Each public street and travelway within a development shall be designed and constructed to the standards of the Virginia Department of Transportation. Each private street and travelway within a development shall be designed and constructed to the standards for private streets in chapter 14 . b. Geometric design . The agent may vary street geometric design standards as provided under section 32.3.5 for public local, collector and minor loop streets, provided that: 1. Approval of the proposed variation is obtained from the Virginia Department of Transportation where applicable; 2. Off-street parking spaces are provided to compensate for the loss of on-street parking due to varying the geometric design standards; and 3. The developer shall be responsible for placing "no parking" signs on all travel lanes, driveways or streets to prohibit parking on the streets. Where turnarounds are used, if the right-of-way radius is 50 feet and the paved radius is 40 feet, the developer shall install "no parking" signs for the complete circle where those signs are required by the agent. If the right-of-way radius is increased to 60 feet and the paved radius is increased to 50 feet, parking on the turnaround may be permitted. c. Turnarounds . All turnarounds shall have a turning radius required by the standards of the Virginia Department of Transportation. In the case of any private street, the agent may require that at least one sign of a type approved by the county engineer be posted giving notice that the street is not a through street. d. Coordination . All streets within a development shall be coordinated as to location, width, grades and drainage with other streets, as follows: (i) by coordinating with existing or planned streets within the general area of the development, including but not limited to existing or future adjacent subdivisions or developments, or subdivisions or developments contiguous to adjacent subdivisions or developments; and (ii) by continuing the streets to planned, existing, or platted streets into adjoining areas by dedication or reservation of right of way adequate to accommodate continuation of the streets. e. Extension . All streets within a development shall be extended and constructed to the abutting property lines to provide vehicular and pedestrian interconnections to future development on adjoining lands, terminating within the development with a temporary turnaround. The arrangement of the streets shall provide adequate access to 1 adjoining lands within the development where necessary to provide for the orderly development of the county including, but not limited to, reserving temporary construction easements of sufficient area to accommodate the future completion of the street when the adjoining lands are developed. f. Interconnectivity of bicycle ways . The agent may require that any bicycle way connect to existing bicycle ways on abutting parcels. Since my plan was not phased there could be something in the language that you need to specifically understand that I didn't need to dig into. I know looking at the wording of the ordinance and/or comp plan will likely be very important in finding the answer on how you should move forward. Dear Mr. Nelson, I am writing on behalf of Dunlora Farm LLC to express a concern about the proposed Belvedere development referenced in the subject line. My siblings and I are owners of the neighboring Dunlora Farm (Parcel 06200-00-00-016A0), a historic property that has been in our family for 300 years. We are concerned that Belvedere's planned Phase 5 will block access to our property via the northwest (along Parcel 16D). Historically, we have used this access as an alternative to the "main" access via Dunlora Farm Road, a one-lane gravel road that runs through a flood plain and cannot accommodate emergency vehicles. When Belvedere submitted its initial site plan in summer 2018, my sisters and I communicated our concerns to Paty Saternye at the July 2018 Site Review and via correspondence afterward.We believe Belvedere's latest submission does not address these concerns and puts our property at risk. As discussed,this plan is significantly different and therefore can not be submitted as a "resubmission" of SDP2018-41. It needs a new initial site plan submission with a new project number. I have one thing to change from what we chatted about however. If the applicant chooses to withdraw the old project SDP2018-41 then the County would not have to deny it. Under the circumstances of you making a new submission for the initial site,that is different than the previous submission, it make sense that you would also choose to withdraw the previous initial site plan from review. I wanted to touch base in reference to SDP2018-41 Belvedere Phase 5 initial site plan. That project was put on"definite deferral"on 7/16/18. The deferral was to allow you time to address the first 5 comments in the draft comments letter—the comments specified as having to be addressed prior to initial site plan approval. Definite deferrals are supposed to be for a maximum of 6 months. It has now been over a year. So, I wanted to reach out to you about it. I also remember you having an exhibit for the Belvedere Phase 5 area during one of our Belvedere Team meetings that (to my recollection) looked very different than the plan shown in SDP2018-41. Question:Were you planning to resubmit Belvedere Phase 5 under SDP2018-41,or because of the changes (and being beyond the 6 month deferral period)were you planning to do a new submission under a different project number for Phase 5? Please keep in mind that significant changes (as defined by the County staff) necessitate a brand new submission. If you are ready to resubmit SDP2018-41,addressing those 5 comments (see attached),this needs to be done in the next week. Because it has been over the 6 months officially the initial plan should be denied. 