Written Description of the Proposal:
Tax Map 61W Section 3 Parcel 14 is a 1.15 acre property located on Commonwealth Drive approximately 500 feet
south of its intersection with Peyton Drive. The property is zoned R15 and the Applicant, Moores Creek Land LLC,
would like to provide an office use on the site in accordance with Section 18.2.2.11 of the County Zoning Ordinance.
The comprehensive plan designation for the property (Places 29 Master Plan) is Urban Density Residential. The site is
currently vacant.
The site is currently approved for a multi-family residential use (SDP201000004) and a special use permit
(SP201300006) has expired for an office use on the site. The Owner/Applicant is requesting a new special use permit
for an office use that is consistent with the layout for the approved residential use.
• Public Need or Benefit: This location provides a convenient location for a professional office adjacent to a
population center and a retail center.
• Consistent with Adjacent Lots: Adjacent property is zoned R-10 and PRD. The R-10 zoning district is buffered
by open space and the PRD district is buffered with a parking lot.
• Consistency with Character of the Zoning District: The office use and multi-family use are consistent in size,
scale, and intensity of development.
• The Use will be in Harmony with the following:
o The purpose and intent of the Zoning Ordinance — Office uses are permitted by Special Use and with a
few modifications, multi-family residential and office uses can accommodate similar building spaces.
o The uses permitted by right in the zoning district — The adjacent uses are multi-family residential and
will not be affected by an office use on the site.
o The regulations provided in Section 5 of the Zoning Ordinance as applicable —There are no applicable
supplemental regulations associated with this special use request.
o Public health, safety, and general welfare — there are no public health, safety, and welfare
considerations with the use.
• Consistency with Comprehensive Plan: The proposed use is mentioned as appropriate in urban density
designations.
• Impact on Public Utilities and Infrastructure: Utilities and infrastructure are available to the site. There are no
detrimental impacts on public utilities or infrastructure.
• Impacts on Environmental Features: There is a regional stormwater facility located on site and critical slopes
disturbances have been approved with SDP201000004. No impacts on environmental features are anticipated
with this application.
A professional office use would be consistent with the Comprehensive Plan designation for the property and would be
consistent with other regional service uses located in the Commonwealth Drive location.
