Box 721 Charlottesville,Virginia 22902 RE: Tax Map 93,Parcel 40C Dear Ms. Payne: After researching your property as part of your request for a variance for road frontage, I have come to the conclusion that you do not need a variance to accomplish the subdivision that you desire. The following are the facts as I understand them: 1. Your neighbor, a Ms. Eppard,will deed to you the strip of land in front of her property but on your side of Rt. 53. This strip (including more than just Ms. Eppard's portion) is shown as "area of confusion" on a plat entitled "Plat Showing Survey of Parcels C&D, a Division of TMP93- 40" drawn by Roudabush , Gale&Assoc, Inc and dated July 29. 1991. Since that plat indicates that you have no precise state road frontage,the increase of 200+ linear feet will make your parcel more conforming to our zoning regulations and therefore can be accomplished without a variance. 2. You would then like to subdivide your 25.54 acres into a total of either two or three parcels, for which you already have the theoretical development rights. (i.e.,Your residue parcel and either one or two new parcels.) You would like to keep the entire front portion of the land including all the road frontage or frontage on the "area of confusion" and give access to the new parcel(s) by means of an access easement through your residue 12± acres. This is a subdivision by definition and requires no variance. 3. There are subdivision regulations that include the size and construction standard for the public or private road which you will have to meet. One of those will require that you obtain a waiver from the Planning Commission to permit your residue parcel to have two entrances on Rt. 53. (i.e.,your driveway and the new access easement.) You will have to request this as part of the subdivision process.
