Regarding your question about comment#3 from the letter dated April 24, 2019:
The second note you suggested looks mostly correct. However,you could maybe reword to the following:
"Revised Lot 34(TMP44-70) IS ASSIGNED 2 DEVELOPMENT RIGHTS AND MAY BE FURTHER DIVIDED. Revised (Lot 35)TAX
MAP/PARCEL 44-71 IS RETAINING (or is assigned) 2 DEVELOPMENT RIGHTS AND may be further divided."
The language about consisting of a certain number of acres can be removed, as the existing parcels are not being
subdivided by this plat, but instead just having boundary line changes performed, and the 31-acre limit isn't an issue for
these parcels since the original parcels are not that large.

Thank you for your quick response. I have just now been able to address your comments.
I think that most of your comments are pretty straightforward, however, I was wondering if you could help me with
comment 3. For note#19, "REVISED LOT 34 (TMP 44-70) RETAINS 5 DEVELOPMENT RIGHTS AND MAY BE FURTHER
DIVIDED AND WHEN FURTHER DIVIDED THESE RIGHTS SHALL NOT COMPRISE LESS THAN 2 ACRES. REVISED LOT 35 (TMP
44-71) RETAINS 5 DEVELOPMENT RIGHTS AND MAY BE FURTHER DIVIDED AND WHEN FURTHER DIVIDED THESE RIGHTS
SHALL NOT COMPRISE LESS THAN 2 ACRES."
Could I change the existing note to say"2 DEVELOPMENT RIGHTS" on both lots?
Or, would this note be more correct, "PARCEL 70 IS ASSIGNED 2 DEVELOPMENT RIGHTS AND MAY BE FURTHER DIVIDED
AND WHEN FURTHER DIVIDED THESE RIGHTS SHALL NOT COMPRISE MORE THAN XX ACRES.TAX MAP/PARCEL 44-71 IS
RETAINING 2 DEVELOPMENT RIGHTS AND WHEN FURTHER DIVIDED It SHALL NOT CONSIST OF MORE THAN XX ACRES."?
I'm not sure of the"MORE THAN XX ACRES". I believe if I understand correctly each parcel cannot be divided to be less
than 2 acres but are not restricted by the 31 acre rule. How would you like me to address this?

Dear Mr. Reitelbach,
Please find attached five copies of the revised Plats. The plans have been revised to address your
comments received on April 24,2019 in accordance with the following:
1. 114-302(A)1I In the title of this plat,provide the name of the magisterial district this property is
located withi• he title currently says "Magisterial District"without specifying which one.
Comment addressed.
2. I14-302(A)4, 14-302(A)5I Are the easements shown on the plat public or private? Please identify.
In addition, in note#19, it appears that the drainage and utility easement reference should state
"...along the rear and sides of all lots..."
Comment addressed.
3. [14-302(A)10] The plat must contain a note indicating the right of further division of the
proposed lots. The following note must also be on the plat (the language can be adjusted slightly
to match the specifics of this plat as a boundary line adjustment):
"Parcel [letter or number] is assigned [number] development rights and may/may not be further
divided and when further divided these rights shall not comprise more than [number] acres. The
residue of Tax Map/Parcel [numbers] is retaining [number] development rights and when further
divided it shall not consist of more than [number] acres." Please use the provided language for
note#19 on development rights,although the language about"the residue of..."is not needed
since the second parcel would not be a residue. For these two parcels,each would have two(2)
development rights assigned to it.

4. [14-302(B)11 Provide the date of revision of this plat on the next submittal. Comment still
applies.

5. ]14-303(C)] Provide the measurements and distances for the exterior boundary lines of the
property.There are several lines labelled as"Cl,""C2," etc.; however, there is no table provided
to identify that information. In addition, there are no measurements provided for the line (near the
driveway) between the old property line and the proposed new property line along Barracks Hill,
between the IF and IS symbols.

6. [14-303(D)] Include the acreage of the area that is being transferred between the two parcels.
Comment addressed.
7. 114-309, 14-310, 14-416] es Revised Lot 34 is under five (5) acres in size, and is losing area as a
result of this boundary line adjustment,provide information for review by the Health Department,
in accordance with sections 14-309, 14-310, and 14-416 of the Albemarle County subdivision
ordinance. The final plat cannot be approved until the Health Director has approved soils
evaluation reports demonstrating that the properties have adequate soils for subsurface drainfields
and reserve drainfields for septic systems and for private wells. Please submit three copies of a
soils evaluation report to the County so that these can be forwarded to the Virginia Department of
Health for review and approval. For more information,you may wish to contact Joshua Kirtley,
Environmental Health Technical Consultant, at joshua.kirtley@vdh.virginia.gov or at 434-972-
6200. Plat and soils reports have been forwarded to the Health Department for their review.
Comments or approval from the Health Department will be provided to the applicant when
received by Planning staff.

Dear Mr. Kirtley:
The County of Albemarle has received an application for a Boundary Line Adjustment involving Tax Map Parcels
44-70 and 44-71,where one proposed lot will be under five acres in size.This project requires Health Department
approval before receiving final County approval.
The applicant has provided the following for Health Department review:
• One(1)final subdivision plat(dated 01/16/2019);
• One(1)VDH Application for Subdivision Review(dated 03/22/2019);and
• Two(2)OSE/PE Reports for Subdivision Approval(dated 03/22/2019).
Please review the proposals for suitable subsurface drainfields which comply with the provisions of Chapter 18,
Sections 4.2.2,4.2.3,4.2.4,and Chapter 14, Sections 14-309, 14-310,and 14-416 of the Albemarle County Code.
