We have revised our plans per most recent comments dated May 12" , 2022. Please see below for a detailed response to each of your comments. A. Stormwater Pollution Prevention Plan (SWPPP) The SWPPP content requirements can be found in County Code section 17-405. A SWPPP must contain (1) a PPP, (2) an ESCP, (3) a SWMP, and (4) any TMDL measures necessary. 1. Submit SWPPP (please use county template). Ensure (VAR10) CGP Registration Statement is complete. Include ref. to WP02022-00008 in SWPPP title. (Rev. 1) Partially addressed. As follow-up: Please include ref. to WP02022-00008 in SWPPP title. The tittle has been included on SWPP PACKET. 2. Comment addressed 3. NEW a) SWM Narrative, p. 21 SWPPP .PDF, note 5 may be incomplete —please check /revise, as needed. This note been fixed. b) Sec. 6.E.: Please list a named individual responsible for PPP prior to scheduling preconstruction. Not required for VSMP /WPO plan approval. This section has been updated with a note — client is on the verge of selecting a contractor, intends to update during precon meeting. c) Sec. 8.: Please list a named individual responsible for VESCH compliance inspections prior to scheduling preconstruction. Not required for VSMP /WPO plan approval. This section has been updated with a note — client is on the verge of selecting a contractor, intends to update during precon meeting. d) Sec. 9/Signed Certification: Provide title, signature, date (recommend TC Ewing: to match Registration Statement Operator /Permittee Information) Section 9 signed by operator (matches registration statement). e) Note: Please confirm that EB Partners LLC (Charlotte, NC) is registered w/VA State Corporation Commission. C database, and will likely not issue a VAR10 to an entity that is not listed with SCC, Active status. This has been DEQ practice. Operator (T5 Pantops LLC) has been updated, is an active entity listed with SCC. f) Sec. 2: Please include a copy of VARIOE170 (DEQ) coverage letter. Added to Section 2. g) Sec. 1, Registration Statement: i. Please revise Sea ILF. (MS4) to read `Albemarle County' ii. Recommend revised start date to 6-1-2022. iii. Revise Sec. W.B., 2nd block (ESC Plan approval date) to: 03/31/2022. iv. Sec. V. Certification: Please print nam ign /date. Registration statement revised, managed by Keane Rucker. B. Pollution Prevention Plan (PPP) — See above. The PPP content requirements can be found in County Code section 17-404. C. Stormwater Management Plan (SWMP) VSMP Regulation 9VAC25-870-108 requires the VSMP authority to approve or disapprove a SWMP. This plan is disapproved for reasons listed below. The stormwater management plan content requirements can be found in County Code section 17-403. 1. Revise Cl, plan set title sheet, to list reference to WPO2018-00088 (Pantops Corner), which provides stormwater quantity treatment for this development, Take 5 Pantops (service station), via underground detention, and quality treatment via nutrient credit purchase (2019). (Rev. 1) May persist. As follow-up: Please provide bold SWM (similar to Benchmark, Flood zone), then text reference to WPO2018-00088. Noted- See Sheet Cl 2. Revise Cl, plan set title sheet to include WPO2020-00008 in plan title. (Rev. 1) Persists /review error. Please revise plan set title sheet to include WPO2022-00008 in plan title. Also: Please revise Revision Note, lower right corner cover sheet to read: 2022.04.13 WPO2022-00008 Comments. Note has been Updated 3. C2: Revise Limits of Disturbance label to incl. Ac. (=0.50 Ac.). (Rev. 1) addressed 4. C3, C4, C5: C3 and C5 identify Str. A3 as type DI-7; C4 lists A3 as a DI-1. Please reconcile. (Rev. 1) addressed 5. (Rev. 1) addressed c. Provioe NNotes that state: (Rev. 1) Partially addressed. As follow-uo: Please review Notes against text, below. Please edit inadvertent typos (quantity control; parking lot at Holiday; area Ac. depicted in this WPO plan) and several omissions for clarity, to help limit misunderstanding. i. `Stormwater quantity control provided via VAR10E170, underground detention system beneath parking lot at Holiday Inn Express, Pantops Corner Way, Charlottesville_ VA.' Note has been checked. ii. `Stormwater quality provided via (portion of) 8.49 lb. nutrient credit purchase, 6/20/19, between Hotel Street Capital, LLC ("Seller" Rivanna River Nutrient Offset Credit Bank) and Pantops Corner, LLC ("Purchaser")/developer of site, which includes post -developed land cover type and area Ac. depicted in this WPO plan.' Note has been checked. iii. IMAGE recommended, but optional: (Rev. 1) addressed D. Erosion and Sediment Control Plan (ESCP) Virginia Code §62.1-44.15:55 requires the VESCP authority to approve or disapprove an ESCP. This plan is approved. `Next Steps' after WPO plan approval 1. Purchase Nutrient Credits (if required) a. PLEASE coordinate with the County reviewer before working with a nutrient bank. The reviewer must confirm if your project must follow the DEQ hierarchy requirements. b. Letter of availability must be provided on the WPO approved plans. c. Applicant must contact/coordinate nutrient credit purchase with Ana Kilmer, akilmer@albemarle.org d. Affidavit of Purchase must be provided to Ana Kilmer before a grading permit can be issued. 2. Post WPO Bond A. Applicant must submit a `Request to Establish a Bond' form and fee to CDD. i. Complete the form and email it to akilmer@albemarle.org, along with proof of payment (see below). a. Payment can be made either online or with a check. i. If paying online: Go to the online payment portal. a. Select WPO/VSMP as the application `type.' b. Type in the WPO number and project name in the Notes/Details section of the form. c. Type in the `payment amount' as $294.34. d. Click "Proceed to Secure Checkout" link to make payment. 1. You will receive a receipt in an email. ii. Email a copy of the receipt to akilmer@albemarle.org. b. Once the bond request and payment are received, the applicant can provide the bond estimate (completed on the County worksheet), or Engineering staff will complete the estimate. Once the estimate is approved, Ana Kilmer will contact and work with the applicant to post the bond. This is included with this submittal - we have provided the estimate. 3.Obtain DEQ Permit (if required) After nutrient credits have been purchased and the bond has been posted: c. County staff will register the project with DEQ. d. Applicantloperator listed on the Registration Statement will receive an email with instructions on how to pay the DEQ permit fee. e. Applicant must email a copy of the DEQ receipt of payment to charris@albemarle.org. f. DEQ typically will issue a permit within 2 weeks of receiving payment. Acknowledge, to be provided after plan approved 4. Request pre -construction meeting: g. a. Complete and email the Request for a Preconstruction Meeting and Grading Permit to charris@albemarle.org. h. b. Pay the fee via the online payment portal or a check at the pre -construction meeting. If paid online, email a copy of the receipt to charris@albemarle.org.
