The Planner for the Planning Services Division of the Albemarle County Department of Community Development
will recommend approval of the plan referred to above when the following items have been satisfactorily
addressed. (The following comments are those that have been identified at this time. Additional comments or
conditions may be added or eliminated based on further review.) [Each comment is preceded by the applicable
reference to the Albemarle County Code.]
1. [34-303(N)] Provide the following statement on the cover sheet of the plat: "Unless specifically denoted as
public, the streets and other required improvements in this subdivision are private in nature and will
not be maintained by either the Virginia Department of Transportation or any other public agency.
The maintenance thereof is the mutual obligation of the affected lot owners. Failure to maintain the
improvements in substantially the same condition as originally approved by the County may
constitute a violation of County ordinance(s)."
2. [34-302(B)1] Provide the date of the last revision of the plat on all future versions of the plat.
3. [34-302(B)5] Add a note on the cover sheet that states that these properties are located within the Entrance
Corridor Overlay District.
4. [34-303(D)] In new parcel 36 in the Area Summary table, I believe it should be "less parcel F," not parcel E. Parcel
E is still a part of the new lot 36.

Re: SUB-2021-00182 — Old Trail Village, Block 32, Phase 2, Lots 34-40 — Final Subdivision Plat
Dear Mr. Reitelbach:
The Department of Transportation, Charlottesville Residency Transportation and Land Use Section, has reviewed the
above referenced — Old Trail Village, Block 32, Phase 2, Lots 34-40 — Final Subdivision Plat, as submitted by Kirk
Hughes & Assoc., dated October 7, 2021 and Find the following:
1. Please include a note stating that "VDOT will only maintain within drainage easements to the extent
necessary to protect the roadway from flooding or damage"
2. Please include a note "Landscaping plants and trees adjacent to the sight distance triangle will need to be
maintained in area between 2 and 7 feet above ground as a clear zone to preserve sight lines and
accommodate pedestrians. The HOA will be responsible for the maintenance of sight lines."
A VDOT Land Use Permit will be required prior to any work within the right of way. The owner/developer must
contact the Charlottesville Residency land Use Section at (434) 422-9399 for information pertaining to this process.
