CERTIFICATE OF PLAT MAINTENANCE AGREEMENT REGARDING POND ACCESS EASEMENT AND SEWER EASEMENT Attached hereto is a plat of Roudabush, Gale & Associates dated July 29, 1997, entitled "Subdivision Plat Lots B-1, B-2, B- 3 and B-4, A Division of Parcel 1, Tax Map 46B4, Forest Lakes - North Section, Rivanna Magisterial District, Albemarle County, Virginia" Pursuant to a Pond Maintenance Agreement recorded in the Clerk's Office of the Circuit Court of Albemarle County, Virginia, in Deed Book 1463, page 477, Lot B shown on a plat recorded in the aforesaid Clerk's office in Deed Book 1463, page 481 contributes 67% of the maintenance of the pond. Among Lots B-1, B-2, B-3 and B-4, the 67% contribution shall be divided as follows: Lot B-1 25. Lot B-2 310-. Lot B-3 32% Lot B-4 12% As shown on the attached plat, there is created for the benefit of Lot B-4 a twenty foot (20') wide private sewer easement across Lot B-3. Lot B-4 may install, repair or replace a sewer line within the easement to serve Lot B-4 and the owner of Lot B-4 shall be responsible for restoring any ground or pavement it disturbs on Lot B-3 to its prior existing condition. There is created for the benefit of Lots B-3 and B-4 a twenty foot (20') wide access easement as shown on the attached aK 1643PGO642 plat. Lots B-3 and B-4 shall mutually maintain the joint access easement in good condition, including snow removal after any snowfall measuring more than 2 inches. Lots B-3 and B-4 are each obligated to contribute to the maintenance of the access easement once a certificate of occupancy is issued for the particular lot. If any owner does not pay its share of maintenance costs for the pond or the access easement, and another owner must bring suit to enforce any payments or contributions from another owner, the losing party shall also owe all costs associated with the suit, including reasonable attorney fees of the prevailing party.
