RE: SDP-2022-022 A Frame Site Plan Exception
Mr. and Mrs. House:
Your application for an exception to the requirements of Chapter 18, Section 32 of the Code of
Albemarle has been reviewed in accordance with Chapter 18, Section 32.3.5 of the Code of Albemarle.
The Agent for the Board of Supervisors hereby approves the requested exception.
Specifically, this exception is to the providing of certain details in site plan, reference Chapter 18, Section
32.3.59(a) of the Code of Albemarle. The Agent finds that requiring all of the details of a site plan as
contained in Chapter 18, Sections 32.5 and 32.6 of the Code of Albemarle would result in a substantial
injustice. The property has limited critical resources and the proposed dwelling does not impact any of
those resources. The property has existing infrastructure, specifically an adequate entrance and
accessway, to serve the proposed dwelling. Addition of a dwelling does not result in overcrowding of
the land. Requiring a site plan meeting all of the requirements of the ordinance would not serve to
protect the public interest to a greater extent than granting the exception. Requiring a site plan
meeting all of the requirements of the ordinance would require the County to expend additional
resources to review the site plan without resulting in an improved outcome.
Copies of the approved plan are attached for your records. Please note that a building permit is
required prior to the start of construction or earth disturbing activities.
This approval shall be valid for a period of five (5) years from the date of this letter as provided for by
Chapter 18, Section 32.4.3.8 of the Code of Albemarle.
