To Whom It May Concern:
In response to your request for a Letter of Zoning Compliance for the above -referenced
Property, please be advised of the following:
• The Property is zoned PD-MC, Planned Development -Mixed Commercial, and is
proffered per ZMA1996-00003, approved August 14, 1996. The Property is subject to
the Entrance Corridor and Steep Slopes Overlay Districts described in Section 30 of
Chapter 18 of the Albemarle County Code (the "Zoning Ordinance")
• The permitted uses of the Property are provided in Section 25A of the Zoning Ordinance.
Uses permitted by right in the C-1, CO, and HC zoning districts are permitted by right in
the PD-MC district per Section 25A.2.1.1 of the Zoning Ordinance. Hotels, motels, and
inns are permitted by right in the Highway Commercial — HC zoning as per Section
24.2.1.20. Therefore, the hotel is permitted by right on the Property.
• The zoning of abutting properties is also PD-MC.
• The Property is subject to site plan SDP2005-00030, for a 124-room hotel with restaurant
and conference facility, approved on August 10, 2005. The use was built per that
approved site plan and complies with all zoning regulations. Specifically, the Zoning
Ordinance and amendments have not been violated with respect to any of the following
matters:
i. Area, width, or depth of the Land as a building site for the structure
ii. Floor space area of the structure
iii. Setback of the structure from the property lines of the parcel
iv. Height of the structure, or
V. Number of parking spaces
The required parking for this development is 159 spaces, which is met by the 147
spaces on the Property and shared parking on the adjoining lot. The shared parking
arrangement is necessary for the parking to be sufficient for the use.
• There have been no variances granted for the Property. However, a special use permit
(SP2006-0029) was approved for an off -site sign on September 12, 2006.
All required permits, consents and authorizations were obtained when required, and a
certificate of occupancy was issued upon completion of construction.

• To the best of my knowledge, the Property is currently in compliance with all applicable
requirements of the Zoning Ordinance. A review of our files found (i) no violations or
alleged violations or regulations applicable to the Property, whether pending,
contemplated, or having already occurred, and (ii) no fees due or pending with respect to
any matter before the County Zoning Office; and (iii) no pending application for rezoning
or for a special or conditional use permit or variance of the Property. Further, no
proceeding to challenge the zoning or other governmental approval or use of the
Property is pending or overtly threatened to the best of our knowledge.
• In the event of a casualty, in whole or in part, the structure located on the Property may
be built in its current form subject to the approval of a building permit and applicable site
plans and building code.
• Copies of any relevant records may be obtained via the noted links or the Community
Development Department Records Public Access link below. If unable to find the
records, a request may be made through the department's Records Manager, Paul
Bjornsen, at pbiornsen(a)albemarle.org. If the request is not based in Virginia, it will take
longer to fulfill.
