Subject: SUB202200096 Ashcroft Phase III Section 1- Final Plat
The County of Albemarle Planning Division will recommend approval of the plat referenced above once the following
comments, and those provided by other Site Review Committee, SRC, members, have been satisfactorily addressed. The
following comments are those that have been identified at this time. Additional comments or conditions may be added or
eliminated based on further review. [Each comment is preceded by the applicable reference to the Albemarle County
Code.]
1. [14-302(A)(3), 14-403] Roads and frontage.
a. Identify all streets serving proposed or future residential lots as "private roads' instead of "private access
roads". The County's ordinance sees accessways and roads differently. In order to meet lot frontage
requirements, each lot within a subdivision must have frontage on an existing or proposed public or private
road.
b. Please be aware, per a letter from Mr. William Fritz (Planning) to Mr. Paul Beyers on December 6, 2010,
Meadow Crossing Trail (now identified as Shadwell Creek Drive) to its intersection with Cedarcroft Way
(now identified as Fry Bearing Trail) will have to meet the VDOT standards. The other roads will not have
to meet VDOT standards. See a copy of the letter attached.
2. [ZMA1980-00003] Conditions.
a. Condition (A)2 Permitted lots. Earlier subdivisions of Ashcroft included a tabular accounting of the number
of lots, lot acreage, open space acreage, percent open space, and DB/PG for all phases/sections of the
Ashcroft development. See DB 5617 PG 625 (Instrument # 202100016700). This tabulation chart should
be included and updated for this phase.
b. Condition (A)3 Grading. Provide the following note on the plat: In accordance with ZMA1980-03 Condition
(A)3, no grading or construction on slopes of 25% or greater is permitted except as necessary for road
construction as approved by the County Engineer.
c. Condition (A)4 Homeowner Association agreement. Provide a copy of the Homeowners' Association
agreements for review by the County Attorney's Office (CAO). These agreements must address associated
clubhouse facilities and be approved by the CAO prior to final plat approval.
d. Condition (A)5 Club house/recreation. Be advised, this condition stipulates that either the Hansen House or
the Lego House has to be designated for clubhouse facilities prior to any Phase 2 approvals. Furthermore,
the condition states that the clubhouse renovation, playground, picnic areas, and tennis courts shall be
provided prior to any Phase 3 approvals and the swimming pool must be provided prior to any Phase 4
approvals. Please provide a status on the designation of the clubhouse and the delivery of the
aforementioned facilities. Please note, this area was considered to be part of the original Phase 4 area, as
indicated on the approved Phasing Plan attached to ZMA1979-00006.
e. Condition (A)6 Clearing.

i. This condition stipulates that Planning Commission approval is needed prior to any clearing of
areas on individual lots. This includes tree clearing. Staff cannot find evidence that this proffer was
amended. Therefore, only clearing activities associated with the construction of roads are
permitted. Submit a plan/exhibit that shows the ultimate clearing limits in comparison with critical
slope areas and proposed locations for buildings and septic systems so it can be reviewed by the
Planning Commission accordingly.
ii. Provide the following note on the plat: In accordance with ZMA1980-03 Condition (A)6, Planning
Commission approval of areas to be cleared on individual lots is required prior to any clearing
activities.
f. Condition (B)3 Septic systems. This condition stipulates that Virginia Department of Health (VDH) approval
of two septic field locations on each lot is needed. Please note, the condition specifies that septic tanks
and/or drainfields cannot be located on any slopes of 25% or greater. Any lot not having adequate septic
system site shall be combined with a building lot and/or added to the common open space. Please submit
soil reports for each proposed residential lot for review by VDH.
3. [ZMA1979-00006] Application plan: nature trails. While the rezonings from 1990 and 1980 replaced conditions
associated with the original 1979 rezoning, the application plan that was originally approved in 1979 was not
replaced. In fact, it was referenced in the 1980 conditions (Condition (A)(2)). As such, nature tails must be provided
as shown on the application plan approved with the 1979 rezoning. See plan attached.
4. [14-302(A)(4-5), 14-302(A)(13)] Public/private easements and proposed facilities.
a. Provide corner locations between distance and bearing measurements for proposed private roads.
b. Provide corner locations between distance and bearing measurements for proposed drainage easements.
c. Label drainage easements as either public or private.
5. [14-303(E)] Dimensions.
a. Provide the required curvilinear dimensions, in accordance with 14-303(E) for segments shown along the
proposed travelway. This table appears to be missing from the plat.
b. Provide bearings for the distances located between L19 and L21 of the proposed drainage easement.
c. There may also be a missing bearing and distance to east of segment L20
d. Order the Easement Line Table data such that line segments are organized in logical sequence: L1, L2, L3,
etc.
6. [14-303(G)] Open space ownership. Provide a stand-alone note to state that all open spaces areas will be owned
and maintained by the Ashcroft Homeowners Association.
7. [14-303(N)] Statement pertaining to private improvements. The subdivision ordinance has been amended to update
the note previously required for private roads and improvements. Replace Note 10 on the Cover Sheet with the
following note: "Unless specifically denoted as public, the streets and other required improvements in this
subdivision are private in nature and will not be maintained by either the Virginia Department of Transportation or
any other public agency. The maintenance thereof is the mutual obligation of the affected lot owners. Failure to
maintain the improvements in substantially the same condition as originally approved by the County may
constitute a violation of County ordinance(s)."
8. [14-302(B)(10)] Stream buffers. Locate all stream buffer areas on the plat maps and provide the following note on
the plat: "The stream buffer(s) shown hereon shall be managed in accordance with the Albemarle County Water
Protection Ordinance."

