A Zoning Clearance is verification from Albemarle County that a proposed use, whether it is a new business or other activity (see Zoning definition of "Use"), satisfies all requirements of the Albemarle County Zoning Ordinance and ensures public health and safety. A Zoning Clearance Application is reviewed by the Zoning Department, Building Inspections Department, as well as any other applicable departments or agencies. A Zoning Clearance is Required in the Following Circumstances • Opening a new business • Changing or expanding an existing business • Buying an existing business • Moving a business to a new location or changing its name • Before natural resource extraction • Any uses listed in SocHon S of the Albemarle Co dlnancs as requiring a Zoning Clearance Items Required to Apply for a Zoning Clearance Before filling out a Zoning Clearance Application ensure you have or have done the following: ❑ Tax Map and Parcel number or Address of the property. Include suite/unit/floor number, if applicable. ❑ Description of the proposed business/use. Include any and all relevant information such as a description of the business, the number of employees, number of shifts, availability of parking, etc. ❑ A Floor Plan. A sketch or an architectural drawing of the total square footage of the use. If using less than the entire structure, note the location within the structure. Note the square footage of and use of each room. ❑ Provide notice to the owner if the applicant is not the owner. Within ten days of applying for a zoning clearance, the applicant, if they are not the owner of the parcel and/or structure, shall inform the owner that they have applied for a Zoning Clearance. Please fill out the form on page 3. • Other Approvals/Documents if applicable. • A Certified EncEineer's Remo is required if the parcel is zoned Industrial (LI, HI, or PDIP). • Health Department approval is required for food preparation or if the parcel is on private well or septic. • Bakeries require USDA approval. • Any additional approvals the Zoning Administrator may require including Department of Social Services and Fire + Rescue. • If you have any questions feel free to contact Staff at (434) 296-5832 Submitting an Application Once you have all the required information provided above: 1. We have three employees and are currently forming a licensed, independent retail used car dealership, which will be located at 3325 Lobban Place, Charlottesville VA 22901. The parcel is zoned LI-Light Industrial. It is my understanding that to use this space for the dealership we will need to submit this Letter of Performance Standards along with our zoning clearance application. We have addressed the standards referenced in Section 4.14 and provided the following responses: Noise. Our operation will not create sound or impact noise levels in excess of the values specified in Section 4.14.1. Our operations will be confined to the interior of the building. Our major sources of noise will be an outside Shp, two -stage Air Compressor that will run average of 10 minutes throughout the day. It will be enclosed in a shed to protect it from weather and to cut down noise. The machine tools utilized inside the shop is all electric and thus do not have an unacceptable noise level. Vibration. Equipment operated by shop does not produce any detectable earthborn vibration. Glare. Aside from exterior motion -sensor lighting which do not shine beyond 10 feet from the building, our operation is completely contained within the building. The interior lighting associated with this operation does not produce glare that is visible beyond the lot line. Air Pollution. There will be no emission of smoke, odor or gaseous pollutants beyond normal gasoline -powered vehicle emissions. Water Pollution. Oil and coolant fluids utilized in the vehicles will be disposed of properly. We maintain secure drums for these fluids, which are either disposed of by a certified handler or by our employees, who transport the drums to the local landfill for safe disposal. Our operation does not represent a hazard to water quality. Radioactivity. Our operation does not require handling of radioactive materials. Therefore, there will be no radioactive emissions or danger to health and safety of person on or beyond the premises. Electrical Interference. Our operation does not require any equipment that would generate electrical disturbances that would adversely affect the operation of equipment on any other lot or premises.
