To Whom it May Concern:
In response to your request for a Letter of Zoning Compliance for the above -referenced
Property, please be advised of the following:
• The Property is zoned HC, Highway Commercial. The permitted uses of the Property are
provided in Section 24 of Chapter 18 of the Albemarle County Code ("Zoning Ordinance").
The Property is subject to the Airport Impact and Steep Slopes Overlay Districts described in
Section 30 of the Zoning Ordinance, but is not within the"safety area' referenced in Section
30.2.4.2 (Airport Impact Overlay) of the the Zoning Ordinance.
• More specifically, the following uses are permitted by right in the Highway Commercial
(HC) zoning district pursuant to Sec. 24.2.1 of the Zoning Ordinance:
a. Car washes.
b. Automobile, truck repair shops.
c. Churches, cemeteries.
d. Educational, technical and trade schools.
e. Home and business services such as grounds care, cleaning, exterminators,
landscaping and other repair and maintenance services.
f. Machinery and equipment sales, service and rental.
g. Offices.
h. Wholesale distribution.
i. Uses permitted by right pursuant to subsection 22.2.1 of section 22.1,
commercial, C-1, including: Barber, beauty shops.
j. Indoor athletic facilities.
k. Storage yards.
I. Manufacturing/Processing/Assembly/Fabrication and Recycling.
m. If the use is served by either public water or an approved central water supply:
n. Restaurants.
• The following uses are permitted by special use permit in the Highway Commercial (HC)
zoning district pursuant to Sec. 24.2.2 of the Zoning Ordinance:
a. Commercial kennels -indoor only (reference 5.1.11).
b. Stand alone parking and parking structures (reference 4.12, 5.1.41).

• There is no pending zoning map amendment, special use permit, conditional use, special
exception, or variance request on the Property.
• To the best of my knowledge, the Property and the existing uses are currently in
compliance with all applicable requirements of the Zoning Ordinance. A review of our
files found (i) no violations or alleged violations or regulations applicable to the
Property, whether pending, contemplated, or having already occurred, (ii) no fees due
or pending with respect to any matter before the County Zoning Office; and (iii) no
pending application for rezoning of the Property or for a special or conditional use
permit or variance in connection with the Property. Further, no proceeding to challenge the
zoning or other governmental approval or use of the Property is pending or overtly
threatened to the best of my knowledge.
• The existing building and the existing uses of the Property are permitted within the Airport
Impact Area (AIA) overlay district.
• No County consents or authorizations would be required to allow the above -referenced uses
to continue if ownership of the property changed.
No special or conditional use permits, proffers, variances, planned unit developments, or
related conditions and plans apply to the property except for except for SP1986-82 dated
February 9, 1987, permitting the use of the building located at 3036 Berkmar Drive to be
used as a kennel. The approval letter with conditions is linked below. A complete copy of
the file or parts there of must be processed by making a request to the Records Manager,
noted below.
• If the Property contained physical development approved with a site plan, then in the event
of casualty, the Property may be rebuilt substantially in the same form upon satisfaction of
all required building permits and site plans, as applicable.
• Copies of relevant records may be obtained via the noted links or the Community
Development Department Records Public Access link below. If unable to find the records, a
request through the department's Records Manager, Paul Bjornsen, at
pbiornsen0albemarle.org may be made. It will take longer to fulfill if the request is not
based in Virginia.
