Variations from Approved Application Plans
Section 8.5.5.3, VARIATIONS FROM APPROVED PLANS,CODES,AND STANDARDS OF
DEVELOPMENTS, of the Zoning Ordinance states: "The director is authorized to grant a variation
upon a determination that the variation: (1) is consistent with the goals and objectives of the
comprehensive plan; (2) does not increase the approved development density or intensity of
development; (3) does not adversely affect the timing and phasing of development of any other
development in the zoning district; (4) does not require a special use permit; and (5) is in general
accord with the purpose and intent of the approved application." Furthermore, under Section
8.5.5.3 a.1., the director is authorized to grant"minor variations to yard requirements".

Location: 566 Pebble Hill Court (TM76R1, Section 3, Parcel 66)
Original feature: 20' Rear Yard
Requested Variation: Allow reduction of the rear yard to a minimum of 16' for a 10'x12'
Sunroom
Criteria for Setback Variations in Planned Developments
1. Is the request consistent with the goals and objectives of the comprehensive plan? The
sunroom will be built over the existing patio and attached tc the existing house. It will have
no negative impact on form or pattern of development as anticipated by the Comprehensive
Plan. The Comprehensive Plan does not directly address rear yards and their reduction.
2. Does the request increase the approved development density or intensity of development?
No. The Redfields Architectural Review Committee and adjacent neighbors have reviewed
the proposal and have no objection. (See attachments)
3. Does the request adversely affect the timing and phasing of development of any other
development in the zoning district? No.
4. Does the request require a special use permit? No.
5. Is the request in general accord with the purpose and intent of the approved application?
Yes.
Citing the information listed above, it is my opinion that:
X This variation is permissible and that a reduction of the side yard for the referenced shed is
appropriate. Please note that any development based on this variation is still subject to all other
applicable regulations.
Cl This variation is not in general accord with the original application plan and an amendment
to the existing Zoning Map Amendment is necessary.
