This letter is to document the current situation of property identified as Parcel ID 09200-00-00-036E0. For ease of
reference, this parcel will be referred to as Parcel 36E. Based on the information below, Parcel 36E may not be divided
without approval of a special use permit for additional development rights and submittal of a plat meeting the
requirements of the Subdivision Ordinance.
Parcel 36E is shown on a plat approved by the County on June 18, 1991, and recorded in Deed Book 1172, Page 369.
Parcel 36E appears to be a parcel in existence prior to December 10, 1980, the adoption date of the Zoning Ordinance.
The plat approved on June 18, 1991, resulted in Parcel 36E being increased in size from 2.01 acres to 6.815 acres. The
resulting Parcel 36E had two development rights. One development right came from the original Parcel 36E that existed
prior to December 10, 1980, and one development right was assigned to the 4.805 acres that came from Parcel ID 09200-
00-00-03600 ("Parcel 36"). The revised Parcel 36E had two dwellings located on it at the time of the plat approval. One
dwelling (2240 Gobblers Ridge), constructed in 1973, is located in the area of the original Parcel 36E and the other
dwelling (2241 Gobblers Ridge), constructed in about 1754, is located in that area of the original Parcel 36.
A subsequent deed was recorded on January 8, 1998, in Deed Book 1685, Page 724. This deed appears to transfer land
from parcel 36 to Parcel 36E. However, the land transferred by this deed is the same land that was transferred to Parcel
36E by the plat recorded in Deed Book 1172, Page 369.
A subsequent deed and plat were recorded on April 19, 2002, in Deed Book 2244, Page 181. This document subdivided
parcel 36E by creating a new two -acre parcel. The new two -acre parcel is currently shown on the County GIS system as
Parcel ID 09200-00-00-036E1("Parcel 36E1"). Because the recorded plat was not approved by the County, its recordation
constituted a subdivision violation.
On October 1, 2003, a subdivision plat was approved by the County. This plat subdivided Parcel 36E by creating a new
two -acre parcel and leaving a 4.815-acre residue. The area shown on the plat is substantially the same as shown on the
plat recorded in Deed Book 2244, Page 181. This plat (erroneously) states that the residue (Parcel 36E) has two
development rights, and the new two -acre parcel has one development right. As noted above, Parcel 36E actually had only
two development rights as assigned on the plat approved by the County on June 18, 1991, and recorded in Deed Book
1172, Page 369. The plat approved on October 1, 2003, was recorded on October 7, 2003, in Deed Book 2610, Page 333.
The recordation of this plat corrected the earlier subdivision violation.
A building permit, B200200840SF was issued on June 3, 2002, and a Certificate of Occupancy was issued on July 2, 2003.
The County View tracking system shows this permit on as being issued on Parcel 36E. The only information available
regarding the details of the building permit is:

There is no additional information about this permit available. I believe this permit was actually for a single-family dwelling
on Parcel 36E1. I believe that the placement of the building permit on Parcel 36E was customary because it is unlikely that
the County's tax maps would have been updated to show the subdivision of Parcel 36E and creation of Parcel 36E1.
The Certificate of Occupancy states that the single-family residence is on Parcel 36, is addressed as 2240 Gobblers Ridge,
is owned by Oscar Forsberg and is associated with building permit 2002-840SF. This Certificate of Occupancy appears tc
have multiple errors. The errors include the following:
1. Parcel 36 has a dwelling constructed with B199300828SF and issued a Certificate of Occupancy on January 12,
1994. The property has only one dwelling.
2. 2240 Gobblers Ridge Road is the address of the dwelling constructed in about 1973.
3. Oscar Forsberg was not the owner of Parcel 36. Oscar Forsberg was the owner of 2240 Gobbler Ridge Road.
4. Building permit 2002-840SF was not assigned to Parcel 36.
In addition to the errors contained on the Certificate of Occupancy, no building permit for a third dwelling on Parcel 36E
should have been issued. Parcel 36E had two development rights and not three. In addition, a site plan is required to
locate three or more dwellings on a single parcel.
Based on aerial photos from 2002 and 2007, building permit B200200840SF was most likely for the dwelling that is
currently on Parcel 36E1 and is currently addressed as 2325 Gobblers Ridge. However, the Certificate of Occupancy
contains so many errors that its subject cannot be verified with any certainty.
In summary:
1. The division of Parcel 36E recorded in Deed Book 2244, Page 181 was in violation of the Subdivision Ordinance.
2. The subdivision plat that created Parcel 36E1 was approved on October 1, 2003,
3. The recordation of that approved plat in Deed Book 2610, Page 333 corrected the prior subdivision violation.
4. Though approved for recordation, the plat erroneously purported to assign three development rights to a property
that had only two development rights.
Based on the above facts, I make the following observations
The plat subdividing Parcel 36E that was approved on October 1, 2003, created Parcel 36E1 and was timely recorded in
Deed Book 2610, Page 333. The owner may rely on the approval for purposes of recordation but may not rely on the
surveyor's erroneous assertion of development rights. No action is required on the division of Parcel 36E and creation of
Parcel 36E1, as currently configured.
However, as noted, that plat incorrectly purports to allocate two development rights to Parcel 36E, when that parcel had
only one development right. Because there is no authority to administratively grant additional development rights, the
County will not approve a subdivision of Parcel 36E based on these purported development rights.
Any further division of Parcel 36E would require approval of a special use permit for additional development rights and
submittal of a plat meeting the requirements of the Subdivision Ordinance.
