Please include a reference to the "instrument number" that's provided. I think the Clerk's Office might have gotten rid of
"deed book and page" numbers and have switched to just instrument numbers. You can reference that instrument
number on the cover page in the site details or as a callout/label next to the easement that's shown on the plan sheets.
I've seen it done both ways.

ACSA has no objection to having the ACSA deed recorded with the plat, if required by the Clerk.
Any field changes to the water main alignment location, will require an updated deed and plat showing the new
easement location.

Here's a summary of everything I can find so far. I'm copying Jeff Baker, our building permit reviewer with Zoning, and
Matthew Wentland with engineering to keep them in the loop as well.
• Easement Plat SUB2021-168 approved 2/9/2022, needs to be recorded at clerk's office. Not sure why Clerk's
Office didn't let you record, but I would advise to try again. There are no additional documents needed for ACSA
or Planning. This Plat in our eyes has been approved and it is up to the Applicant to record it.
• Site Plan SDP2021-47 all comments addressed, pending resubmission to include one final revision — show new
easement and include the recorded instrument number (plat mentioned above)
• WPO/VSMP Plans WPO2021-44 appears to have been approved 2/15/2022
• ARB Application ARB2021-96 approved 3/2/2022
• Lastly, a Building Permit Application B202201048AC — currently under review. Typically, a site plan but must be
approved prior to building permit application, but in this case I don't see there being any issues.
If anyone else has anything to add please let us know.

I appreciate the dialogue and responses to this one remaining outstanding item.
This item has been our only outstanding item since early March when ARB issued their CoA. Alan has been diligently
working to get this item resolved, but as he mentioned we are in a loop of conflicting information.
Given the long lead times on building permit applications at the County, we're growing increasingly concerned about
submitting for our building permit and remaining within our schedule for construction.
Is there anything we can do to submit for building permit while this last remaining item gets sorted out? Can anyone
provide a site approval form and number that allows us to get our building permit in queue? Our ACSA pre -application
has been approved, we have our ARB CoA, bonds have been posted; this deed of easement is our only remaining
unresolved item.
We've been told to anticipate 6-8 weeks for building permit review (which is frustrating in itself, but not due to anyone
on this email chain). I'm just searching for some way this process could run concurrently so our owner can feel like some
progress is being made toward breaking ground. Certainly, we'd not expect a building permit issued prior to site plan
approvals, but it seems like there is time in the building permit review process to allow these two items to run
concurrently.
Again, I appreciate everyone's efforts and I look forward to crossing the finish line on this site plan review process.

ACSA does not require the deed be recorded with the plat throughout the site plan stage.
I believe the dilemma here (from my understanding) is that the Clerk's office is requiring an additional document
(typically not the ACSA deed) accompany the plat to record.
Are there any documents from the County's end that may be missing to get the plat recorded?

It was my understanding that the ACSA deed does not need to be recorded along with the Plat showing the easement.
Richard, please let us know the appropriate order here.

The easement plat cannot be recorded without the approved deed from ACSA. ACSA does not want to approve and
record the easement and deed until after construction. The only easement associated with the site plan is for ACSA. We
are stuck in a loop. All other comments have been addressed now that we satisfied ARB.

If the easement plat has been recorded, please update the site plan to include the recorded instrument reference. The
Site Plan will need to be submitted digitally one more time to make sure all reviewer comments have been addressed.
Once all comments have been addressed then yes the plans can be submitted for signature.

The building permit was just entered into the system on the 1' of this month last week and I just checked, the plans
have not yet even been scanned into our system (assuming hard copies were provide?). Per Kevin's last bullet below,
once I see the plans and do a quick check against the site plan that is in the system (with the assumption that no changes
are forthcoming), I can move the permit along. I'm copying all relevant internal reviewers as a head's up to this project.
Please note that expediting this permit would be placing it on the top of hundreds that are currently pending in the
review system so no promises can be made on turn -around. With that said, we will do what we can.

Here's a summary of everything I can find so far. I'm copying Jeff Baker, our building permit reviewer with Zoning, and
Matthew Wentland with engineering to keep them in the loop as well.
• Easement Plat SUB2021-168 approved 2/9/2022, needs to be recorded at clerk's office. Not sure why Clerk's
Office didn't let you record, but I would advise to try again. There are no additional documents needed for ACSA
or Planning. This Plat in our eyes has been approved and it is up to the Applicant to record it.
• Site Plan SDP2021-47 all comments addressed, pending resubmission to include one final revision — show new
easement and include the recorded instrument number (plat mentioned above)
• WPO/VSMP Plans WPO2021-44 appears to have been approved 2/15/2022
• ARB Application ARB2021-96 approved 3/2/2022
• Lastly, a Building Permit Application B202201048AC — currently under review. Typically, a site plan but must be
approved prior to building permit application, but in this case I don't see there being any issues.

I appreciate the dialogue and responses to this one remaining outstanding item.
This item has been our only outstanding item since early March when ARB issued their CoA. Alan has been diligently
working to get this item resolved, but as he mentioned we are in a loop of conflicting information.
Given the long lead times on building permit applications at the County, we're growing increasingly concerned about
submitting for our building permit and remaining within our schedule for construction.
Is there anything we can do to submit for building permit while this last remaining item gets sorted out? Can anyone
provide a site approval form and number that allows us to get our building permit in queue? Our ACSA pre -application
has been approved, we have our ARB CoA, bonds have been posted; this deed of easement is our only remaining
unresolved item.
We've been told to anticipate 6-8 weeks for building permit review (which is frustrating in itself, but not due to anyone
on this email chain). I'm just searching for some way this process could run concurrently so our owner can feel like some

progress is being made toward breaking ground. Certainly, we'd not expect a building permit issued prior to site plan
approvals, but it seems like there is time in the building permit review process to allow these two items to run
concurrently.
Again, I appreciate everyone's efforts and I look forward to crossing the finish line on this site plan review process.

