Perkins, Sr. & Connie PerkinE 6/21/2018 Dear Ms. Saternye; In response to your recent memo: 1. [14-212 & 14-212(B)] Family division; conditions or approval. Per 14-212 (A): " No lot may be created by family subdivision unless it has been owned by the current owner or a member of his or her immediate family for at least four (4) consecutive years immediately preceding the date the family subdivision plat is submitted". The lot was previously owned by Mr. Perkins father & mother (James L. Perkins, Jr. & Dora Lee Perkins) as outlined in the transfer history attached to the GIS-Web Navigation site. 2. [14-212(B)] Family subdivisions; conditions of approval. Mr. Perkins is having his attorney draft the deed for the 4 year restrictive covenant to be placed on the lot created by the family subdivision for your review. 3. [14-212 (A)] Family division; conditions or approval. The previous owner's relationship to the current owners was parents to son and wife. 4. [14-212 (C)] is worded: The entrance of the principal means of access for each lot onto any public street shall comply with Virginia Department of Transportation standards and be approved by the Virginia Department of Transportation. VDOT's letter dated May 24, 2oi8 satisfies that requirement. 5. [14-106 & 14-412] Private Street; Standards for Private Street only. The plat has been changed to indicate a "New Private Street" rather than a private access easement. Also, the easement holder(s) are identified on the plat in Note 11 as Michael W. Perkins, Sr. & Connie Perkins and Michael W. Perkins, Jr. 6. [14-303 (N)] Statement pertaining to private streets. Note 11 has been revised to say "proposed private street". 7. [14-410, 14-412 & 14-235(A)] Standards for all streets and alleys; Standards for private street only,- Effect of approval of private street. a & b) Mr. Perkins is having his attorney draft the private road maintenance agreement for review. c) The private street easement is NOT meant to serve both properties when it enters Family Lot D. There is a t' offset so that it does not touch the residue so that the existing house & shed setbacks conform to code. This was done for previous submittals (TM 47-57A & TM 105-21E) approved by Albemarle. 8. [14-302 (B)(10)] Stream Buffers. The stream buffers were inspected and modified by Mr. Pohl on 5/4/2o18. Ms. Saternye, I thought I sent you an email regarding this on May 7. Albemarle County's interpretation is included on this plat. Please refer to Note 6 on the certified plat. 9. [14-302 (A)] Building Sites on proposed lots. Since the WPO buffer shown in the County's GIS no longer bisects the proposed family lot based on Albemarle County's interpretation, a 30,000 s.f. building site (173.3' x 173.2' ) easily fits. I've forwarded the modified plat so this should be evident by the boundary measurements adjoining the free space on the lot. Please refer to Note 7 on the certified plat. Chambers Land Surveying 10. [14-302 (B)(8)] Yards. Note 5 has been revised on the plat to say "proposed private street" and specify the appropriate setbacks. 11. [14-302 (A)(7)]. Existing and departing lot lines. The departing lot line that divides Albemarle County parcels TMP 9516B and TMP 94-28A is 1113.13' distant from the NE corner of TMP 95 -16A per the plat in DB 1265-56o. TMP 95 -16A and TMP 94-27A only have 1000.94' along the total rear line. Albemarle's GIS is inaccurate in that the departing lot line is actually west of the rear corner of TMP 94-27A (and off the page). 12. [14-302 (A)(15)] Identification of all owners and certain interest holders. "Connie N. Perkins" has been written in the owner's consent panel. 13. [14-302(B)(1)] General Information. The date of the last revision is included on the plat. 14. [Other Reviewers Comments]: In answer to comments from David James — 1) The stream buffers were inspected and modified by Mr. Pohl on 5/4/2o18. Albemarle County's interpretation is included on this plat. 2) The plat has been changed to indicate a "New Private Street" rather than a private access easement. Proposed road alignment is shown within its' 2o' easement. 3) Please refer to Note a on the certified plat. VDOT and the County of Albemarle are excluded from main- tenance. In answer to the comment from Elise Kiewra— It is not anticipated that 3 or more addressable structures will access the new private street. The concern is so noted.
