ice skating rink; boat renting, dance pavillion
was deferred until proper information is presented

come to this office to obtain your Zoning Permit.

Planning Commission recommended denial on the basis of not being compatible°`
with development of adjacent property and not in keeping with the character
of the immediate area. On motion by Mr. Yancey, seconded by 1[r. Wheeler, and

unanimously carried, the recommendation of the Planning Commission was accepted;;

(5) ® -64 - Application of Charles A. and Robert Baber to locate a e.neral
store and public garage on 2.0 acres at intersection of Routes 626 and
602 in Howafdsville.
No one appeared With regard to this application. Mr. Humphrey advised that the
Planning Commission recommended approval, subject to the filing of a plot plan

to the 'Zoning Ad;inistrator to determine proper zoning requirements and that if
it is found that'additional setback can be obtained, that the Zoning Adminis-
trator shall establish the setback beyond the minimum 30 foot requirement. On
motion by Xr. Pau]ptt, seconded by Yr. Wheeler and unanimously carried, the
recommendation of the Planning Commission was accepted.
(6) SR -65 - Application of Andrew Woodson to locate a permanent mobile home on
1,0 acre located on Route 712 in North Garden.
No one appeared with regard to this application. Mr. Humphrey advised that the
Planning Commission recommended approval subject to a 50 -foot setback from the
right -of -way and Health Department'approval for septic system and that the
existing dwelling now located on the property be removed from the premises on or
before June 1, 1971. On motion by Nr. Yancey, seconded by Mr. Wheeler and
unanimously carried, the recommendation of the Planning Commission was accepted.
(7) SP -67 - Application of Cavalier Home Sales, Inc. to locate a facility to
manufacture wood modular unit dwellings on 2+aores, located on Route 29
North across from Caaelot Subdivision.
No one appeared with regard to this application, Mr. Humphrey advised that t e
staff and the Planning Commission recommended approval subject to the following
! conditions: (a) Storm drainage facilities in keeping with the County Engineer's
recommendations, (b) The facility utilizing the common entrance, and (c) That
all utilities be placed in an easement paralleling Route 29 North and adjacent
thereto. After discussion, motion was offered by Mr, Gibson, seconded by Mr.
Wheeler, and unanimously adopted, accepting the_Tecommendation of the Planning

Commission with the additional condition that the access road be dedicated to
public use.
(8) SP -66 - Application of George Cason to locate an ice skating ri", boat
i
renting and dance pavillion on 2.2 sores located on the south of Route 643,
west of Route 29 North and immediately below the Rivanna Reservoir Dam.
Yr. Cason appeared in support of his application. No one appear in opposition.
Yr. Humphrey advised that the staff suggested approval subject to Health De-
pertment approval of septic system and submission of site plan. Mr. Wheeler
suggested that the application be approved for one year subject to review at the
end of that time. Setting a time limit as a condition was also discussed. After

some discussion, motion was offered by Hr. Yancey, seconded by Yr. Paulett, and
un-1 usly carried, to refer this application to the Planning Commission for

recommendation.

Mrs. James Ewald, Jr. and Mr. Liens. 'Following public hearing and discussion,
motion was offered by Mr. Wood, seconded by Mr. Yancey, and unanimously carried
by recorded vote, to accept the recommendation of the Planning Commission to
rezone the subject property from A -1 to M -1 with intent to create RTM zone by
amending the Zoning Ordinance. On motion by Mr. Gibson, seconded by Mr. Wheeler,
the following resolution was unanimously adopted:
BE IT RESOLVED by the Board of Supervisors of Albemarle County,
Virginia, as follows:
I
1. That it is the intention of this Board to amend, the Albemarle
County Zoning Ordinance so as to provide a new district or districts
within Albemarle County in which permitted uses will be facilities
designed and used for:seientific and technical research, product
development and manufacture, of the type specified and described in
the proposal for the "R -TM District" prepared by Mr. John L. Humphrey,
County Planner.
2. That it is also the intention of this Board, if the aforesaid amend-
meat to the Albemarle County Zoning Ordinance is adopted, to amend the
Albemarle County Zoning Map so as to re- classify the 220 -acre tract
of land situated at the Ivy Interchange of Interstate Route 64 with
State Route 637 in Albemarle County, upon which General Electric Company
holds a purchase option from the M -1 (Manufacturing) classification to
the classification permitted by the proposed amendment described in
paragraph 1 of this resolution.
3. That the County Planner is hereby directed to prepare the necessary

ordinances to amend the Albemarle County Zoning Ordinance and Zoning Map
as proposed in paragraphs 1 and 2, and to publish notices of public

hearings as provided by Virginia Code Section 15.1 -431 to be held hereon
I
by this Board at 10:00 A.M. on November 19, 1970, at the Board Room in
the County Office Building.
4. That the proposed amendments described in paragraphs 1 and 2 hereof
and the ordinances to be prepared by the County Planner are hereby
referred to the Albemarle County Planning Commission for its recommen-
dations, and it is hereby requested to hold a public hearing thereon,
pursuant to public notice as required by Virginia Code Section 15.1 -431,
and to report its recommendations to this Board at or before the public
hearing to be held by thus Board on November 19, 1970.
The Chairman called for public hearing on the following zoning requests as
advertised in the Daily Progress on September 25 'and October 2 and 9, 1970:
(1) Sp -66 - George Cason. Deferred from September 17, 1970, meeting for recom-
mendation from Planning Commission.