The easement plat cannot be recorded without the approved deed from ACSA. ACSA does not want to approve and
record the easement and deed until after construction. The only easement associated with the site plan is for ACSA. We
are stuck in a loop. All other comments have been addressed now that we satisfied ARB.

Alan,
Item #1 is referring to the existing ground -mounted lighting. The action letter (attached) from the 9/7/21 ARB meeting
contained the full condition. The photometric plan was revised to show illumination levels only for the new fixtures
(building -mounted lighting) but the note regarding the existing site lighting was not added to the plan. If there are still
no changes to the existing ground -mounted lighting proposed, please add the note to the plan. The note can be tweaked
to state that no changes are proposed to the existing ground -mounted lighting and the ground -mounted lighting
remains as was approved with SDP2003-67.
Regarding item #2, the ARB had no issue with the changes shown to the previously approved architectural design at the
11/15/21 ARB meeting but the revised line drawings are needed for final approval.
ARB approval is pending resubmittal of revised architectural drawings and site plan that includes a note regarding the
existing ground -mounted lighting.

Thanks Kevin. Engineering has approved VSMP plan. We are in the process of posting bonds. I was not aware of an
outstanding ARB issue. I just checked on the 11/19/2021 comment letter and found this..
1. Note clearly stating that no changes to existing site lighting are proposed and site lighting remains as was approved
with SDP2003-67 is missingfrom the plans.
2. Changes to the approved building design have also been proposed that will be reviewed by the Board during a
worksession/other business item during the 11115121 ARB meeting.
Regarding item #1: This seems like an errant comment perhaps from another project review. Our site plan included a
photometric plan because we did have changes to the site lighting and I did not see any previous reference to the this
note.
Regarding item #2: 1 don't have record of any comments generated from the 11/15/21 ARB review.
Any suggestions on how to resolve these issues.

Development Department for final submittal and approval. Once signed by the Agent for the Board of Sueprvisors one
copy will be kept for our records and one copy will be returned to you. If you require additional copies please make
copies of the signed plat we return to you. Additional copies will not be signed. Please make sure to print the plats to
scale, have all applicable parties sign them, and have it notarized.
Once the plat is recorded please update the pending site plan application SDP202100047 to show the easement and
include the recorded instrument number. Comments on the most recent site plan submission will be sent out in the
next week or so.

Alan,
Item #1 is referring to the existing ground -mounted lighting. The action letter (attached) from the 9/7/21 ARB meeting
contained the full condition. The photometric plan was revised to show illumination levels only for the new fixtures
(building -mounted lighting) but the note regarding the existing site lighting was not added to the plan. If there are still
no changes to the existing ground -mounted lighting proposed, please add the note to the plan. The note can be tweaked
to state that no changes are proposed to the existing ground -mounted lighting and the ground -mounted lighting
remains as was approved with SDP2003-67.
Regarding item #2, the ARB had no issue with the changes shown to the previously approved architectural design at the
11/15/21 ARB meeting but the revised line drawings are needed for final approval.
ARB approval is pending resubmittal of revised architectural drawings and site plan that includes a note regarding the
existing ground -mounted lighting.

outstanding ARB issue. I just checked on the 11/19/2021 comment letter and found this..

The Site Plan (SDP202100047) will need to revised to reflect the recorded easement (SUB202100168). The Plan will need
to show the easement and include its recorded instrument number in the label. Once that has been updated please
resubmit the Site Plan for review. Based on the comments sent out 11/19/2021, Engineering needs an approved VSMP
plan prior to approval and any outstanding ARB comment needs to be addressed. I have no additional Planning

copies of the signed plat we return to you. Additional copies will not be signed. Please make sure to print the plats to
scale, have all applicable parties sign them, and have it notarized.

Attached below are the links for the documents for the Umansky Subaru Major Amendment. As I mentioned in A -Team
I would like help commenting on the proposed parking. Attached here is a word document with a draft of my
comments. These are not finalized and I was going to go over them again with Cameron next week.
Where I would like Zoning to weigh in is on the discrepancies between the number of employees and parking required
for the service bays. The number of employees has significantly changed since the previous plan SDP2003-67 and they
have not provided any justification of this change. Also, there is no change in the number they have required for the
service bays despite adding over 5000 square feet of service area with this amendment. Please see my draft comments
and the attached links for additional info.
If you guys would like to meet to discuss this just let me know. Wednesdays are typically wide open for me and I can
meet anytime.

Yes, Albemarle County has parking regulations that are outlined in Section 4.12 of the Zoning Ordinance. Section 4.12.6
identifies the minimum number of spaces for specific uses. For this type of use the scheduled parking requirements
include:
Motor vehicle sales, including automobiles, farm equipment and trucks: one space per 1,500 square feet of
display area. Spaces for customers shall be clearly delineated on the ground, signed and maintained for
customers only.
Automobile service station and truck repair shop: one space per each employee plus two spaces per each service
stall. In addition, when accessory activities such as the rental of automobiles, trucks and trailers of all types exist
on the site, there shall be provided suitable area to accommodate the highest number of rental units expected at
any one time.
Since the proposed changes to the site affect the total parking provided and total parking required our Zoning
Administrator will review these plans and provide and comments and suggestions accordingly. We are well aware of the
concerns regarding parking at this site.

I am sure that Albemarle county like others requires hotels to have a certain number of parking spaces based on the
number of sleeping rooms as well as the number of square feet of meeting space. I would suspect the same goes for
retail buildings. Does the same also apply to car dealerships?
