Subject: Re: HTC - Offsite improvements Peter, After discussing this with the others they agree that an easement plat is required. What you have provided is insufficient. Thanks, Paty From: Patricia Saternye Sent: Monday,August 13, 2018 4:35 PM To: Peter Russell Cc:Justin Shimp, P.E. Subject: RE: HTC-Offsite improvements Peter, I cannot tell you if such a document is appropriate or not. I have not seen such a document utilized to "create" an easement in the past. Once I am able to ask others I will get back to you. However, please keep in mind that this document specifies the creation of four parking spaces on the adjoining lot. Zoning has previously comment that the creation of parking spaces on the adjoining lot could not be allowed without an Special Use Permit (SP)since it would be a standalone use on the adjoining lot. Are you now considering getting an SP for the parking spaces, even though they are no longer shown on the site plan? I recently received your 3rd round of comments concerning SDP2017-70 HTC Hotel, and we are working to resolve all issues you and others have noted for resubmittal. One outstanding issue that I would like to discuss is the adjoining parcel improvements on the south west corner. The attached easement agreement and exhibit looks to satisfy comment#15, by providing all the improvements, easements, and maintenance issues required for the improvements. If you agree that the provided attachments have the necessary legal documents for off-site improvements we would love to include it in our next submittal. If there is anything you believe we have missed we will work to get you correct documentation. Thank you, Peter 2
