After re -reading the deeds and discussing with others here, we agree that you are correct. I have removed the note 48
from the plat that references the VDOF easement and changed the plat date to Revised August 91h, 2019. 1 think this
addresses all of your comments now. (see attached revised plat)

Hi Jeff,
Attached are the deed book instruments I was referencing during our discussion earlier. These are the same instruments
referenced in your application notes (Note 8). Looking over these two instruments, I found that one instrument was the
easement itself, which only applies to parcel 50-45B, and the other instrument is a BLA that added non -easement land
from the property you're working on to 50-45B. In summary, I was not able to confirm that the VOF easement exists on
TMP 50-44 or 50-44A1. Is there an instrument that I'm missing?

Attached you will find a copy of the revised SUB201900113 submitted plat and a comments addressed letter. Please look
at notes 7 and 8 concerning the Albemarle county and Virginia outdoors foundation open space easements. It is our
opinion that they are separate easements to separate entities if this not the case please clarify.

Hi, Mariah—
This BLA requires approval from the conservation easement holder. Fortunately, the landowner has already secured that
approval, as you'll see in the attached resolution.
However, note 8 on the plat is incorrect. The conservation easement is not held by the Virginia Outdoors Foundation,
but by the Albemarle Conservation Easement Authority (known back when this was recorded as the Albemarle County
Public Recreational Facilities Authority.) The earlier two deed references are for a VOF easement on adjacent parcels
under the same ownership, and not on this property.
So — note 8 should be replaced with something like:
Subject properties are under an open -space easement held by the Albemarle Conservation Easement Authority
(formerly known as the Albemarle County Public Recreation Facilities Authority per D.B. 3634 P.108.
