RE: Rosamond Payne, Application for variance
2193 Thomas Jefferson Parkway
Legal: part of parcel D, TM 93-40C
Thank you for your proposal of an alternative solution which will allow Mrs. Rosamond
Payne to use her remaining development rights, creating two lots in addition to her
existing home
I understand that all of this is dependent upon the Eppards, who are the property owners
across the street, donating their 204 feet of road frontage.
As Mrs. Payne's representative, I hereby withdraw her petition for a variance and
I understand and accept that since the work of notification has been done, there can be no
refund of the application fee.

RE: Tax Map 93,Parcel 40C
Dear Ms. Payne:
After researching your property as part of your request for a variance for road frontage, I have come
to the conclusion that you do not need a variance to accomplish the subdivision that you desire.
The following are the facts as I understand them:
1. Your neighbor, a Ms. Eppard, will deed to you the strip of land in front of her property but on
your side of Rt. 53. This strip (including more than just Ms. Eppard's portion) is shown as "area
of confusion" on a plat entitled "Plat Showing Survey of Parcels C&D, a Division of TMP93-
40" drawn by Roudabush , Gale&Assoc, Inc and dated July 29. 1991. Since that plat indicates
that you have no precise state road frontage, the increase of 200+ linear feet will make your
parcel more conforming to our zoning regulations and therefore can be accomplished without a
variance.
2. You would then like to subdivide your 25.54 acres into a total of either two or three parcels, for
which you already have the theoretical development rights. (i.e.,Your residue parcel and either
one or two new parcels.) You would like to keep the entire front portion of the land including
all the road frontage or frontage on the "area of confusion" and give access to the new parcel(s)
by means of an access easement through your residue 12± acres. This is a subdivision by
definition and requires no variance.
3. There are subdivision regulations that include the size and construction standard for the public
or private road which you will have to meet. One of those will require that you obtain a waiver
from the Planning Commission to permit your residue parcel to have two entrances on Rt. 53.
(i.e.,your driveway and the new access easement.) You will have to request this as part of the
subdivision process.

If all of this is correct, you may proceed without any variance. Yadira Amarante in the Department
of Planning and Community Development has been consulted regarding your proposed subdivision
and is anticipating your application. I am sure that you will find her helpful in seeing your project
through the subdivision process. If I can be of any additional assistance, please feel free to call on
me.
