All comments appear to have been addressed satisfactorily; however,there is one change regarding comment#5 and the requirement for planting or bonding the necessary street trees After discussions with other CDD staff members, it has been determined that the amount of money required for bonding for the street trees would be a relatively small amount,as there are only a few trees proposed. Rather than bonding those trees, an additional note on the plat should suffice to cover this requirement. Please read the attached comment letter for more information and the proposed wording of the additional plat note. Once that note has been added to the plat,you may just email me a PDF of the revised plat to quickly review that note, as that should be the final outstanding item before the plat and landscape plan are ready for final approval. Although Engineering and VDOT had no objections to the first submittal, there are a number of changes that have occurred with this plat,including the addition of a landscape plan that is proposed to add street trees in order to get a bonus density to create a lot that is smaller than would otherwise be allowed by County Code. Once all issues have been addressed,the landscape plan will have to be approved together with the plat. [14-400, 14-403] Planning has no additional concerns regarding the landscape plan, except for the aforementioned ACSA sewer easement in comment#2. Response:The ACSA Sewer easements have been added to the plat.We could find no recorded deeds for an ACSA water easement on this property. 3. [14-302(A)6.] Alleys and shared driveways. Provide the width of the proposed shared driveway easement. Response:It is a triangular shaped easement,so width is not really applicable,but the distance between the stream buffer and the edge of the easement is 20',this dimension has been added to the plat. 4. [14-302(A)16.]Dam break inundation zones.This property is within the limits of a state dam break inundation zone.Please show the limits of this dam break inundation zone. Response:Dam break inundation zone has been added to the plat. 5. [14-400, 14-403] Minimum lot requirements;Lot frontage.The proposed Lot 1 does not meet the required minimum lot requirements or lot frontage of the R2 zoning district. It appears from the supplemental information provided that the applicant is proposing to use the 5% street tree zoning bonus as found in Albemarle County Zoning Ordinance,Chapter 18,Section 14.4.1. This bonus level would allow for a smaller lot size of 14,520 square feet,which would be sufficient for the proposed size of Lot 1 as 0.356 acres.However,for this street tree zoning Page 1 bonus to be considered,please provide a landscape plan as a part of the plat,showing where the street trees are to be located.This landscape plan must be in accordance with Section 32.7.9 of the Albemarle County zoning ordinance. In addition,please be advised that either the landscaping must be planted prior to approval of the plat,or that the landscaping must be bonded prior to approval. Also,if there is not sufficient right-of-way width for the street trees,then the required landscaping must be placed in a landscape easement. Response: Refer to Landscape plan.The street tree bonus is being pursued in order to reduce the required lot sizes.Four street trees will be planted in the Orchard Drive right of way roughly 4 ft from the property line.The work to install the street trees will be bonded after your approval of the new Landscaping Plan included in the resubmittal. 6. [14-414] Public water and sewerage systems.Please include a note on the plat indicating that this property is within the Albemarle County Service Authority's jurisdictional area and shall be served by public water and sewer.
