Dear Mr. Herrick:
The applicant has submitted an Affidavit for family relationship. Attached please also find a copy
document and plat.
This Affidavit provided is not the County's form which is attached to the family division application and
checklist. It also does not appear to include all of the language in the County's Affidavit form. So, I'm
sending this to you to ask if what they have done is sufficient. If it is not, please provide guidance on what
modifications would be required to their affidavit. Please note that there are two current owners, which the
County's affidavit does not appear to be designed to handle.
A little history on this review: With the exception of the affidavit of family relationship that was just
submitted for the first time (attached), the legal documents and plats were reviewed under a different
project number (SUB2018-82) last year and John Blair had already approved them. This project was
recently resubmitted under another project number because it had been withdrawn for inactivity.
Therefore, I have not provided you with the whole submission. If you need any other items for your
review please let me know.
If October 23rd is reasonable under current workload it would be appreciated. Should you have any
questions or comments please feel free to contact me.

The Property is hereby subdivided into Family Lot D and the Residue Lot (the
"Created Lots") as shown on the Plat.
2. With the exception of the transfers identified in Paragraph 3 below, neither of the
Created Lots may be transferred to any person other than an eligible member of the immediate
family of Declarants for a period of four (4) years after the date of recordation of the Plat.
3. The restriction imposed by Paragraph 2 shall not apply to transfers by devise,
descent or operation of law; to transfers securing a purchase money and/or construction loan,
including bona fide refinancing; or to transfers in which a lending institution requires in writing
that the spouse of a member of the immediate family be a co -grantee or co-owner of a Created Lot.
4. If either of the Created Lots is conveyed back to Declarants within the four (4) year
retention period described in Paragraph 2, it shall be recombined with the parent lot within six (6)
months after such conveyance, and no building permit may be issued for the lots until they are
recombined.

Family subdivision. The term "family subdivision" means the single division of property for the purpose
of sale or gift to a member of the immediate family of the owner of the property.
Member of the immediate family. The term "member of the immediate family" means the natural or le-
gally defined off -spring, grandchild, grandparent, or parent of the owner of property.
