Willoughby Corporatiou 413 7th Street NE Charlottesville, Virginia Re: Board of Supervisors Action-SP-S34 SP-47-76 Dear Sirs: This is to advise you that the Albemarle County Board.of Supervisors at its meeting July 21, 1976, approved your requests for SP-534 and SP-47-76 subject to a series of conditions. These conditions al;e attached in the form of a memo to Mr. Robert Tucker, Director of Planning,from Lettie E. Neher, Clerk, dated July 22, 1976. The motion of approval reads: "Approve SP-534 with an amendment to condition #4 which replaces Condition #4 in memorandum dated December la, 1975, by substitution of conditions listed in letter dated July 21, 1976, signed by J~ne Gloeckner, but with the language of item No. 6 in that letter altered to read: Package treatment plant is to be phased out, dismantled and removed when aDequate sewage capacity is made available by the Rivanna Water and Se\'ler Authority." ROM: Lettie ,E. Neher, Clerk DATE: 'July 22, 1976 SUBJECT: Conditions of approval, SP-534, Nilloughby Corporation. 1. Maintain the proposed density of 5.3 dwelling units per acre (gross).. 2. Approval from State HighwJY Department concerning internal street rights-of-way and cross sections. 3.. Corps of Engineers review and approval of any development, i.e., residential, commercial, and streets, within the flood plain limits. 4. Tertiary package sewage treatment plant, as follows: a) Corps of Engineers review and approval of any development within the flood plain of Noore's Creek. b) Site plan approval. c) Approval of Count.y Engineer, State Water Control Board and other appropriate Federal, State and local agencies. d) Package treatment plant is to be operated and maintained by the Rivanna Water and Sewer Authority pursuant to contract approved by the County Attorney and the County Engineer. All water and sewer lines are to be dedicated to the Albemarle County Service Authority and access easements to be provided to all said utilities to be adequate in the opinion of the Albemarle County Service Authority. e) Applicant shall provide a written statement from the Albemarle County Zoning Administrator stating that soil erosion is controlled to the satisfaction of the Zoning Administrator and that continuing efforts are being made to control soil erosion. f) Package treatment plant is to be phased out, dismantled and removed when adequate sewage capacity is made available by the Rivanna Water and Sewer Authority. 5. Submit to the Albemarle County Se:rvice Authority an estimat.e by stages of the capacities that will be expected on an annual basis. 6. Open space and recreation plan to be submitted for approval by the County Department of Planning indicating recreation e~uipment and facilities proposed. 7. Dedication of water and sewer lines to the Albemarle County Service .Authority. 8. This approval is contingent upon the County Engineer's approval. All streets to be constructed with sidewalks. IO. County Attorney's review of any deed restrictions or homeo\vners' association agreements. II. No site plan or subdivision plat approval shall be given until the grading plan for this property has been approved. l2. Only those areas where a structure, utilities, streets, sidewalks, rccreation areas, nature and bikc traj,ls, parking areas, and debris basins are to be placed shall be disturbed; all other land shall remain in a natural state. 13. The commercial area shall be limited to 17 acres gross area in Albema,rle County. 14. Bike trails are to be developed in" keeping with the concept received and accepted by the Planning Commission under a study entitled "Bike\vay Plan for Albemarle County, Virginia" dated "Fall, 1975" prepared by Albemarle County Department of Planning. 15. Present erosion problems to be corrected to the satisfaction of the Zoning Administrator before any further approvals required hereafter are given. l6~ All internal roads serving this development are to meet the standards of the Virginia Departmen't of Highways for inclusion into the High\.my System of Virginia. 17. 'The generalized land use plant showing the location of the types of single-family and multi-family development and commercial areas and the access to these areas from the internal road system shall be adhered to. The Land Use Plan referred to is that described as Exhibit "A'I, prepared by Environmental Interface and marked "Received, .11/26/7S" and color coded and signed by John L. Humphrey, Director of Planning. 18. Due to the fact that the Albemarle County School Board, through resolution, stated that no school reservation is warranted, the Albemarle County Planning Commission concurs with their resolution.
