It is easy to understand any confusion on the conditions of approval of this SP—there are four pages of conditions and many changes were made between the staff report recommendations,the Planning Commission's and Board of Supervisors'discussions/actions and the final conditions of approval by the Board. In the next paragraph I will summarize my findings on the tot lots and other required recreation areas. The following conditions of approval are copied from the Board's action letter of June 27, 2000: Phase 1: a. 4. b. Install a recreation area of 10,000 square feet in size, in a location to be determined with the review of the site plan. Phase 2: g. Installation of the second tot lot,fronting Rio Road West Although these are the only conditions requiring installation/construction of specific recreational areas,there was other discussion that would indicate a desire to have a level area available for older children's play towards the rear of the parcel. The Board minutes of May 17, 2000 clearly state that ". . . it has been suggested that 10,000 square feet of open space be used as a play area for children and outdoor recreational space. The second tot lot might be eliminated, if that occurs." Later in the meeting, a board member stated that she wanted to see both a tot lot and/or open space play area, as well as the 10,000 square feet of grassy open space. The County Attorney responded that the existing condition on the development plan showed a tot lot at the rear of the site. The Planning Commission's intent, on the other hand,was to have an older children's play area at the rear of the park, 10,000 square feet of grassy area in the center, and a tot lot at the front. Looking at the application plan,the only logical place for a grassy,level play area at the rear of the parcel is the gas line easement (on which the easement owner wants no structures),the area noted • C:IMy DocumentslCurrent Review\SP-ZMA's\Townwood TotLotLtr.doc Townwood Tot Lots Page 2 01/22/02 for "tot lot 2" and the open space between the gas line easement and the cemetery. An additional approval condition states, "No trees are to be removed within the rear fifty-foot buffer and cemetery site. Preserve trees along Townwood Drive to the greatest extent possible." I think it is possible to propose open space/recreational use without removing trees from the buffer,the cemetery or along Townwood Drive. The only place it may be necessary to remove any vegetation is the area noted for the tot lot and it should be minimal since most of the tot lot area is within the gas line easement. With all of this in mind, I would recommend that you submit a site plan amendment to the Planning Department (either a letter of revision or a minor amendment) that removes any"lot area" from the gas line easement, removes the "tot lot" designation from the rear of the site and notes that the area between the rear lots, the cemetery, and the tree preservation area is designated open space/recreation area. You could also do the dumpster pad changes that we have verbally discussed on the amendment—get it all taken care of with one amendment. I hope this letter meets your needs.
