On February 16, 2022, the Board of Supervisors took action on your Special Exception on Tax Map Parcel Number
061WO-02-OA-00100 in the Rio District.
The Special Exception was approved by the Board's adoption of the attached Resolution.
Please be advised that although the Albemarle County Board of Supervisors took action on the project noted
above, no uses on the property may lawfully begin until all applicable approvals have been received and
conditions have been met. This includes:
• compliance with the approved SPECIAL EXCEPTION;
• approval of and compliance with a SITE PLAN; and
• approval of a ZONING COMPLIANCE CLEARANCE.

RESOLUTION TO APPROVE
SE 2021-00048 WAWA -1215 SEMINOLE TRAIL
WHEREAS, upon consideration of the Memorandum prepared in conjunction with the SE 2021-00048
Wawa - 1215 Seminole Trail application and the attachments thereto, including staffs supporting analysis,
any comments received, and all of the factors relevant to the special exception in Albemarle County Code
§§ 18-4.12.2(c), 18-4.12.17(a), and 18-33.9, the Albemarle County Board of Supervisors hereby finds that:
(1) the public health, safety or welfare would be equally or better served by the modification,
(2) the modification would not otherwise be contrary to the purpose and intent of the Zoning Ordinance;
(3) no reasonable design alternative would reduce or alleviate the need; and
(4) the increase in grade would be in the best interest of public health, safety, and welfare.
NOW, THEREFORE, BE IT RESOLVED that the Albemarle County Board of Supervisors hereby
approves the special exception request to modify the 10% maximum access aisle grade otherwise permitted
by County Code § 18-4.12.17(a), in general accord with the special exception application submitted by
Kimley Horn dated November 19, 2021.
