I would like to defer SUB201900133 until the consolidation plat is reviewed and recorded and I can submit an updated
boundary for TMP 72-36C1. Sorry for the mix up, thank you for working with me to come up with a solution that works

Good afternoon Will,
Thank you for following up with us regarding these plats. It is fine if you move forward with the consolidation plat (Chris
is reviewing this plat) at this time, and defer action on SUB2019-00133 (I am reviewing this plat) until the consolidation
plat is recorded. Please submit to me in writing (an email is fine) a request for deferral of SUB201900133. This request
for deferral will keep the application for SUB2019-00133 active, so you do not have to submit a new application or pay a
new fee for it when you are ready to submit the revised plat. Planning staff will not take action on the currently-
submitted plat at this time, and review will begin again once you have submitted the revised plat for SUB2019-00133.
Please let me know if you have any questions or want further clarification.

Can we move forward with the Boundary Line Adjustment Plat and Consolidation Plat for Tax Map 72 Parcels 36C, 36C1
& 36C5? Can you guys hold onto the Application and Check for the other survey until I can submit a new plat once the

The County of Albemarle Planning Division will grant or recommend approval of the plat referenced
above once the following comments have been addressed: [Each comment is preceded by the applicable
reference,which is to the Subdivision/Zoning Ordinances unless otherwise specified.]
1. [General Comment] This plat involves one of the same parcels as SUB2019-00142, which is
also under review by the Planning Division. However,the two plats are showing different
proposals for the parcel (TMP 72-36C1). Please clarify what is proposing to be done with this
property so that staff can better review the two boundary line adjustment applications.
2. [14-302(A)10] Revise the development rights note(Note#17)to indicate how many
development rights each parcel has available and whether any are being transferred with this
boundary line adjustment. Use the following language: "Parcel [letter or number] is assigned
[number] development rights and may/may not be further divided and when further divided
these rights shall not comprise more than [number] acres. The residue of Tax Map/Parcel
[numbers] is retaining [number] development rights and when further divided it shall not
consist of more than [number] acres."Reviewing previously recorded plats, it appears that
TMP 72-36C1 has only one(1) development right remaining, although a parcel of at least 21
acres could still be subdivided out. In addition, it appears that TMP 72-36C6 has one(1)
development right remaining as well. (All parcels of less than 21 acres must have at least one
development right.)
3. [14-302(B)6] There are several areas on the plat where the incorrect tax map and parcel
numbers are provided. Please revise note#1 to state the correct TMP numbers for the subject
parcels of this plat.

The County of Albemarle Planning Division will grant or recommend approval of the Boundary Line
Adjustment Plat referenced above once the following comments have been addressed: [Each comment is
preceded by the applicable reference,which is to the Subdivision/Zoning Ordinances unless otherwise
specified.]
1. [14-302(A)10]Right of Further Division of Proposed Lots. Note#17 is incorrect. There is 1
development right associated with TMP 72-36C 1 (32.355 ac),which remains with the 3 acre
portion of the original 5 acres.TMP 72-36C5(5.489 ac)contains 1 development right that needs
to be allocated with either Parcel"A"or Parcel"B".Additionally,TMP 72-36C(10.042 ac)only
contains 1 development right. Revise.
I offer the following revised note#17,if you choose to allocate the development right from TMP
72-36C5 with Parcel A(2.744 AC),which is being added to TMP 72-36C1: "Tax Map/Parcel
72-36C1 is assigned 2 development rights and may be further divided. Tax Map/Parcel 72-36C is
retaining 1 development right and may not be further divided. No development rights are
transferred with Parcel B."
OR
I offer the following revised note#17,if you choose to allocate the development right from TMP
72-36C5 with Parcel B(2.745 AC),which is being added to TMP 72-36C: "Tax Map/Parcel 72-
36C1 is retaining 1 development right and may be further divided. Tax Map/Parcel 72-36C is
assigned 2 development rights and may be further divided. No development rights are transferred
with Parcel A."
2. [14-302(A)4]Private Easements. For each private easement label the name of the owner of
record.
Staff has provided references to provisions of Chapter 14 of the Code of the County of Albemarle. The Code is
kept up to date by the County Attorney's office.The Code may found on the County Attorney's website which
may be found under"Departments and Services"at Albemarle.org. In accord with the provisions of Section 14-
229(B)of Chapter 14 of the Code if the developer fails to submit a revised final plat to address all of the
requirements within six(6)months after the date of this letter the application shall be deemed to have been
voluntarily withdrawn by the developer.Please contact Christopher Perez in the Planning Division by using
