The County of Albemarle Planning Division will recommend approval of the plat referenced above once the following
comments, and those provided by other Site Review Committee, SRC, members, have been satisfactorily addressed. The
following comments are those that have been identified at this time. Additional comments or conditions may be added or
eliminated based on further review. [Each comment is preceded by the applicable reference to the Albemarle County
Code.]
1. [14-302(A)(9)] Building sites. Update Note 7 to reference "The Residue of TMP 61A-42" to match the plat map. The
note currently references the residue of TMP 61-32 but that may have just been a clerical error.
2. [14-302(B)(5)] Zoning. These properties are not within the Airport Impact Area Overlay District. Please revise or
remove Note 14.
3. [14-302(B)(7)] Agricultural -Forestal District. Provide a note on the plat that identifies whether or not the subject
property lies within an agricultural -forestal district. (Note: The subject property does not lie within an agricultural -
forestal district.)
4. [14-302(B)(8)] Yards. Revise the non -fill setbacks for Lots 1, 2, and 3 on Sheet 5 as follows, to align more readily
with the setback requirements contained in Sec. 18-4.19 for this zoning district:
a. Front setback: 5ft (minimum), 25ft (maximum) as measured from the right-of-way
b. Front loading garages: 18ft (minimum), Side loading garages: 5ft (minimum), both as measured from the
right-of-way, (no maximums).
5. [14-303(S)] Control Points. Provide at least four (4) control points, evenly distributed across the property and
located at survey property corners, and shown on each sheet depicting the property. The applicant also has the
option to show the control points on a copy of the final plat, as opposed to on the plat.
6. [Comment] Reminder that revised plats must include the original date of drawing and the revision date(s) of each
subsequent version of the plat.
'Note: Planning has reviewed the comment letter from VDOT. No change is needed on the plat. The Comment made
by the VDOT staff reviewer was more -so addressed to County staff rather than the applicant.

1. Reminder that the developer must provide the County with confirmation of the initial sale price for the affordable
units before the building permits for the bonus unit(s) can be issued.
In accordance with the provisions of Z.O. 14-229 of the County Code, if the applicant fails to submit a revised plat to
address all of the requirements within six (6) months after the date of this letter, the application shall be deemed to have
been voluntarily withdrawn by the applicant.

Ms. Gleason:
While the intention is for the existing residence at 1165 Pen Park Road to be connected to
the ACSA sewer system, I have confirmed with ACSA that it is currently is not, which
leads me to assume it is connected to a private onsite septic system. As such, I
recommend that the subdivision not be approved until the connection of that residence to
the public system has been completed.
It has also been reported, but not verified, that the "Existing Shed TBR7 on Tax Map
61A-32 may also have plumbing that is connected to an onsite septic system. Since the
intention is for the shed to be removed, I don't think any action is necessary regarding
that system prior to approval of the plat. Although not a regulatory requirement, I
recommend that any existing septic tanks associated with 1165 Pen Park Rd or the
existing shed be pumped out by a licensed sewage handler and abandoned.

Dear Ms. Gleason:
The Department of Transportation, Charlottesville Residency Transportation and Land Use
Section, has reviewed the above referenced plan as prepared by Meridian Planning Group, dated
15 March 2022, and offers the following comments:
1. The Department does not have a compelling reason to force dedicated right-of-way to
align with existing comers, though the first sentence of the Applicant's response to the
County's second comment begs explanation.
The Department finds this plat generally acceptable. If further information is desired, please
contact Doug McAvoy Jr. at (540) 718-6113.
A VDOT Land Use Permit will be required prior to any work within the right-of-way. The
owner/developer must contact the Charlottesville Residency Transportation and Land Use
Section at (434) 422-9399 for information pertaining to this process.
