The above referenced plat has been reviewed. This plat shows the relocation of the private street. Chapter 14, Section
212.113 of the Code of Albemarle states: "The application shall not involve the relocation or alteration of any streets,
alleys, or easements for public passage, or other public areas. Easements or utility rights -of -way may be relocated or
altered only with the express written consent of all persons holding an interest therein." However, Chapter 14, Section
202.113 of the Code of Albemarle states: "After a plat is approved by the agent, the subdivider may amend the plat if the
amended plat is submitted, reviewed and approved as provided in section 14-209 or sections 14-213 through 14-231.1,
as applicable; provided that the agent may approve amendments to an approved final plat without proceeding
under section 14-209 or 14-213 through 14-231.1, as applicable, if he determines that the plat, as amended: (i) complies
with all requirements of this chapter and all other applicable laws; (ii) is substantially the same as the approved plat or
site plan; and (iii) will have no additional adverse impact on adjacent land or public facilities." This provision allows the
agent to administratively authorize changes in previously approved plats. The private street was shown on a previously
approved plat and it is the finding of the agent that the change in the street location may be authorized. No public
purpose is served by requiring the submittal of two plats to achieve this relocation. Therefore, in this case, the
relocation of the street may be approved as part of the Boundary Line Adjustment.
The plat will be approved for recordation with the following changes:
1. Provide the owner's notarized signature.
2. Revise note B on page 1 to read "Revised Lot B is assigned 3 development rights and may be further divided and
when further divided these rights shall not comprise more than 13.12 acres."