6 However, I've been given permission to allow you one week to resubmit. In reference to the "2' connection road" comment I wanted to give you a heads up on the following. As stated in my comment#2 on July 11, 2018 a connection to TMP62-16A will be required by planning. As stated in Shawn's Fire Rescue comment on July 1, 2018 "Developments of one-or two-family dwellings where the number of dwelling units exceeds 30 shall be provided with two separate and approved fire apparatus access roads." I had reached out to Shawn after the comments were distributed to see if the connection to TMP62-16A that Planning is requiring would also meet the Fire Rescue requirements. I was concerned that the existing road connection through TMP62-16A, and to Park Street, goes through the Rivanna River flood plain. His response was the following: Good evening-just a quick glance over this 1 don't feel the secondary emergence access meets the intent of the code being through a flood plain with known problems. Holkam Drive is fresh in evervvone's mind with the.f ooding as an example. 1 also noticed their cul-de-sac doesn't meet the 45'minimum either. When he says"the secondary emergency access" he is referring to the one that Planning is requiring connecting to TMP62-16A. So, I wanted to give you a heads up that you need to work directly with Shawn and Fire Rescue to determine a 2' connection that will meet their requirements. So, it is important to note that it looks like you will need both a connection to TMP62-16A and another one that will meet Fire Rescue requirements. Since you were already talking about connecting to Belvedere Block 10 you could discuss with Shawn M.whether that connection would suffice for the Fire Rescue requirement, and if so where it would need to be located. If you read the highlighted portion of proffer 4.4, and look at the 3 items I highlighted in exhibit 2C, I think you will see that the proffer shows the 50' ROW ending at the edge of the Belvedere NMD property. That is the property line between TMP61-160 and TMP 62-16D. So it is my understanding from this that the proffer is already being met by the bringing the road to the edge of their property, which they have already been showing on all previously and currently submitted plans and plats. So, it my interpretation that anything from the edge of TMP 61-160, and going through TMP 62-16D, does not appear to be the responsibility of the Belvedere development. As mentioned, although referred to as "Belvedere Phase 5" you can see on the graphic attached that TMP 62-16D was not part of the Belvedere development planned with the Zoning Map Amendment ZMA2004-7. I will research it. However,there are two things to consider: 1 1. That quote you provided use. word "assumption" which to me, a noru-iawyer, means they didn't have proof. 2. With that being said, as a requirement of the Belvedere ZMA I expect the proffer you mention will only apply to them adding public road stub outs to the edge of the Belvedere property (TMP 61-160), not through an adjoining property (TMP 62-16D) which they probably had no legal right to encumber. Although they are calling this recent submission "Belvedere Phase 5"TMP 62-16D is not part of the Belvedere ZMA Neighborhood Model that was created when the proffer was put in place. I have bolded the portion relevant to our parcel 61-16A. A 2013 property appraisal of parcel 62-16D by Pape &Co. identified the following based on the then-current development plan: "This appraisal is based on the following extraordinary assumptions: 1. The the owners of the subject property have the legal right to build a public road at their own expense that would connect with the Belvedere subdivision's internal public roads. Belvedere's rezoning Proffer 4.4 provides that Belvedere's owners will dedicate, upon demand by the County, a 50-foot right-of-way to Dunlora Farm. The Belvedere General Development Plan and the recent plans for Belvedere Phase II show this right of way going to the subject property. The Subject is a portion of the original Dunlora Farm...While the proffer's language says that the right-of-way will be granted upon the County's demand, I assume that the Subject's owners effectively have the right to demand this public right-of-way. I assume that the County would require an internal public road in a subdivision of the subject property to extend to the Subject's 2 - southeastern boundary, and that tilc adjacent property,Tax Map 61-16A,wouuu Have the right to use the public road across the subject property for access...." I am concerned that the development may permanently block the right-of-way that belongs to the owners of the adjacent property(parcel 62-16A). I am one of those owners and represent the group. Currently the dirt road leading southeast from Belvedere Drive through parcel 62-16D to parcel 62-16A is overgrown, preventing vehicles from passing through. Our right-of-way to our family property is blocked by this overgrowth.This is the sole access to our property during flooding of the flood plain south of Dunlora Drive.The blockage prevents tenant 4 and emergency vehicle access. RecE our tenants were trapped at the properly 'or three days due to flooding, and emergency crews had difficulty reaching additional flood victims who were being washed down the river. I have already submitted an issue (complaint) to the County regarding the (temporary) blockage of the right-of-way. I believe the responsibility of keeping the road clear belongs to the Belvedere developers. However, my greater concern is that new construction in Phase 5 may obstruct and/or remove the dirt road entirely,which would eliminate the only viable (non-flood-plain)access to our property. I would greatly appreciate it if you could raise this issue at the SRC and let me know the outcome of the discussion.