9. [14-303(B)(8)] Yards. The approved preliminary plat (SUB200600411) for the proposed parcels notes the following
setbacks (yards): 15ft front; 15ft side, and 15ft rear. Review and revise the plat to align with the approved
preliminary plat.
10. [14-303(D)] Acreage of lots. The Cover Sheet notes the total open space acreage provided by the plat as 15.587
acres while the plat maps identify the open space acreage as 15.583 acres. Review and revise for consistency
across the plat.
11. [14-302(A)(7)] Abutting lots.
a. Update owner info for TMP 78D-14
b. Albemarle County GIS shows different lot line locations for TMP 78A-03-F and TMP78A-03-G than what
is shown on the plat map. Please review and revise as necessary.
c. Is there a reason why portions of abutting property edges are colored grey?
12. [14-302(A)(2)] Vicinity map. Bright green does not come across clearly in black and white scans. Please change the
subject property outline to a contrasting blue or black color. Also, add a north arrow to the map.
13. [14-303(S)] Control Points. Provide at least four (4) control points, evenly distributed across the property and
located at survey property corners, and shown on each sheet depicting the property. The applicant also has the
option to show the control points on a copy of the final plat, as opposed to on the plat.
14. [Comment] Reminder that revised plats must include the original date of drawing and the revision dates) of each
subsequent version of the plat.
*Note: Planning has reviewed the comment letter from VDOT. No change is needed on the plat. The Comment made
by the VDOT staff reviewer was more -so addressed to County staff rather than the applicant.

Dear Mr. Beyer,
You have asked what road standards apply to the review of the above referenced project. I have reviewed
the question and have reached the following conclusions:
The property that is the subject of SUB 2006-411 is zoned, PRD, Planned Residential Development. This
zoning was established on March 19, 1980 with the approval of ZMA 80-03. In accord with the
provisions of Chapter 18, Section 8.5.5.2(A) this subdivision may be reviewed under either the current
ordinance or the ordinance in effect at the time of the establishment of the Planned Development (in your
case this would be December 10, 1980). 1 have researched the subdivision ordinance and found that the
road standard provisions in effect on December 10, 1980 are those adopted by the Board of Supervisors
on March 29, 1978 (copy attached). For roads serving 35 or fewer lots a significant amount of flexibility
road design exists. For roads serving 36 or more lots no flexibility exists. Roads which serve 36 or more
lots must meet the VDOT standards. Therefore, it appears that Meadow Crossing Trail to its intersection
with Cedarcroft Way will have to meet the VDOT standards. The other roads will not have to meet
VDOT standards.
The scope of the Board's instruction to study an amendment to the ordinance was to study the potential
need to amend the ordinance to allow Planned Developments to continue to develop based on the road
standards in effect when the project was conceived. Your project may use the road standards that were in
effect 2 years prior to the approval of the zoning for this project. These standards were in effect even
prior to the initial zoning action for the project (ZMA 79-06). Therefore, it does not appear that any text
amendment is necessary to allow this project to develop in a manner consistent with the zoning in place
for all of Ashcroft.

The Department of Transportation, Charlottesville Residency Transportation and Land Use
Section, has reviewed the above referenced Ashcroft, Phase III , Section 1 — Final Plat, as
submitted by Roudabush, Gale & Assoc., Inc., dated April 20, 2022 and find it to be generally
acceptable.
A VDOT Land Use Permit will be required prior to any work within the right of way. The
owner/developer must contact the Charlottesville Residency land Use Section at (434) 422-9399
for information pertaining to this process.
