The County of Albemarle Planning Division will recommend approval of the plat referenced above once the following
comments, and those provided by other Site Review Committee, SRC, members, have been satisfactorily addressed. The
following comments are those that have been identified at this time. Additional comments or conditions may be added or
eliminated based on further review. [Each comment is preceded by the applicable reference to the Albemarle County
Code.]
1. [14-302(A)(2)] Vicinity map. Provide a map at a scale of one (1) inch equal to two thousand (2,000) feet showing the
property and its relationship with adjoining land and streets, its relationship with landmarks in the area and, in
detail adequate to describe the location of the property without field review.
2. [14-302(A)(3), 14-302(A)(4)] Rights -of -way. Previous plats for TMP 126-33B, particularly DB 3215 PG 253 and DB
3226 PG 498, reference an easement or right of way over a private road. Show and label (with deed book and
page) this easement or right of way on the plat map.
3. [14-302(A)(7)] Departing lot lines. It is challenging to tell the departing lot lines are dashed and different from other
linework presented on the plat, save for a lighter color. Please revise the dashes such that there is clear separation
between dots/dashes.
4. [14-302(A)(9)] Building site. Provide the following note on the plat: "Parcel [letter or number] and the residue of Tax
Map/Parcel [numbers] each contain a building site that complies with section 4.2.1 of the Albemarle County
Zoning Ordinance."
5. [14-302(A)(10)] Development rights. Provide the number of lots, as assigned by the subdivider, into which each
proposed lot may be further divided by right pursuant to section 18-10.3.1, if applicable. The plat shall also contain
the following note or something similar in nature: "Parcel [letter or number] is assigned [number] development
rights and may/may not be further divided and when further divided these rights shall not comprise more than
[number] acres. The residue of Tax Map/Parcel [numbers] is retaining [number] development rights and when
further divided it shall not consist of more than [number] acres." Staff suggests looking at DB 1872 PG 477 for
TMP 126-33J1.
6. [14-302(A)(15)] Owner information. Provide names and addresses for each owner of record and holders of any
easements affecting the property. Also, County GIS records indicate that TMP 126-33J1 is currently owned by
John and Judith Regan. The property was sold on 5/10/2021.
7. [14-302(B)(5)] Zoning. Provide the zoning classification of the property, including all applicable zoning overlay
districts.

8. [14-302(B)(7)] Water supply watershed and ag-forestal district. Provide a notation as to whether the land is within an
Albemarle County and/or City of Charlottesville water supply watershed or an agricultural -forestal district.
9. [14-302(B)(10)] Water Protection Ordinance.
a. Locate the limits of the stream buffer within the flood plain areas. Other applicants have used a patterned
fill symbolization to denote areas that are subject to both the floodplain and stream buffers.
b. Provide the following note on the plat: "The stream buffer(s) shown hereon shall be managed in
accordance with the Albemarle County Water Protection Ordinance."
10. [14-303(A)] Statement of consent. Provide a statement on the plat that: "The platting or dedication of the following
described land [insert a correct description of the land subdivided] is with the free consent and in accordance with
the desire of the undersigned owners, proprietors and trustees, if any."
11. [14-303(C)] Exterior boundary lines.
a. Provide a corner between the two bearing and distances measurements along western boundary line of
TMP 126-33B Lot 1.
b. Provide bearing and distance for boundary line abutting Schuyler Rd of Area "A".
c. What do the hollow square boxes along the property edges signify? Please identify these symbols in the
legend or with a label.
12. [14-303(0)] Signature panels. Provide signature panels for each owner and for the agent or his designee. The
signature panel for the owner shall be located immediately below the statement required by 14-303(A).
13. [14-303(P)] Notary panels. Provide notary panels for the notary to acknowledge the signature of each owner.
14. [Comment] Reminder that revised plats must include the original date of drawing and the revision date(s) of each
subsequent version of the plat.

address all of the requirements within six (6) months after the date of this letter, the application shall be deemed to have
been voluntarily withdrawn by the applicant
