That is one of the options you and I discussed. So, if the answer to the question above is "yes" then that would work. However, we would need a new submission of the plat that shows the proposed easement and we would need to see the draft deed of easement (for the County Attorney to review) that states all the criteria of the easement. In order to do this it would be best to defer review until you can resubmit with the items mentioned above. Otherwise I would have to give you comments on the currently submitted plat and the review cycle would begin again once you resubmit. I've attached a checklist that the County Attorney's office uses when reviewing maintenance instruments. In whatever deed of easement you create please make sure to cover the items in this checklist. Before you submit the deed of easement to me, 1. Highlight the sections that cover the items in the checklist and put the number of the checklist item next to the highlighting. This is a requirement for submittal to the County Attorney's office. I will forward the document to them once I've received it from you and confirm the content. 2. Ensure that the deed of easement specifies the plantings "will meet or exceed" screening requirements, and specifies the screening requirements, in the County CODE. Lot 18 (in the attached plat you sent me earlier today) is a "corner lot", not a "double frontage lot". Those are allowed, but they usually have "front setbacks" on both road frontages. When they combined Lot 18 with Lot 19 it did not change its status. The combined Lot 18 & 19 was still a "corner lot". No additional/different road frontage was added since Lot 19 was already on the same road as Lot 18. Please let me know if you have any further questions. However, we would need a new submission of the plat that shows the proposed easement and we would need to see the draft deed of easement (for the County Attorney to review) that states all the criteria of the easement. In order to do this it would be best to defer review until you can resubmit with the items mentioned above. Otherwise I would have to give you comments on the currently submitted plat and the review cycle would begin again once you resubmit. I've attached a checklist that the County Attorney's office uses when reviewing maintenance instruments. In whatever deed of easement you create please make sure to cover the items in this checklist. Before you submit the deed of easement to me, 1. Highlight the sections that cover the items in the checklist and put the number of the checklist item next to the highlighting. When they combined Lot 18 with Lot 19 it did not change its status. The combined Lot 18 & 19 was still a "corner lot". Lot 18 (in the attached plat you sent me earlier today) is a "corner lot", not a "double frontage lot". Those are allowed, but they usually have "front setbacks" on both road frontages. When they combined Lot 18 with Lot 19 it did not change its status. The combined Lot 18 & 19 was still a "corner lot". No additional/different road frontage was added since Lot 19 was already on the same road as Lot 18. Please let me know if you have any further questions.