Communication Was received from the Planning Commission advising that the Com-
mission found itself unable to discuss the proposal intelligently and make
I!� appropriate recommendations in view of the unavailability of a site plan,
LL� Which is required by the zoning ordinance, and the lack of information regard-
ing the facility. Mr. Cason was present and advised that he did not Wish to
spend a great deal of money on his proposed project until he was assured of
obtaining the required special permit. Mr. Wood commented that the Highway
II Safety Commission had found the section of Route 29 North where the applicant's
V facility would be located to be the second most-.,accident done location in the
County and this should be taken into consideration. After discussion, motion
was offered by Mr. Paulett, seconded by Mr. Gibson, and unanimously carried,
requesting that Mr. Cason work with Mr, Humphrey in submitting details of his
proposed project in order that this can be submitted to the planning Commis-
sion for recommendation to this Board at its November meeting.
(2) UP -137 —Application of Forrest A. and Raymond R. Phillips forapermission
to rezone from B -1 Business to M -1 Industrial, Limited District, 1'.22
acres located on Route 631, just west of Route 29 North.
lir, Phillips was Present in support of the application; no one appeared in
oPposition. Mr. Humphrey advised that the staff and the planning Commission
recommended approval of the subject application. On motion by Mr. Paulett,
seconded
�. by Mr. Wheeler, unanimously adopted, the recommendation Of the Plan-
ning Commission was accepted.
(3) ZO -139 - Request Of Margaret Garms to rezone from RS-1 Residential to
R -2 Residential 1.5 acres located just north of Route 1204 in Crozet area.
Mr- JOha Fischbeck appeared as representative for Mrs. Garms; no one appeared
in opposition. Mr. Humphrey reported that the staff and the Planning commis_
sion recommended denial of this petition since R -2 zoning Would not be Com- !
patible with the existing development pment and it would not be in the best interest
to permit 12,500 square foot lot development or duplexes as it relates to
public i
welfare. On motion by Mr. Wheeler, seconded by Mr. Gibson, unanimously carried,
the recommendation of the Planning Commission was accepted.
(4) ZMP -141 - Application of Blkcar Incorrppoorated to rezone 4.352 acres
located on cute 631, from Rti3 Aesidential to M -1 Industrial.
Mr. Humphrey advised that the Planning Commission recommended approval but noted �
l need of screening from adjoining property in approval of site plan. Mr, Stuart
Carwile appeared on behalf of the petitioner and advised that the owner of this
Property was not aware of the existing R -3 since the adjoining property Which he
owns, on -which the Grassy Knoll Ha6chery is located, is zoned M -1. Mr, Fred
Landes appeared on behalf of Dr. Smith, whose property also adjoins the subject
l Property, and advised that I)r, nth was concerned since he did not wish the
usability of his land as residential to be disturbed. After disoussion, motion

Claims in the amount of $1,435.26 and 9932.91, for October and November
respectively, were received from the University of Virginia Hospital for hoe -
pitalization of indigent patients under S.L.H. On motion by Mr. Wood, seconded

by Mr. Yancey, these claims Were approved for payment.
Report of the County Executive Was submitted for the month of October,
1970, and Was ordered Piled.
The County Executive presented each Board member with a copy of brochure
prepared for the Commission on Outdoor Recreation in connection with applica-

tion for funds.
Communication was received from'Mr. Keene Byrd on behalf of committee
assigned with the task of drawing up proposal for yearly operation of ant.

Opportunities Industrialization Center to serve about nine surrounding coun-
ties and requesting this Board's endorsement of the OIC philosphy. The Clerk
was directed to acknowledge Mr. Byrd.'s communication advising that the Board
would be glad to give this matter further consideration if the committee wished
to submit its proposal at a later date.
At 1:30 P.Y. the Chairman called for public hearing on zoning requests
carried over from previous meetings as follows:
(1) SP -66 - Application of George Cason for Special Permit to locate an ice
skating rink boat renting and dance pavillion on 2.2 acres located on
the south side of Route 643, west of Route 29, North.
Mr. Humphrey reported that Mr. Cason had advised his office that he could not

be present for this meeting. No one from the public appeared. Mr. Humphrey
further advised that Mr. Cason did not file site plan with the Planning Com-
mission nor did he seek the assistance of the Planning Department in preparing
a plan to be submitted. On motion by Nr. Paulett, seconded by Mr. Gibson and
unanimously carried, this matter was deferred until proper information'is re-
ceived from Mr. Cason.
(2) SP -68 - Application of James C. Weeks to locate a permanent mobile home,
being previously a temporary mobile home, on 2.0 acres fronting on Route 53.
Mr. E. 0. Wingfield, attorney, appeared with Mr. and Mrs. 'Peeks. Appearing in
opposition were Mr. Tommy Parrish and four other residents representing property
owners who signed petition presented at the last regular meeting. Mr. Humphrey
showed drawing as submitted to his office of proposed structure. He advised
that the Planning Commission recommended that the Special Permit be approved
for six months for the building of a permanent home, at the and of which time
the trailer would have to be removed. On motion by Mr. Yancey, seconded by Mr.
Wheeler, unanimously carried, the recommendation of the Planning Commission was
accepted but the time specified was extended to one year from this date since
it wee the expressed feeling of the Board that they did not with to place an ,
undue hardship on Mr. and Mrs. Weeks during the winter months.
