One more question, if I may?Our plan is to submit the three Two-Lot Divisions in a stagger across the next three business days.That way we are assured to get assigned Application numbers in the same sequence that reflect how we show the adjoining conditions on each plat, if that makes sense?When we've done similar projects in the past this seems to aid the County in making the adjacent conditions reflect the sequential order of the submittals. The developer seemed to remember in our meeting with Francis last year that there was a mention of the need to do a simultaneous submittal for the lots fronting Miller School Road due to its designation as a "Major Collector". I seem to recall this comment as well, but I believe that comment was made if we intended to have one single entrance for all four lots, which we do not. Do you mind getting a clarification to see if there would be any issue with the two plats fronting Miller School Road being submitted in the staggered fashion? Thanks. Kristopher C. When the newly-received applications are distributed among the Planning reviewers, I can let the distributors know that I have previous experience with this property and the earlier plat,as it does generally help when the same reviewer works on connected projects that have a similar history. As such, please submit at least three copies of the BLA plat for final approval by the County. After the Agent for the Board of Supervisors has signed the plats,granting final approval,they will be returned to you for recordation at the courthouse. Please be reminded that the plats must be signed and sealed by the surveyor, as well as have the notarized signatures of all property owners of the three parcels involved in this BLA. If you have any further questions or concerns, please let me know.The County Office Building will be closed on Monday and Tuesday next week. Regarding potential future subdivision of these lots, it appears they may be able to be further subdivided. However, without a subdivision plat showing all the proposed boundaries and acreage of any lots, as well as other requirements (including but not limited to providing necessary frontage, access to the parcels, setbacks, Health Dept. approval of additional parcels, and environmental features), I cannot guarantee approval of future subdivision plats.Such reviews would be conducted when a subdivision plat is officially submitted to CDD. On the current BLA plat, as long as each "quadrant" on sheet V3 of revised TMPs 56-30 and 56-31 (the four parts of those two parcels that are created by the intersection of the new and old lines of those TMPs) is a minimum of 2 acres with an available 30,000 sq. ft. building site,then development rights can be properly assigned with 2 DRs available for each of revised TMPs 56-30 and 56-31,with another DR going to 56-32B for that parcel's expansion. It's important to remember that any future parcel would have to have its required 2 acres and building site within the boundaries of the 1980 parcel lines. The last step needed toward getting the BLA approved is revising the Development Rights note to explain the re- assigning of all the DRs among the parcels. Please see below for my explanation: Development rights must be used within the original boundaries of a property as it existed on December 10, 1980. For the proposed TMP 56-32B, as shown on the proposed plat, it would have 6"theoretical" development rights. 5 of those theoretical development rights can be used within the boundaries of existing 56-32B. (These development rights are theoretical because although 56-32B has not been divided since 1980, and thus has the 5 DRs allowed it by the ordinance, in practice it can only use 1 because of acreage limitations.) 56-32B also gains one development right from 4 existing TMP 56-30.Thus, it has 6 theoretical development rights, but only two of those are actually available in practice because of the parcel size.You may want to use the term "theoretical" in the plat note to help with clarification. For revised TMP 56-30, it would have 2 practical development rights, retaining 1 from within its 1980 boundaries, losing 1 each to 56-32B and 56-31, and then also gaining 1 from 56-31. For revised TMP 56-31, it would also have 2 practical development rights, retaining 1 from its original boundaries, losing 1 to revised TMP56-30, but gaining 1 from existing TMP56-30. However, please be advised that development rights must be used within their 1980 boundaries.Although the BLA plat itself would be fine, it has been indicated that the applicant also intends to submit multiple two-lot division plats in the future.Thus, if revised TMP 56-31 is proposed to be divided into two lots,there must be a minimum of two acres and a 30,000 square foot building lot coming from the land that was previously a part of existing 56-31 (in other words,the western portion of revised TMP 56-31 must have 2 acres and a required building site that fits within the boundaries of the existing 56-31). It appears that the portion of revised TMP 56-31 that is to the west of the vacated property line may not meet that required two acres and 30,000 sq. ft. building site. For this BLA plat, in the development rights note, include where all the development rights are coming from and how they are all being exchanged among one another. By including this information in this note, it will also help to ensure that the future subdivision plats are more easily reviewed. I hope this helps. Have a nice weekend. Here's our logic: TMP 56-32B starts with 5 DR's, as it was configured before 1979. It is retaining all of its original area and gaining some area from TMP's 56-31 and 56-30. It cannot have more than 5 DR's, so it keeps a total of 5. TMP 56-30 starts with 3 DR's. Since the original area is being split between 3 reconfigured parcels, it will lose 1 of those DR's to 56-32B, 1 to 56-31,and gain 1 from 56-31,to keep a total of 2. 5 • TMP 56-31 starts with 2 DR's. Since its original area is being split between 2 reconfigured parcels, it will lose 1 of those DR's to 56-30, but also gain one from 56-30,to keep a total of 2. We understand the County wants to get this right, but the follow-on 2 Lot Divisions that we will be executing following this action will extinguish all these rights anyway, and obviously by Zoning Code we cannot divide smaller than 2 Acres. If this doesn't suit the County's requirement we would like to request a meeting to see how we can resolve this, as it appears to be the only thing holding up approval at this point.
