The Planner for the Planning Services Division of the Albemarle County Department of Community Development
will recommend approval of the plan referred to above when the following items have been satisfactorily
addressed. (The following comments are those that have been identified at this time. Additional comments or
conditions may be added or eliminated based on further review.) [Each comment is preceded by the applicable
reference to the Albemarle County Code.]
1. [General Comment] The final site plan for Old Trail Village Block 7C must be approved prior to approval of this final
subdivision plat. Additional comments may be provided on the subdivision plat based on the final layout and design
of the approved site plan, as they must match.
2. [ZMA2015-00001] Revise the minimum lot area in Note 2. For SFD units, the minimum lot size is 4,000 sq.ft. For
SFA units, the minimum lot size is 1,000 sq.ft.
3. [34-302(A)3] Identify the proposed Fennel Road as a "private street' on sheet 2, and call it out as a "private street
easement."
4. [34-302(A)3] Revise note #15 to say "Public right-of-way shown hereon... "
5. [34-302(A)3] Is the portion of Golf View Drive that is proposed to be vacated and become part of the open space
lot currently public right-of-way?
6. [14-302(A)4] On sheet 3, who is the trail easement being dedicated to?
7. [34-302(A)9] There must be a note on the cover sheet indicating whether each lot has a building site that complies
with the zoning ordinance.
8. [34-302(A)9] There is an existing storm easement on most of lot 34 and part of lot 33. Is this being vacated? There
is no building site on these lots if the easement remains.
9. [14-302(B)1] Provide the date of last revision of the plat on all future submittals.
10. [14-302(B)1] Provide a title on each sheet that matches what is provided in the index on the cover sheet of the
plat.
11. [34-302(B)5] Include the zoning overlay district that applies to these parcels: Steep Slopes - Managed.
12. [34-302(B)5] Include the special exception that was approved by the Board of Supervisors allowing the reduction
of the WPO buffer in this block.
13. [14-302(B)5] The zoning labels on Sheet 2 for the residues of 35D1 and 713 are incorrect. There is no SF zoning
district.
14. [34-302(B)30] There is a Water Protection Ordinance (WPO) stream buffer located on these parcels, surrounding
the pond. Show boundaries of this buffer on the plat and provide the required note.
15. [14-317] Identify who will own and be responsible for the proposed private right-of-way, as well as the open spaces.
HOA documents that comply with the requirements of 14-317 must be provided to County staff for review and
approval prior to the approval of this plat. These documents will then need to be recorded along with the subdivision
plat once everything has been granted final approval.
16. [General Comment] Some of the easements will require deeds prepared by the Engineering division.

-Variable width SWM easement should be labeled as "Public SWM facility easement."
-SWM and drainage easements will need deeds. Engineering will draft these deeds when the plat is ready for approval.
-Road plan must be approved and bonded before subdivision can be recorded.

The Department of Transportation, Charlottesville Residency Transportation and Land Use
Section, has reviewed the above referenced plan as prepared by Timmons Group, dated 2
February 2022, and offers the following comments:
1. Add a note: "VDOT will only maintain within public drainage easements to the extent
necessary to protect the road."
Please provide a digital copy in PDF format of the revised plan along with a comment response
letter. If further information is desired, please contact Doug McAvoy Jr. at (540) 718-6113.
A VDOT Land Use Permit will be required prior to any work within the right-of-way. The
owner/developer must contact the Charlottesville Residency Transportation and Land Use
Section at (434) 422-9399 for information pertaining to this process.
