To Whom it May Concern:
In response to your request for a Letter of Zoning Compliance for the above -referenced
Property, please be advised of the following:
• The Property is zoned R-15, Residential. The permitted uses of the Property are provided in
Section 18 of Chapter 18 of the Albemarle County Code ("Zoning Ordinance"). The
Property is subject to the Airport Impact and Steep Slopes Overlay Districts described in
Section 30 of the Zoning Ordinance. Multi -family apartments are permitted by right in this
zoning district.
• The parcels abutting the Property are zoned R-15, Residential, PUD, Planned Unit
Development, PDSC ,Planned Development Shopping Center, R-1, Residential, and NMD,
Neighborhood Model District.
• Our records indicate Parcel 129D1 contains 1.732 acres and has 26 dwelling units (15
du/ac), Parcel 129D2 contains 0.822 acres and has 6 dwelling units (7 du/ac) and Parcel
129D3 contains 1.03 acres and has 15 dwelling units (14 du/ac). Together the Property
contains 47 dwelling units on 3.58 acres (13 du/ac).
• The Property meets all access and parking requirements required by the Albemarle County
zoning ordinance and complies with the current zoning ordinance of Albemarle County,
including all provisions regulating setback, density, and height.
• The Property is not a planned unit development and the current use of the Property as part
of a multi -unit apartment facility is permitted under the R-15 zoning without the necessity of
any rezoning, special exception, special use permit or variance.
• The Planning Commission originally approved SDP-340 Squire Hill Apartment Site Plan on
September 25, 1972. The plan was titled Phase One, Buildings 1 through 28. That plan
included Phase Two, dated November 10, 1972, showing a total of 516 units in 53 buildings
served by 900 parking spaces on 32.18 acres, an overall density of 16.03 units per acre.
The parcels that are the subject of this letter contain a total of 47 units on 3.58 acres, a
density of 13 units per acre.
• SDP 78-10 Squire Hill Phase II Site Plan Amendment was approved by the Board of
Supervisors on August 7, 1978. The plan, revised on May 22, 1978, showed 516 units in 53
buildings served by 900 parking spaces. The plan was divided into two stages. Stage 1

consisted of Buildings 1 through 28. Stage 2 proposed Buildings 29 through 53. The plan,
revised on May 22, 1978, showed 516 units in 53 buildings served by 900 parking spaces.

proposed Buildings 29 through 53. The plan was revised again on November 2, 2009; this
reconfigured the pool and clubhouses. The plan was revised again on March 8, 2010, which
changed some lighting around the entire site.
• The entire Squire Hill project was developed at a density of 16.03 units per acre in
conformance with R-3 zoning regulations in effect at the time of approval. Those regulations
permitted up to 20 units per acre. The current R-15 zoning limits density to 15 units per
acre. Therefore, the density of this section of Squire Hill is legally conforming.
• The current Zoning Ordinance requires a total of 950 parking spaces based on 1.5 spaces
for each 1-bedroom unit and two spaces for each 2 & 3-bedroom unit. The parking is legally
nonconforming because the development was approved with 900 parking spaces.
• The Property is recognized as one or more parcels of land and may be conveyed, leased, or
mortgaged as separate parcels. The Property complies with the subdivision ordinance of
Albemarle County. The Property is not subject to any other conditions or special limitations
imposed by the County of Albemarle in connection with any subdivision approval of the
Property.
• To the best of my knowledge, the Property is currently in compliance with all applicable
requirements of the Zoning Ordinance. A review of our files found (i) no violations or
alleged violations or regulations applicable to the Property, whether pending,
contemplated, or having already occurred, (ii) no fees due or pending with respect to
any matter before the County Zoning Office; and (iii) no pending application for
rezoning of the Property or for a special or conditional use permit or variance in
connection with the Property. Further, no proceeding to challenge the zoning or other
governmental approval or use of the Property is pending or overtly threatened to the best of
my knowledge.
• If the Property contained physical development approved with a site plan, then in the event
of casualty, the Property may be rebuilt substantially in the same form upon satisfaction of
all required building permits and site plans, as applicable.
• Copies of relevant records may be obtained via the noted links or the Community
Development Department Records Public Access link below. If unable to find the records, a
request through the department's Records Manager, Paul Bjornsen, at
pbiornsen(Walbemarle.oro may be made. It will take longer to fulfill if the request is not
based in Virginia.
