Rick,
Would the easement give the HOA rights to the landscaping easement area, if maintenance is not done in a
timely fashion by the owners?
That is one of the options you and I discussed. So, if the answer to the question above is "yes" then that
would work.
However, we would need a new submission of the plat that shows the proposed easement and we would
need to see the draft deed of easement (for the County Attorney to review) that states all the criteria of the
easement.
In order to do this it would be best to defer review until you can resubmit with the items mentioned
above. Otherwise I would have to give you comments on the currently submitted plat and the review cycle
would begin again once you resubmit.
I've attached a checklist that the County Attorney's office uses when reviewing maintenance instruments. In
whatever deed of easement you create please make sure to cover the items in this checklist.
Before you submit the deed of easement to me,
1. Highlight the sections that cover the items in the checklist and put the number of the checklist item
next to the highlighting. This is a requirement for submittal to the County Attorney's office. I will
forward the document to them once I've received it from you and confirm the content.
2. Ensure that the deed of easement specifies the plantings "will meet or exceed" screening
requirements, and specifies the screening requirements, in the County CODE.

Mr. Carter,
The plat you gave me, of lots 18 & 19, is not the same circumstance as the SUB201600166 Hacking boundary
line adjustment (BLA).
Lot 18 (in the attached plat you sent me earlier today) is a "corner lot", not a "double frontage lot". Those
are allowed, but they usually have "front setbacks" on both road frontages.
When they combined Lot 18 with Lot 19 it did not change its status. The combined Lot 18 & 19 was still a
"corner lot". No additional/different road frontage was added since Lot 19 was already on the same road as
Lot 18.

No additional/different road frontage was added since Lot 19 was already on the same road as
Lot 18.

Thanks O.
Yes, I have been looking at that, but maybe I need to go to the definitions to see if they specify "definite"
versus "indefinite" deferrals.
A. does mention "for a specified period", which could be assumed to be the "definite deferral" but I hate
to assume.

Subject: Deferral question - answered by ordinance (see below, as it slightly differs from what we discussed yesterday)
See. 14-229 Deferral of review of final plat; when application deemed withdrawn.
The review of, and action on, a final plat may be deferred, and an application for a final plat may be deemed
withdrawn, as follows:
A. Request to defer by subdivider. A subdivider may request that review or action on its application for a final
plat be deferred for a specified period up to six (6) months. If during the deferral period the subdivider does not
request the agent to take action on the final plat as provided in section 14- 230 within six (6) months after the
date the deferral was requested, the application shall be deemed to have been voluntarily withdrawn.
B. Failure to submit revised plat. If a subdivider fails to submit a revised final plat to address all of the
requirements within six (6) months after the date of the letter from the agent as provided in section 14-228, the
application shall be deemed to have been voluntarily withdrawn by the subdivider.
C. Extension of deferral period or period to submit revised plat. Before the deferral period in subsection (A)
expires, the subdivider may request that the agent extend the period before the application is deemed to have
25
been voluntarily withdrawn. The request must be received by the agent before the deferral period expires. The
agent may grant one extension for a period determined to be reasonable, taking into consideration the size or
nature of the proposed subdivision, the complexity of the review, and the laws in effect at the time the extension
request is made. (Ord. 13-14(1), 12-4-13, effective 1-1-14)

No additional/different road frontage was added since Lot 19 was already on the same road as
Lot 18.
Please let me know if you have any further questions.

I do not wish to withdraw the application. I propose a 20' landscape easement along Worthington Drive, the
easement to be attached to the lot in perpetuity and be maintained by the lot owner. Will this work?

I just wanted to touch base to see if your clients had decided on how to move forward.
Do they know which of the options that we discussed they wish to move forward with and/or do they wish
to withdraw the application for the boundary line adjustment (SUB201600166 Hacking BLA)?

Mr. Carter,
The plat you gave me, of lots 18 & 19, is not the same circumstance as the SUB201600166 Hacking boundary
line adjustment (BLA).
No additional/different road frontage was added since Lot 19 was already on the same road as
Lot 18.
Please let me know if you have any further questions.

Subject: SUB201600166 Hecking - Lot 3A - BLA Double Frontage
Mr. Graff,
I left a voicemail for you, but thought I might be able to reach you quicker by email.
The County has received your submission for SUB201600166 Hecking - Lot 3A boundary line adjustment (BLA)
Because this BLA would create a double frontage lot, and double frontage lots are restricted, I wanted to
discuss with you some of the options for moving forward and make sure that the owners are still interested in
moving forward with the necessary steps and cost that would be associated with those steps.
Please call me to discuss the issue.
Thank you,
