This initial site plan is only proposing 299 total units (including 284 multifamily units and the 15 townhouses), so they're below the maximum threshold that was approved by the ZMA (327 total units). The developer could still come back in the future to add in the remaining 28 units, but that would require a site plan amendment. Townhouses with school age children will have an impact on an already overcrowded situation at the schools where the children would be assigned. The school bus travelling into/out of the complex to pick up the children also needs to be evaluated. And .... any word about Dunlora Farm?
