Correct. The easement is not something required by the ordinance and we aren't approving a private street. They could
just as easily get the BLA approved and then record a separate plat showing the easement. We would not even see the
plat showing the easement. It is the actual disturbance that the WPO regulates not the placement of the easement. If
this were a private street we would require road plans and that is where we could invoke the WPO requirements and
either deny the project or require mitigation. Hope this helps.

Some background:
I've talked with Bill about this Plat a few weeks back. It is my understanding that there is nothing in the Ordinance that
prevents us from approving this. The Plat is simply a Boundary Line Adjustment. They are proposing "right of way" but
for our purposes it is not a private street or anything like that. If they were to build a private street in the future they
would need to submit the appropriate plat and meet all applicable regulations.
I'm attaching a plat from'77 that shows some existing right of way that it appears they are connecting to. That right of
way appears to cross several properties and connect to the public road through TMP 85-13A. Bill's thoughts on this were
that they may just be proposing this additional right of way for potential future options.

Correct. The easement is not something required by the ordinance and we aren't approving a private street. They could
just as easily get the BLA approved and then record a separate plat showing the easement. We would not even see the
plat showing the easement. It is the actual disturbance that the WPO regulates not the placement of the easement. If
this were a private street we would require road plans and that is where we could invoke the WPO requirements and
either deny the project or require mitigation. Hope this helps.

Some background:
I've talked with Bill about this Plat a few weeks back. It is my understanding that there is nothing in the Ordinance that
prevents us from approving this. The Plat is simply a Boundary Line Adjustment. They are proposing "right of way" but

for our purposes it is not a private street or anything like that. If they were to build a private street in the future they
would need to submit the appropriate plat and meet all applicable regulations.
I'm attaching a plat from'77 that shows some existing right of way that it appears they are connecting to. That right of
way appears to cross several properties and connect to the public road through TMP 85-13A. Bill's thoughts on this were
that they may just be proposing this additional right of way for potential future options.

Good Afternoon,
This email is to serve as the transmittal of application SUB202200081 Steven Rosenfield BLA. This application is a simple
BLA between TMP 85-13 and TMP 85-13E and involves adding 4 acres from lot 13 to lot 13E. However, they are also
showing additional "Right-of-way" that appears to be private right-of-way. There is an existing creek and lots of critical
slopes on the subject property, so I just wanted to send this to Engineering to see if yall had any comments or concerns.
It doesn't appear that they are proposing any new roads/driveways at this time, but they are platting that new expanded
"right-of-way."
