Hey Lea,
Thanks for this information. I've discussed this with Brad and we'd like to request
deferral of
AP2021-013 until the BZA's May meeting. Can you let us know if the BZA can
accommodate
this on their schedule and if so, could you let us know if you need anything more
formal from
Brad to process the deferral request? Thanks again.
Best,
Kelsey

Thanks for sharing,
How does this impact our particular situation?
I thought our issue was around the disallowance of the LLC to have a short-term
rental permit.

Ms. Schlein and Mr. Bradford,
As we prepare for the upcoming appeal hearing, postponed from our prior Board of
Zoning Appeals
meeting, I wanted to reach out to update you on some proposed changes to the
Albemarle County
Zoning Ordinance's homestay regulations, to make sure you were aware of the current
situation.
Zoning Text Amendment 2021-04, Homestay Updates, is currently scheduled for a public
hearing
before the Board on April 6th. Among other changes, one proposed change would be tc
make rural
area parcels of greater than 5 acres eligible to apply for a special exception to
permit a resident
manager to reside on a property in lieu of an owner residing on a property. This
would still be subject
to approval by the Board of Supervisors, who would consider each case on its own
merits, but this
does open up eligibility to request the special exception where none existed before.
This Zoning Text Amendment was recommended for approval by the Planning Commission
on
February 1st. The details of that meeting, including the Action Memo, Minutes,
Recording, and
Agenda, which includes the staff report for the item, can be found here:
