THIS DEED made this 28th day of June 1979 by and between
CHARLES WM. HURT, a widower, (the "Grantor") of the first
part, and FIRST VIRGINIA BANK - CENTRAL, a Virginia banking
corporation, " P , (the " Grantee ) of the second part,
W I T N E S S E T H:
For and in consideration of the sum of Ten Dollars
r ($10.00) cash in hand paid and other good and valuable
consideration, the receipt of which is hereby acknowledged,
the Grantor does hereby GRANT, BARGAIN, SELL and CONVEY with
GENERAL WARRANTY AND ENGLISH COVENANTS OF TITLE unto the
Grantee all that certain tract or parcel of land situate in
the Rivanna Magisterial District of Albemarle County, Virginia,
at the intersection of Riverbend Drive and U. S. Route 250,
east of Charlottesville, containing 47,631 square feet, as
shown and described on the attached plat of B. Aubrey Huffman
& Associates, Ltd., dated April 17, 1979, captioned "47,631
S.F. Being A Portion Of Parcel 17D On Sheet 78 County Tax
Maps", BEING a portion of the property conveyed to the
Grantor by deed of Arlene M. Rolkin, dated December 1, 1965,
of record in the Clerk's Office of the Circuit Court of
Albemarle County, Virginia, in Deed Book 414, at page 383.
TOGETHER with a non-exclusive easement 26 feet in width
for ingress and egress to Riverbend Drive as shown and
described on the attached plat of B. Aubrey Huffman &
Associates, dated June 20, 1979, captioned "Plat Showing
26' ingress & egress easement across parcel 17D County tax
sheet no. 78, Pantops", (the "26 Foot Access Easement"). The
Grantor, and his assigns, reserve the right to modify the
location of the 26 Foot Access Easement at no cost to the
Grantee in order to provide convenient traffic circulation
for the benefit of the remaining portion of the 66.9 acre

Huffman 8 Associates, Ltd., dated 1 December 1965, of record
in said Clerk's Office in Deed Book 414, at page 385, cur-
rently owned or controlled by the Grantor, but any such
relocation of the 26 Foot Access Easement shall provide
convenient ingress and egress to the property hereby conveyed.
Any relocation of the 26 Foot Access Easement which does not
result in a direct access to and front on Riverbend Drive
shall require the consent of the Grantee, it being the!
intent of the parties that any such relocation which promotes

the commercial development of the remaining portion of the
66.9 acre tract and provides convenient access to the Grantee i
will be consented to. In addition to the foregoing rights
granted to the Grantor to relocate the 26 Foot Access Ease-
ments, the parties STIPULATE that the Grantor may move the

26-Foot Access Easement in a westward direction to a point y.

that is an extension of the drive-in exit lanes of the Gran- a

tee. In the event that Riverbend Drive is accepted into the
State Highway System and no divider or median which would
prohibit direct access to the property hereby conveyed, is
required at the time of the dedication of Riverbend Drive
and its acceptance into the State Highway System, then in
that event, the 26 Foot Access Easement shall terminate and
the Grantee agrees to execute such instruments as may be
reasonably necessary to effect such termination. In the
event that the 26 Foot Access Easement is not terminated and
is required by the Grantee for access to Riverbend Drive,
the Grantor COVENANTS that it will construct a two-way
travel lane for the Grantee in the 26 Foot Access Easement
or any relocation thereof.
TOGETHER with a non-exclusive easement 70 feet in width
for ingress and egress to the property herein conveyed over
and along Riverbend Drive from its intersection with U. S.
Route 250 to a point determined by an extension of •the

southernmost boundary of the 26 Foot Access Easement, which
easement shall terminate in the event that Riverbend Drive
is accepted into the State Highway System.
The Grantor COVENANTS to construct a road within the 70
foot right-of-way of Riverbend Drive from its intersection
with U. S. Route 250 for a distance equal to the easement
granted in the preceding paragraph, such road to be 57 feet
in width and constructed with a pavement strength in accordance
with the Virginia Department of Highways and Transportation
standards for Category IV roads, and to maintain such road to
the standards of maintenance and snow removal equal to those of
the Virginia Department of Highways and Transportation.
The COVENANTS herein -made by the Grantor for construction
of the road and maintenance thereof and for the construction of
travel lanes in the 26 Foot Access Easement are personal
covenants of the Grantor and do not impose any obligation or
servitude on other lands of the Grantor.
This conveyance is made subject to a 30 foot building
setback line as shown on the above referenced attached plat
dated April 17, 1979 and to easements and restrictions of record.
