The following is our comment response letter addressing comments received from the County of Albemarle Planning Division dated June 24, 2022. Each comment is addressed and responded to as follows: Planning / Kevin McCollum Comment 1: [14-302(B)(5)] Revise Note 6 to include all applicable zoning information. The property is zoned Planned Residential Development and subject to ZMA202000007 and SE202000003. The property is subject to the following Overlay Districts: Airport Impact Area, Entrance Corridor, Steep Slopes — Managed, and Steep Slopes — Preserved. Response 1: Note 6 has been revised. Comment 2: [14-302(B)(1)] Include a date of revision. Response 2: A revision date has been added. Comment 3: [14-302(B)(6)] Revise all "PID" and "PIN' references and change them to "TMP" for Tax Map and Parcel number. Response 3: All "PID" and "PIN" references have been revised to "TMP". Comment 4: [14-302(B)(7)] Please include a note that the property is not within an Albemarle County and/ or City of Charlottesville water supply watershed or an agricultural - forestall district. Response 5: Signature panel has been added. Comment 6: [14-302(A)(5)] Ensure public easements are labeled as "dedicated to public use." For example, the variable width storm water management facility easement, please revise to say hereby dedicated to public use. Response 6: The label has been updated. Comment 7: [14-303(E)] Identify the private street easement holder(s) on the plat. Response 7: Private streets will be held by Seminole Trail, LLC has been added to labels. Comment 8: Revise the private street label to clarify that this is a private street with public access. Response 8: The label has been revised. Comment 9: [14-302(A)(5)] The public access easement and private street easement will require a public access deed of dedication to be recorded with the plat. Attached is an example of a deed of dedication. a. Per the Application Plan for ZMA202000007, all roadways and travelways shall be privately maintained and subject to an access easement allowing the public to utilize the roadways and travelways. Response 9: Acknowledged. The plat is currently being prepared by the owner's attorney. Comment 10: [14-303(L)] New public stormwater facility and drainage easements will require a deed of dedication to be recorded with the plat. Once all revisions to the plat have been made, staff from the Engineering Division will draft the deeds and transmit them to the applicant. When the plat is ready to be submitted to the County for signature/approval, signed hard copies of the deeds will also need to be submitted so that the County Executive and County Attorney can sign them. Please contact Engineering Division staff directly if you have further questions. Response 10:Acknowledged. Comment 11: [14-303(N)] Please include the follow statement pertaining to private improvements: "Unless specifically denoted as public, the streets and other required improvements in this subdivision are private in nature and will not be maintained by either the Virginia Department of Transportation or any other public agency. The maintenance thereof is the mutual obligation of the affected lot owners. Failure to maintain the improvements in substantially the same condition as originally approved by the County may constitute a violation of County ordinance(s)." Response 11: Note 8 has been added. w .BohlerEngineering.com Kevin McCollum BOHLER IBLA &Easement Plat 1 s Review Response July 20, 2022 Page 3 of 4 Engineering / John Anderson Comment 1: Sheet 1: Provide note to indicate steep slopes exist on TMPs (PIDs) 04600-00-00-10800 and 04600-00-00-10900, as well as steep slopes field -surveyed on 12/23/20 found to be less steep than 25 percent slope. Response 1: Note 6 has been updated. Comment 2: Sheet 2 a. Since separate deeds accompany SWIM and public drainage easements, please provide graphic separation to discriminate variable (or fixed) width storm water management facility easement/s from public drainage easements (SWIM facility pipe outfalls) as shown on system 1 and 2 plan views, sheet C- 907 (Bohler Engineering, 5/18/22; WPO2021-00058); best accomplished by: i. East SWIM facility: 1. No new or revised linework, but leader lines with labels that define a portion of SD20 (51.50'), SD21, SD22, and 6.30' (tie) as shared, common to both variable width SWIM facility easement, and public drainage easement. The public drainage easement at East SWIM facility consists of SD7-SD12, together with line segments common to both SWIM and pipe outfall. 2. Revise SD7-SD-12 labels in favor of PD7, PD8, ...PD12 to distinguish public drainage easement from storm drain easement lines (SWIM facility easement); alternative labels are needed for public drainage easement (SWIM pipe outfall). 3. Provide leader line for public drainage easement. 4. Revise sheet 1 tables, as needed. ii. West SWIM facility: 1. No new or revised linework, but provide leader line /label to identify a portion of SD5 (slightly > 20.0') as shared, common to 49.10' SWIM facility easement, and 20' public drainage easement. The public drainage easement at West SWIM facility consists of SD3, SD4, and portions of SD5 and 435.88' Lot 2 boundary (slightly >20.0'). 2. Revise SD3, SD4 labels in favor of PD3, PD4 (or similar) to distinguish public drainage easement from storm drain easement lines. Alternative label is needed for public drainage easement (SWIM pipe outfall). 3. Provide tie, SD4 to SD5. 4. Revise SWIM easement label to 49.10' storm water management facility easement (hereby dedicated), rather than variable width. 5. Provide leader line /label for public drainage easement at west SWIM facility. 6. Revise /create sheet 1 tables, as needed. b. Provide (show, label, define) SWIM facility access easement between SWIM system 2 and private access easement (plat, sheet 3), to provide corridor for future maintenance/replacement. c. Ties are correct and will not be modified. SWM facility easement areas are shown. Comment 3: Sheet 4 a. Please check PA ties (383.60', 340.61') and 34.00' PA width against 755.43' boundary length. Response 3: b. Provide alternate tie to rebar w/cap set to an boundary monument, since 91.2' tie to U.S. Rte. 29 station 2657+31.80 is a design reference not verifiable in the field (not a monument); recommend tie to monument that may lie = S27014'53"W, a boundary corner of PID: 046135-00-00-001 DO. a. PA ties are correct, the 383.60' tie is to the centerline of the waterline easement not to the PA. b. The monuments shown tied into are all field verified by Bohler. ACSA / Richard Nelson Comment 1: ACSA approval of the utility plan will be required prior to final plat approval. Response 1: Acknowledged. Comment 2: Indicate that the 20-foot water and sewer line easements are to be dedicated to ACSA. Response 2: Water and sewer line easement labels have been updated. Comment 3: Include a note that ACSA easements are to be centered on as -built locations. Response 3: Note 9 has been added. VDOT / Doug MCAVOV Jr. Comment 1: Add a note: "VDOT will only maintain within the drainage easements to the extent necessary to protect the road." Response 1: Note 10 has been added.
