Included (below) are comments provided by Albemarle County with responses (in red), accordingly: (Planning) 1. [General Comment] The final site plan for Old Trail Village Block 7Cmust beapproved prior to approval of this final subdivision plat. Additional comments may be provided on the subdivision plat based on the final layout and design of the approved site plan, as they must match. Noted. Incidental to current plat provision regarding site plan status. 2. [ZMA201 5-00001 ] Revise the minimum lot area in Note 2. For SFD units, the minimum lot size is 4,000 sq.ft. For SFA units, the minimum lot size is 1,000 sq.ft. Addressed. Note 2 has been modified. 3. [14-302 (A) 31 Identify the proposed Fennel Road as a "private street" on sheet 2, and call it out as a"private street easement." Addressed. Sheets 1-3 modified accordingly to present Fennel Road as a Private Street Easement. 4.[14-302(A)31 Revise note#15tosay "Publicright-of-wayshown hereon...." Addressed. Note15 modified accordingly. 5. [1 4-302(A)31 Is the portion of Golf View Drive that is proposed to be vacated and become part of the open space lot currently public right-of-way? Correct, and addressed with addition of area Table on sheet 1. 6.[14-302(A)4]Onsheet 3, who isthe trail easement being dedicated to? Addressed; trail easement shall be dedicated to Old Trail Community Association, Inc. Please also see added Note 20. [ 14-302(A)9] There must be a note on the cover sheet indicating whether each lot has a building site that complies with the zoning ordinance. Addressed; please see added note 18 on sheet 1. 8.[14-302(A)91 There is an existing storm easement on most of lot 34 and part of lot 33. Is this being vacated? There is no building site on these lots if the easement remains. Addressed; label is revised to include 'hereby vacated'. 9.D 4-302(B) 1 Provide the date of last revision ofthe plat on all future submittals. Addressed;title block updated to include revision date, this plat. 10. [14-302(B)1 ] Provide a title on each sheet that matches what is provided in the index on the cover sheet of the plat. Addressed. Corresponding title added on each sheet. 11. [1 4-302(B) 51 Include the zoning overlay district that applies to these parcels: Steep Slopes — Managed. Addressed. Managed steep slopes now shown per County data and noted in Survey Note no. 23. 12. [14-302(B) 51 Include the special exception that was approved by the Board of Supervisors allowing the reduction Addressed. See Survey Note 19 on sheet land modified annotation / label. 13. [14-302(B)5] The zoning labels on Sheet 2 for the residues of 35D1 and 713 are incorrect. There is no SF zoning district. Addressed. Zoning label revised / corrected to state 'N M D'. 14. [14-302(B)10] There is a Water Protection Ordinance (WPO) stream buffer located on these parcels, surrounding the pond. Show boundaries of this buffer on the plat and provide the required note. Addressed. See Survey Note 19 on sheet 1 and modified annotation / label. 15. [14-317] Identify who will own and be responsible for the proposed private right-of- way, as well as the open spaces. HOA documents that comply with the requirements of 14-317 must be provided to County staff for review and approval prior to the approval of this plat. These documents will then need to be recorded along with the subdivision plat once everything has been granted final approval. Addressed. Old Trail Community Association will be responsible for private R/W and Open Space(s). See Survey Note 20 on sheet 1. 16. [General Comment] Some ofthe easements will require deeds prepared by the Engineering division. Noted, and to be coordinated by legal. Comments from Other Reviewing Departments and Agencies Albemarle County Engineering Services (Engineer) Emily Cox, ecox2(a)albemarle. org— Requested changes; seethe comments below: -Variable width SWM easement should be labeled as "Public SWM facility easement." Addressed. Label has been modified. -SWM and drainage easements will need deeds. Engineering will draft these deeds when the plat is ready for approval. Noted (legal matter). -Road plan must be approved and bonded before subdivision can be recorded. Noted. Add a note: "VDOT will only maintain within public drainage easements to the extent necessary to protect the road." Please provide a digital copy in PDF format of the revised plan along with a comment response letter. If further information is desired, please contact Doug McAvoy Jr. at (540) 718-6113. A VDOT Land Use Permit will be required prior to any work within the right-of-way. Area Land Use Engineer Charlottesville Residency VirginiaDOlorg WE KEEP VIRGINIA MOVING ATTACHMENT II RESOLUTION TO APPROVE SPECIAL EXCEPTION TO MODIFY CODE OF DEVELOPMENT AND APPLICATION PLAN APPROVED IN CONJUNCTION WITH ZMA201500001 OLD TRAIL WHEREAS, the Owner of Tax Map Parcel Number 055EO-01-22-00000 filed a request for a special exception to vary the Code of Development approved in conjunction with ZMA201500001 Old Trail to allow lots and disturbance within the stream buffers and to modify the Application Plan Open Green Space Areas to reflect the current stream buffers. NOW, THEREFORE, BE IT RESOLVED that, upon consideration of the foregoing, the Memorandum prepared in conjunction with the special exception request and the attachments thereto, including staffs supporting analysis, and all of the factors relevant to the special exception in Albemarle County Code §§ 18-8.5.5.3 and 18-33.49, the Albemarle County Board of Supervisors hereby approves the special exception to vary the Code of Development approved in conjunction with ZMA201500001 Old Trail and to modify the Application Plan as set forth hereinabove, subject to the condition attached hereto. Special Exception to Vary the ZMA201500001 Old Trail Code of Development and to Modify the Application Plan Special Exception Condition 1. Stream buffer mitigation shall be provided at a 2:1 ratio in accordance with a buffer mitigation plan for Old Trail Village ZMA2015-001, as approved by the County Engineer. 2. Disturbance to the buffer shall be limited to the areas depicted on pages 1-4 of the exhibit prepared by Roudabush, Gale & Associates, Inc., entitled "WPO Stream Buffer Impact Exhibit Blocks 19, 24-25, 32-43" dated January 23, 2018, with a revision date of December 6, 2018. Modification of the "Open Green Space' shall be limited to the areas depicted on pages 1-4 of the exhibit prepared by Roudabush, Gale & Associates, Inc., entitled "WPO Stream Buffer Impact Exhibit Blocks 19, 24-25, 32-43" dated January 23, 2018, with a revision date of December 6, 2018. 51
