Aubrey Huffman and Associates 193 Riverbend Drive, Suite 2 Charlottesville VA 22906 RE: [SDP 2005-061: Commonwealth-Greenbrier Center] Dear Mr.Drumheller: The Planning Commission granted approval of your request for the following waivers: Waiver of Section 4.2.3.2 of the Zoning Ordinance to allow disturbance of critical slopes. The Department of Planning and Community Development hereby grants administrative approval to the above-referenced site plan. The approval of the preliminary site plan is valid for(1)one year in accordance with Zoning Ordinance Section 32.4.3.1. Therefore,the preliminary approval shall expire August 18,2006. If the preliminary site plan approval expires, a new application must be filed and processed. Please address all of the requirements and conditions listed below and submit eight(8) tentative plan copies to the Department of Planning and Community Development. This letter must be submitted with the tentative plans,as a checklist,to document that you have addressed all requirements or conditions,or the tentative plan will be denied. A submission and review schedule is attached for your information. The Erosion and Sediment Control Plan and the BMP Stormwater Management Plan,with the associated applications and fees,may also be submitted with the eight(8)tentative Plans. Box 8147 Charlottesville, VA 22906 RE: OFFICIAL DETERMINATION of USE and PARKING For Commonwealth H2O—Ultra Pure Solutions, Inc. Dear Mr. Melton: This letter is a written determination that your use although not specifically permitted in the Commercial District(C-1) is similar to uses permitted by right in general character and more specifically,similar in terms of locational requirements,operational characteristics, visual impact and traffic generation. This determination is based my visit to the existing establishment on Berkmar Drive and on the descnption of the business from Mrs. Linda Schroeder which I understand as follows: • The primary business of Commonwealth H2O is selling and installing water filters for home and business use at the client's site; • The primary business of Ultra Pure Solutions, Inc. is selling,processing, installing and regenerating pure, ionized water for specialized use in medical and manufacturing businesses; • There is a small reception and retail sales area; • The on-site retail sales is a very small component of the overall businesses; • There are several offices for owners, managers, sales personnel and technicians; • There is a large area for storage of all the filters,tanks and supplies; • There is a large area for the purification processing which includes large tanks with filtenng devices; • Currently there are nine full time employees and one part time employee, total for both companies; and, • The companies current operate one large container truck,two vans and one pickup truck. This use is determined to be comparable to the following C-1 uses: • Furniture and home appliances(sales and service) [similar sized tanks/appliances with service available] • Hardware store [small filters and pieces for the tanks/appliances that they sell] • Automobile service station [large and small tanks are brought in and serviced,returned or picked up] • Administrative offices [their offices constitute a little less than one-half of their total space] With these similarities to other C-1 uses, I find that your use can be considered a by-right use also. Therefore,your proposal to move this business from Berkmar Drive(TMP 061 U0-02-00-00200)to Greenbrier and Commonwealth Drives(TMP 061w0-03-00-006a0)both in the C-1 zoning district meets the zoning ordinance. The parking will be calculated for the offices at their total square footage plus one space for the employee of the"warehouse"area. There will be no need to add customer parking since the office calculation is geared to include customers. With the site plan currently under review, if the building is one floor of offices and the basement is warehouse,the total required parking would be 16 spaces—one for the warehouse employee and 15 for the 3680sf of offices. (3680 x 80%—200= 14.72,rounded to 15) If you are aggrieved by this determination,you have the right to appeal it within thirty (30)days of the date notice of this determination is given, in accordance with Section 15.2-2311 of the Code of Virginia. If you do not file a timely appeal, this determination shall be final and unappealable. An appeal shall be taken only by filing with the Zoning Administrator and the Board of Zoning Appeals a notice of appeal which specifies the grounds for the appeal. In order for an appeal to be considered complete,it shall include a completed application and $120 fee. The date notice of this determination was given is the same as the date of this letter.
